As descri in the Modification Application,the Applicant is continuing to work with the Mass DOT with respect to traffic dessign matters,but a final Access Permit is not expected to be'issued for another several months. In order for Hillwood Enterprises,L.P.to close on the purchase of Lot B and to commence construction,both Hi lwood Enterprises,L.P.and the Applicant are requesting Planning Board approval of the proposed modifications,as described below,which in turn„would requhv a Modification to the Lot A Recision In order to implement the a improvements ents dictated by a letter to Mr.Mae 3tsey,Hillwood Enterprises,LP,from Paul D.Stedman,District 4 I-Eghway Director,Mass DOT,dated July 3 o,2020 the`MassDO T Mitigation Leftel. The public hearings 109 on the above referenced appficafions were opened on September 15,2020,and closed by the North Andover Plann.ing Ekwd on October 6,,2020. The Applicant submitted the Modificafion Application and other supplemental document of record M conforma=with the requirements of the`North Andover&ning Bylaw,which were noticed and rem-ewed in a=zdance with(Article 8,Part 3[Site Plan Review]; Article 8, It Part Is,§195-8.8.[Pwking Special Permits);Axticle 2,§195-2.2.[Common Driveway Special Permit3;and, Article 10,§ 195-103A[Special Permit-General],of Chapter 195—North Andover Zonin Bylaw), =9 (Article 8,Part 12(Site Plan Review);Aracle 8,Part 12,Section 195-8.98[Setback Modification Special Permit];and,Article 10,§ 195-10.7A[Special Pc it-General],of Chapter 195—North Andover Zoning Bylaw)and MOIL c.40A,Sec.9. The Planning Board voted una ously(by a vote of 4—0)to approve the Modification to Site Plan Review,Parldng,and Common Driveway Special Permits,and to approve the Large Scale Ground Mounted Solar Energy System We Plan Review, as well as the Solar Energy System Setback Modification Special Permit. A special permit'issued by the planning board,as special permit granting authority, requies a vote of at least four members of a five-member board, Planning Board members participafing throughout the hearing process were:Eitan Goldberg, Chair;Peter Boynton;Kelly Comfier; and Aaron Preston.
