BACKGROUND
On May 20,2020 the Planning Board approved a"Notice of Decision—Site Plan Review,Parking,Common.
Driveway,Building Height, and Floor Area Ratio Special Permits,"as amended by a"Notice of Decision.
(Modification)--Site Flan Review,Parking, Common Driveway,Building Height,and Floor Area Ratio Special
Permits,"dated October 6,2020(collectively,the"Lot B Decision"). The Lot B Decision authorized the
development of an approximate 3.8 million s.f.warehouse and distribution facility leased to Amazon, and the
building,parking and associated improvements are substantially complete.
On October 3,2023 the Applicant requested,pursuant to Condition No. 122 of the Lot L Decision,approval of
parking adjustments and related adjustments as a miner modification and an insubstantial change to the approved
site plan. Specifically,the Applicant is seeking to convert an existing paved parking area into a new bus stop
available for use by the Merrimack valley Regional Transit Authority(MVR.TA,and now known as VA)as part
of its route to provide public bus service to the Amazon facility.
On April 9,2025 the Applicant requested,pursuant to Condition No. 122 of the Lot L Decision,approval of
proposed parking adjustments a a miner modification and an insubstantial change. Specifically,the Applicant i
requesting approval to convert an existing row of parking spaces into a designated drop-off and pick-up area. This
modification is intended to improve site circulation,enhance pedestrian safety,and better align with actual site
usage patterns.

The proposed location of the drop off area is located on existing paved area, so there will be no changes to
impervious area. R.estriping,curb island removal,bollard installation and relocation of an existing fire hydrant
approximately thirteen feet west will be required.
While the drop off area would be placed in an area previously approved for 42 parking spaces,it is noted that a total
of 1,714 passenger vehicles spaces would remain available. The number of required parking spaces on site is 1,713.
DECISION
.After discussion at the May 6, 2025 Planning Board meeting, and upon a motion by S. Keviahar,,
seconded by P.Boynton,the Planning Board voted to approve the Insubstant a,l Change regiicsi for )450
Osgood ,Street(Map 34,Lot t 5)based on the Findings of Facts and Conditions 11 -was 3-A+
in favor of the request.

The Applicant shall comply with all existing conditions rendered in the Special Permit, except forspecific

conditions superseded by this Notice of Decision Insubstantial Change.
No additional speed bumps shall be introduced as a result of this Insubstantial Change.
Any action by a Town Board, Commission, or Department, which requires changes in the Plan or design,
as presented to the Planning Board,may be subject to modification by the Planning Board.
Any revision shall be submitted to the Planning Director for review. If the revision is deemed substantial,
the applicant must submit revised plans to the Planning Board fora approval using the process outlined in
pp g
Section 195-8.17 (:Revision to Approved Site Plan)of the Zoning Bylaw.

This Decision shall be recorded with the Northern Essex:Registry of Deeds and evidence of recording
shall be provided to the Planning Department.
