' # T NOTICE OF DECISION SUBSTANTIAL CHANGE) Date of Decision:: ct ber 3 2023 Petition of., Osgood Route-125 Project,LLC 5050 W.Tilghman Street I Suite 435 Allentown,PA 18104 re ises Affected 1450 Osgood Street(Map 34,Lot .5 North Andover,N.01845 BACKGROUND n May 20,2020 the Planning Board approved a"Notice of Decision—Site Plan Review,Parking,Common Driveway,Building Height,and Floor Area Ratio SpecialPermits,"'as amended by a `Notice of Decision (Modification)—Site Plan Review,Parking,Common Driveway,Building Height,and Floor Area Ratio Special Permits,"dated October 6,2020 (collectively,the"Lot B Decision"). The Lot B Decision authorized the development of an approximate 3.8 million s.f`. warehouse and distribution facility leased to Amazon,and the building,parking and associated improvements are substantially complete, n September 28,2023 the Applicant requested,pursuant to Condition No. 12 of the foot B Decision, approval o the following panting and related adjustments as a minor modification and an insubstantial change to the approved site plan. Specifically,the Applicant is seeking to convert an existing paved parking area into a new bus stop available for use by the Merrimack Valley Regional Transit Authority 1 VRTA,and now known as MEVA as part of its route to provide public bus service to the Amazon facility. This bus stop area is depicted on the sketch plan attached as Exhibits A and B. As background concerning this change,the following is noted: 1. Over the past number of months,the Applicant has been meeting with.representatives of MEVA.and M1 Amazon to implement measures designed to encourage the use of public transportation as required under the Community Benefits Agreement,dated February 8,2021,entered into by and among the Town, i l lwo o d,and Amazon; 2# This consultation was also required under Condition 100.c of the Lot B Decision which states that the Applicant shall coordinate with the MV A(oar M VA.) for bus service; and, 3. Based upon those discussions, it has been determined that there is a need to locate a bus stop area on a portion of the Property located southeast of the existing building entrance in an existing paved parking area, as depicted on the plans attached as Exhibits A.and B.It has been determined that the existing bus stop location in front of 1600 Osgood Street is not adequate to service the facility, MINGS OF FACTS 1, McVa Transit has along history of serving Osgood Landing with the 414 bus route running from the Haverhill Transit center to the ward Hill Industrial Park and then south along Route 125 to Osgood Landing, Prior to construction,the bus route traveled south down Route 125 entered the property and dropped off passengers at Osgood sanding before turning around and heading north on Route t 2 , returning to downtown Haverhill, At Amazon's request,service to Osgood Landing was temporarily suspended during construction,always with a plan of returning the route to its original configuration once :. they were cleared to resume service, r Insubstantial Change 1450 Osgood Street{Map 34,Lot 1 October 3,2023 2. The proposed route and location have been reviewed by MEvA and they are in support of the proposed location, As stated In a letter dated October 2,2023 from Noah S.Berger,MVRTA Administrator,"We agree that the proposed configuration best serves Amazon employees,who will now be afforded easier access to the Amazon facility than they would have at our original pick-up and drop-off location which was closer to Route 12 and without sate pedestrian passage", 3, The proposed location of the bus stop area is located on an existing paved area,so there will be no changes to stormwater management. Minor revisions to curbing,striping and signage are required in addition to two 2 new bus shelters. 4. While the bus stop facility would be placed xn an area previously approved for 44 parking spaces, it is } noted that a total of 1,759 passenger vehicle spaces would remain available for Amazon's use. Amazon has infornned the Applicant that the adjusted parking would continue to support the needs of Amazon's on's operations,and that the mntroduction of more convenient public transportation services world,mi fact, reduce the use of,and need for, on-site passenger vehicle parking. The additional tuns into the site resulting from the proposed bus stop will not affect operation of the signalized southern driveway entrance. 5. The Applicant has also reviewed the parking use classifications originally approved for the Project,and based upon Amazon's operations,adjusted the classification of a small percentage of square footage i.e;, o from.`warehouse''use .7 spaces per 1,000 st. A to"Other industrial and transportation uses not otherwise listed (As determined by the Planning Board,but not less than 0.25 per ksf 'A "due to the fact that e-commerce use and robotics uses are unique and do not squarely fit within other categories listed in the Table of Parking Regulations. As a result of the adjustments as depicted on the parking table attached as Exhibit C,the adjusted parking continues to comply with the Zoning Bylaw notwithstanding the conversion of existing parking spaces to a bus stop area. . In conjunction with these adjustments, stop"and"do not enter"'sign age in this area will be ad, ted as shown on the plans which was previously approved in the April 26,2022 Sign Master Plan Special Permit Decision(the `Lot B Sign Master Plan Decision"). DECISION . ter discussion at the October 3,2023 Planning Board meeting, and upon a motion by P, Boynton, seconded by J. Simons,the Planning Board voted to approve the Insubstantial Change request for 1450 Osgood Street(Map 34,Lot 1 based on the Findings of Facts and Conditions herein. The vote was -0, in favor of the request. r CONDITIONS The Applicant shall comply with all existing conditions rendered in the Special Permit, except for specific conditions superseded by this Notice of Decision-Insubstantial Change. Applicant shall provide Hula the opportunity to confirm maneuverability for their buses. Evidence of said confirmation shall be provided to the Planning Department prior to operation of the bus service to the 3 Property. The two shelters shown on the Plan shall be l eVa's standard 12-foot shelters. Any action by a Town Board, Commission, or Depatiment, which requires changes in the Plan or design, as presented to the Planning Board,may be subject to modification by the Planning Board. Any revision shall be submitted to the darning Direotor for review. If the revision is deemed substantial, the applicant must submit revised plans to the Planning Board for approval using the process outlined in Section i 9 - .i 7 (Revision to Approved Site Plan)of the Zoning Bylaw.
