In accordance with Section 8.1.8_ a "Common Parking Areas and Multiple Use `aciliti s" the Project will involve parking for presidential uses,which will compliment a combination of aretail, restaurant, office uses on the real property and parking for the sarne adjacent to the Site,and the hours, days,or peak parsing or loading demand for the residential uses are so different from the proposed non-residential uses proposed adjacent to the Site,that the proposed number of Project spaces will provide adequately for all uses or activities served by the parking Facility, and the location of the pang facilities relation to the uses proposed to be served by 'it is appropriate. The stonnw ter management is designed in accordance with the'down Bylaw requirements and Best Management Engineering and rrii� lcs,and the most recent version of the MA DEP Stor water Handbook, and the Revised Site Plan reflects extensive discussions and review by the Town's outside consultant engineer,Eggleston Environmental.As shown on the kevlsed Site Plans, the proposed runoff from the lmperlous areas of the Site will be drained through drainage system to subsurface storage/infiltrating detention systems. The roect's permanent ton water measures include; deep sump catch basins with hood outlets(39 total),ADS Storrntech Underground Chambers Isolation Row 13 total), RainStore3 Underground Chamber and Infiltration Systems 11 systems total)and Rip.-Rap Aprons 4 total), There were extensive discussions between the Town's outside peer review consultant engineer and the ProFeot Engineer related to the overall modified stonnwater managernent design and long term Stormwater Operations&Maintenance Flan.(See correspondence from L Eggleston,Eggleston Environmental, dated November 29,2017,December 19,2017and January 12,2018 and Hancock Associates response comments through November 2 ,2017,December 15,2017, January 12,2018 and email dated January 16,2018). 12. The Plan reflects extensive discussion and review with TEC,Jnc.,the 'o n's civil peer review consultant and meets the requirements of the TowD for Site Playa Review as stated in Section 8.3 of the Zoning Bylaw. (See memos dated July 22,2016, September 29,2 016 and October 3 1,2016 and H nco k,Associates response comments t xough October 31,2016). 13, The North Andover Public School Assistant Superintendent,James Mealey,has reviewed the project and concurs with the,estimated school impact given the proposal 's for one and two bedroom units,and that the Project does not include nun affordable rental component, (See September 6,2016 Ply meeting minutes and Memo from Jeff]gown dated September 1,2016). . The Landscape Plan reflects extensive discussions in regards to the connective spine,"'Main Streee'that connwts and integrates the residential component with the,adjacent proposed commercial component of the mixed use development.moose common corridors re been designed and will be constructed to meet AA accessibility requirements. 15. See Woodard&Curran memo dated November 29,2016 and T.wll et DPW Operations Manager,memo dated f ecembie.r 1,2016). 16, The Town Engineer,John Borgesi,has reviewed the Project and has con w ed that all } engineering department comments have been adequately addressed(See memos dated July 2 , f 2016 and September 27,2016). t 17, The North,Andover Fire Departrnent, including Chief William McCarthy and Lieutenant Robert rt on n an ,as well as Jennifer HoA Cie e Protection Engmeer of the Massachusetts Department of Fire Services,have reviewed the Plans and determined that the final design addresses all of the concerns the Fire Department had over the additional hydrant and access to the Project for firefigMing and rescuo operations,(See Lt.Bonenfant memo correspondenoe dated October 4,2016). 18. The Applicant has filed a Notice of Intent(N01)with the Conservation Commission and received an Order of Conditions,DEP No. 2- 692 dated January 11,2017. 1 . The Project will require a National Pollutant Discharge Elimination Systern DIES Construction General Permit(CGP)to be died with and obtained from the United States Environmental Protection.Agency. 20; The Site was reviewed pursuant to the Massachusetts Enviro=ental Policy Act(MEPA)during the 2001 permitting process. 21. The Massachusetts Department of Transportations(MassDOT)Highway Division is granted authority to issue State Highway Access Permits and Nora-ve io l r Access ' nits by M-G,L Chapter 8 1, Sec.21 and 720 CMR 13.00 for any work related to State Route 125 which is a state jurisdictional highway. 22. The Project will require are Airspace review by MassT's Aeronautics Division and review by the FAA,based upon its location and elevation. AMMNDIED FMINGS ofFACTS: 23. Changing the elevation of the site does not change In any respect the vast majority of the features of the nixed-use development: a. There are no cbanges to the location, number, size and height of any buildings in the mixed-use development. b. There are no changes to the locations and size of any ancillary features of the,mixed- use developmemt including the access drive,pedestrian corridors,landscaping, and the size and curvate of the interior roadways (foe emergency vesicles). c. 'here are no changes In the utility and municipal service needs. 24 The redesign of the site grades and elevations also has a number of positive impacts that benefit the Town and Developers a.
