(Condition 34):The NACC finds that the intensive use of the upland areas and buffer zone proposed on this site will cause further alteration of the wetland resource areas. In order to prevent any alteration of wetland resource areas a twenty-five foot 5' Igo-Disturbance lone and a fifty foot 50`)l No- Construction Zone shall be established from the edge of the wetland resource areas.The Conservation Admi nistrator and/or other agents of the NACC do not have the authority to waive these setbacks as established under the local Bylaw. No disturbance of existing grade, sells or vegetation is permitted in the no-disturbance zone. Future work within the wetland or within 100,feet of the wetland shall require separate permitting with the Conservation Commission, 2. (Condition #501): The existing wetland markers attached to the chain-link,fence, incorporating the following text: "Protected wetland Resource Area" and the associated rules shall remain.These markers will designate the sensitivity of the resource area and assure no further inadvertent encroachment into the wetland. The applicant shall instruct all agents to explain these markers to buyers/lessees/landscapers and all persons taking over the property from the applicant. These markers shall remain posted and be replaced as necessary in perpetuity. Markers are available from the Conservation Department($2 round and $B square). 3. (Condition 5 );All stormwater best management practices shall be maintained as specified in the existing SwPPP submitted and referenced in the Notice of Intent.The SwPPP will be incorporated in the Order of Conditions. The approved SwPPP is fully binding upon the applicant and/or owners, successors, agents, associations, heirs and assigns and must be adhered to in perpetuity. Copies of the annual maintenance reports shall be maintained in perpetuity with a prier 5 year,period available upon request for review by the NACC or its agent at any time. 4. (Condition# 9):The applicants, owners, and their successors and assignees, shall maintain, in perpetuity all swales, grassed channels, deep surnp catch basins, outlet structures, stone infiltration basins, and other elements of the drainage system, in order to avoid blockages and siltation which might cause failure of the system and/or detrimental impacts to on-site or off-site resource areas, and shall maintain the integrity of vegetative cover on the site. 5. Condition #71).- There shall be no discharge or spillage of fuel, or,other pollutants into any wetland resource area If there is a spill or d'ischar;ge of any pollutant the NACC shall be notified by the applicant within one 1 business dray. No construction vehicles are to be stored within 1001 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 1010 feet of a resource area. (Condition #72): No underground storage of fuel oils shall be allowed within one-hundred (100) feet of any wetland resource area. 7. (Condition#73): Fertilizers utilized for landscaping and lawn care shall be slow releas�e, low-nitrogen types (< 5%), and shall not be used within 25,feet of a resource area. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. 8. (Condition #75):There, shalll' be no dumping of leaves,grass clipipinigs, brush, dog waste, or other debris into a wetland resource area or beyond the No-Disturbance Zone demarcated by the posts and/or wetland markers. This condition shall survive the issuance of a Certificate of Compliance. 9 (Condition#74):The use of coal tar-based pavement sealants is prohibited on the property, as they have been determined to contribute high levels of polycyclic aromatic hydrocarbons (PAHs) to stormwater runoff.
