Conservation Conditions of Approval, NACC #363
Pursuant to section 4.4.2 of the North Andover Wetlands Protection Regulations, the
applicant/homeowner Dana Brown, filed for a Small Project Permit application under Category "B", for
work proposed at 30 Summer Street, North Andover. The work involves: The reconstruction of an
existing deck,which is 84 feet to the BVW at its closest point (BVW is located on the far side of the
existing stone wall at the rear of the property). Six (6) new 12" footings (to be 4' deep) will be installed, and
five (5) existing footings will be replaced. A mobile trailer will be used and-,viu be parked on the driveway
for construction and demolition debris to be hauled away from the worksite. The end of the driveway
abuts the deck area for direct access to the work area. All the work will be done by hand using small
portable power tools.
During the May 13, 2026 the North Andover Conservation Commission (NACC) found this project to
qualify as a Small Project Permit and voted unanimously to approve this project as proposed under Cate go
`B"for replacement of existing decks,regardless of size outside the 50' NBZ, subject to compliance
with the conditions listed below. The project is approved only as it relates to d-le Conservation
Commission and any and all other approvals should be obtained by the applicant/homeowner.
All work shall conform to the following:
RECORD DOCUMENTS: Small Project Filing Including:
• Application Checklist with supporting narrative and attachments,
stamped received April 29, 2026;
• Deck Rehab Aerial with wetland measurements.
The following conditions are hereby mandated:
CONDITIONS:
1. Prior to construction, erosion controls in the form of 8" straw wattle shall be installed and staked
according to the instructions of Conservation staff
2. A pre-construction site inspection shall be scheduled with the Conservation Department and the
contractor to review erosion control installation and project scope.
3. A post construction site inspection shall be scheduled with the Conservation Department to verify
compliance and approve removal of erosion control,
4. This permit is valid for one (1) year from the date of issuance.
The applicant, homeowner and their contractors are advised that NO other work on the
property is allowed under this permit. The NACC has jurisdiction over all of the wetlands and
associated 100-Foot buffer zones and 200 Riverftont Area to the Shawsheen River on site and any work

that involves ground disturbance or changing the current conditions in these areas will require
permitting with the NACC. This includes,but are not limited to house additions, pools,patios decks,
sheds, fences, garden beds, landscaping and bridge installation, tree or vegetation cutting/pruning. These
activities shall be held to the current standards under the Bylaw and WPA.**
