The Pl =g Board herein APPROVES a modification of the Rewvalion Project and the Sow Project as
descaibed in the Dart A Decision,as fiuther described below(this"Lot A.Modification Decision').
As descri in the Modification Application,the Applicant is continuing to work with the
Mass DOT with respect to traffic dessign matters,but a final Access Permit is not expected to be'issued for
another several months. In order for Hillwood Enterprises,L.P.to close on the purchase of Lot B and to
commence construction,both Hi lwood Enterprises,L.P.and the Applicant are requesting Planning Board
approval of the proposed modifications,as described below,which in turn„would requhv a Modification
to the Lot A Recision In order to implement the a improvements ents dictated by a letter to Mr.Mae
3tsey,Hillwood Enterprises,LP,from Paul D.Stedman,District 4 I-Eghway Director,Mass DOT,dated
July 3 o,2020 the`MassDO T Mitigation Leftel.
Special Condition No.74 of the Lot A Decision states that in the event.MassDOT requires a
material change(as deemed by the l i�g it r)in the access/egress s or other details depicted on the,
Plans and/or Conceptual Off-Site Improvement Plan dated July 19,2019(include but not limited to
details listed in:findings of Fact Renovation Project ect#9 and.#9 in this decision),the .p ►lic t shall
submit revised Flans to be reviewed in accordance with the process described in Section 195- .17
(Revisions to Approved Site Plan). 'while the changes described in the MassDOT Mitigation Letter
would trigger modifications to both the site plan rev ie v and common driveway special permits desezibed
ioa the Lot A Decision*the Applicant is also requesting approval of the modification of the Parking Special
Permit,Large Scale Ground Mounted Solar Energy System Site Plan Review and Solar Setback
Modification Special Permit described in the Lot A Decision with the sole purpose of ensur'ing that all
approvals,as modified,for Lot A.are g+ovemed by the same set of record"P e'(,as defined below).
Moreover,Special Condition No-93 of the Lot A Decision requires the Applicant to-implement
certain recommendations of the Board's peer review stormmwater management consultant,Horsley Witten
Group,includ' the provision of seasonal high groundwater elevation and infiltration Tales,in the
proposed location ofthe infiltration systems. .As a result of that data,which is contained within
Storrnwater Management Report(Revised August 2020),and the Mass DOT N 'tigation Letter,the
Applicant is,also making adjustments to the storm water management facilities and parking areas a
further described below to ensure that the Project continues to maintain compliance with stag and local
sto n waterr management requirements.
Additionally,both the configuration of Lot A and Lot B previously approved and endorsed by the
Planing Board through the A R Lot endorsement process Will be slightly adjusted so that a 9,710+/
s,f:area of areal property previously approved as a pant of Lot B at the signalized North Entrance to the
Site as defined below)will now become a paxt of Lot A.such that Lot B is now proposed to be 4,796,989

The Planning Board voted una ously(by a vote of 4—0)to approve the Modification to Site Plan
Review,Parldng,and Common Driveway Special Permits,and to approve the Large Scale Ground
Mounted Solar Energy System We Plan Review, as well as the Solar Energy System Setback
Modification Special Permit. A special permit'issued by the planning board,as special permit granting
authority, requies a vote of at least four members of a five-member board, Planning Board members
participafing throughout the hearing process were:Eitan Goldberg, Chair;Peter Boynton;Kelly Comfier;
and Aaron Preston. Planning Board Member Kate R.Bargnesi was recusod from the hearings and did not
participate in the votes described herein.
The Applicant'is hereby notified that should the Appficant disagree with this decisim the Applicant has the
light utl&r MGL Chapter 40A,Section 17,to appeal to this decision within twenty days after the date this
deoisw' n has been filed with the Town Clerk.
FINDINGS OF FACT
I This Lot A Modification Decision expressly incorporates, and reaffirms,all of the Findings of
Fact described in the Lot A Deef sion,exmpt as amended as follows:

wide strip of land parallel and adjacent to the State Highmy Layout BLt for.route 125 along

of the SUP)to be constructed by others.
