• The Administrator presented the project for construction of an in-ground pool,patio and infiltration trench,
deck reconfiguration,pool fencing, and relocation of the septic system to the front of the house, outside the
Buffer Zone.
• Ryan Roseen of Goddard Consulting and the homeowner, Tanner Comfort,were present.
• The Administrator reported that site investigations confirmed the wetland functions as a Vernal Pool based
on the presence of fairy shrimp and is certifiable with the state. The wetland delineation was confirmed as
accurate with no flag changes. The wetland is an Isolated Vegetated Wetland(IVW),jurisdictional under the
local Bylaw only, and is primarily located on an abutting property. The project was designed to maintain the
50-foot NDZ and 75-foot NBZ to the Vernal Pool. Construction access, stockpiling, and dewatering areas
are shown outside the 100-foot Buffer Zone.
• Mr. Mustain asked about drainage near the stockpile area. Mr. Roseen stated the area is generally flat and
erosion controls will be installed,with additional controls added if needed.
• Mr. Mustain asked about pool drawdown and discharge. Mr. Roseen stated the infiltration trench includes a
pop-up emitter outside the 75-foot Buffer Zone, and pool backwash and drawdown will be directed away
from the wetland and allowed to infiltrate in a wooded area. The pool is proposed as a saltwater pool.
• Ms. Valentino asked about fencing. Mr. Roseen confirmed the revised plan includes fencing around the
pool.
• Ms. Valentino recommended installation of markers along the wooded edge of the 50-foot NDZ. The
Commission discussed spacing and agreed markers should be installed approximately every 30 feet,
mounted low to the ground, and affixed to either posts or trees, as appropriate. This will be included as a
condition in the Order.
• Mr. McDonough raised concern regarding the existing lawn area located within the 50-foot NDZ and
requested that area be allowed to revegetate naturally. The Applicant agreed.
• The Administrator noted there is an outstanding 1978 Order of Conditions on the property for construction
of the house and draining the wetland to elevation 100 that has not been closed out. The Applicant is
working to submit a Certificate of Compliance request for that file. The Administrator recommended
continuing the hearing to allow time for the Certificate of Compliance filing and review.
• Ms. Valentino requested the Applicant coordinate with the Board of Health regarding abandonment of the
existing septic system. The Administrator noted the new septic system has been approved by the Board of
Health.
• No abutters were present.

• The Administrator provided an overview of the project,noting this is a septic system upgrade involving
installation of a Presby-Enviro septic system. The Board of Health required a minor adjustment to the pipe
layout; the revised design remains outside the 50-foot NBZ. The Administrator confirmed coordination with
the Health Inspector,who has approved the system.
• A draft Order of Conditions was prepared for review.
• No abutters were present.
• A motion to close and issue in 21 days was made by Mr. Mustain, seconded by Ms. Valentino.

• The Commission reviewed the draft Order of Conditions. Minor revisions were made, including clarification
to Condition 43 regarding inspection of the closest point of construction near the 50-foot NBZ, and adding
"perimeter"to erosion control language in Condition 44.
• A motion to approve the Order of Conditions as drafted and amended was made by Mr. Mustain, seconded by
Ms. Valentino.
• Vote: 4-0-1, (In Favor: White,Mabon,Valentino, Mustain,Abstained: McDonough).
