Massachusetts General Laws, Chapter , Section 54A, provides that no pity or, town in, the
Commonwealth shall issue a permit t 'build a structure f' any kind on land "formerly used as a �
railroad right-of-way or any property appurtenant thereto formerly used by any railroad company 111
the Commonwealth," without the writ,ten' consent of the Secretary of the Massachusetts Department,of
Transportation. ' r ua t to, the intent of this statute, I have the responsibility to preserve former
railroad property in the Commonwealth for present or future transportation.-related use where
appropriate.
After reviewing of rm tion on rile at our, office, canvassinginterested agencies and
conductinga public hearing on September 10, 2018, it has been determined that the u o ed
construction ctio will not, adversely impact potential, transportation uses. Accordingly, I give my consent
to the issuance a f a building perm for the above-referenced construction as detailed the
application material.
