• The Administrator presented a request for a corrected Partial Certificate of Compliance (PCOC) for 315
Candlestick Road. She explained that the PCOC had previously been issued twice; however,both versions
referenced an incorrect book and page number for the recorded Order of Conditions. The correction was
requested to reflect the proper recording information(Book 29971, Page 2) as the property is currently
undergoing a transaction.
• Commission members sought clarification regarding the request and confirmed that no new PCOC
determination was being made. The action before the Commission was solely to correct the recording
reference on the previously issued PCOC. Questions were also raised regarding the status of the prior
incorrectly recorded PCOCs. The Administrator indicated that a note could be added stating the previously
recorded PCOCs are null and void to avoid future confusion.

• A motion to issue a corrected Partial Certificate of Compliance was made by Mr. White, seconded by Ms.

• The Administrator presented a request for a Certificate of Compliance for the GLSD Pump Station at 0
Riverview Street. The Order of Conditions was issued in October 2015 for the removal of an existing concrete
equipment pad, construction of a new exterior switchgear pad and associated electrical equipment, installation
of underground electrical conduits, and milling and repaving of the site access drive and parking lot.
• The Administrator explained that the work occurred within the Riverfront Area, Buffer Zone, and Bordering
Land Subject to Flooding,with no impacts to flood storage capacity. The switchgear pad was rotated and
shifted slightly farther from the wetlands than originally approved. Stormwater operation and maintenance
reports were provided through March 2026, and site work was completed in May 2016.
• Following a site inspection,the Administrator reported that no outstanding issues were identified and that
wetland markers were installed along the perimeter chain-link fence. The Administrator recommended
issuance of a full and final Certificate of Compliance with ongoing conditions as prescribed in the Order.
• Milagros Puello of the Greater Lawrence Sanitary District was present.
• A motion to issue a full and final Certificate of Compliance was made by Mr. McDonough and seconded by
Ms. Valentino.

• The Administrator presented a request for a Partial Certificate of Compliance for 51 Colonial Drive (Lot 5).
The Order of Conditions was issued in January 1993 for the construction of a 29-lot residential subdivision
with associated roadways,utilities,wetland replication areas, and stormwater management structures.
• The Administrator explained that the Applicant's engineer had submitted a certification letter noting
deviations from the approved plan. During file research, staff located a January 16, 1998 memorandum from
former Conservation Administrator Mike Howard indicating that staff was prepared to recommend issuance
of a Partial Certificate of Compliance for Lot 5. The Administrator noted that the house is located
approximately 83 feet from the wetland and the toe of the riprap slope is approximately 25 feet from the
wetland, consistent with distances referenced in the memorandum. The site is fully stabilized,wetland
markers are installed, and no evidence of violations was observed during a recent site inspection.
• Mr. McDonough asked whether the identified modifications warranted a modification to the Order of
Conditions prior to issuance of the Partial Certificate of Compliance. The Administrator explained that the
modifications were minor,no violations were observed on site, and staff was comfortable recommending
issuance of the Partial Certificate of Compliance based on the site conditions and prior file documentation.
• Ben Osgood of Ranger Engineering was present.
• A motion to issue a Partial Certificate of Compliance was made by Mr. White and seconded by Mr. Bohenek.

• The Field Inspector/Planner presented the proposal for the replacement of an existing wood stockade fence.
The project was reviewed under Category"H",which allows fences and stone walls that do not alter the flow
of surface water or wildlife habitat and movement.
• The Field Inspector/Planner explained that the proposed fence would be an exact replacement of the existing
damaged fence,maintaining the same location, style, dimensions, and footprint. The replacement fence will
be approximately 65 feet in length and 4 feet in height. The closest point of work is approximately 80 feet
from the BVW.
• The Field Inspector/Planner recommended that the Commission find the project qualifies as a Category"H"
Small Project and approve the application with conditions, including a pre-construction site inspection,

removal of excess soil from post holes to a location outside the 100-foot Buffer Zone, and a post-construction
site inspection to verify compliance.
• A motion to approve the project as a Small Project Category"H"with conditions as recommended was made
by Ms. Valentino and seconded by Mr. Bohenek.

Enforcement Order/Violation
981 Johnson Street—EO Follow Up (Bohenek)
• Commission member Matthew Bohenek recused himself from the discussion and vote and participated as the
homeowner.
• The Administrator presented a request to lift an Enforcement Order issued in December 2017. The
Enforcement Order addressed violations inherited from a previous property owner and required removal of an
unpermitted and failing retaining wall,regrading and stabilization of the slope, installation of plantings, and
installation of a fence at the top of the slope.
• The Administrator reported that restoration photographs from 2018 documented completion of the required
work and that a recent site inspection confirmed the slope was fully vegetated and stabilized. Wetland
markers were installed on the fence, and no outstanding compliance issues were identified. The Administrator
recommended that the Enforcement Order be lifted.
• A motion to lift the Enforcement Order was made by Mr. White and seconded by Ms. Valentino.

• Commission member Matthew Bohenek recused himself from the discussion and vote and participated as the
Applicant.
• The Administrator presented a Small Project Application involving after-the-fact hardscape improvements
and proposed landscape plantings. The after-the-fact work included replacement of a failing retaining wall,
front stairs, and walkway. The Administrator explained that most of the work occurred outside the Buffer
Zone and that the house is located between the work area and the wetland resource area.
• The proposed work includes foundation plantings and landscape beds,portions of which are located within
the outer reaches of the 100-foot Buffer Zone. The Administrator recommended approval of the hardscape
improvements under Category"L" and the landscaping under Category"G",with a condition requiring a
post-planting inspection by the Conservation Department.
• A motion to approve the project as a Small Project under Categories "G"and"L",with conditions as
recommended,was made by Mr. White and seconded by Ms. Valentino.

• The Field Inspector/Planner presented the proposal for the in-kind replacement of an existing deck at 164
Bridges Lane. The project was reviewed under Category"B"and involves replacement of the existing deck
boards,railings,posts, and footings. Existing 4x4 posts and 8-inch concrete footings will be replaced with 6x6
posts and 12-inch sonotube footings. The post closest to the BVW, located approximately 48 feet from the

Resource Area,will utilize a diamond pier footing to minimize ground disturbance. All work will occur
within the existing gravel area beneath the deck and will be completed by hand.
• Commission members discussed whether the in-kind replacement of the existing post within the 50-foot NDZ
would require a waiver under the Small Project Bylaw. The Administrator noted that the deck has existed in
its current location for many years and that the proposed work constitutes an in-kind replacement of an
existing structure. The Administrator further explained that the use of a diamond pier footing would minimize
ground disturbance at the post located closest to the BVW. Following discussion,the Commission agreed that
the project qualified as a Category"B" Small Project. Mr. McDonough expressed concern that the
replacement footing located within the 50-foot NDZ did not meet the requirements of the Small Project
Bylaw.
• Paul DeLuca,homeowner,was present.
• The Field Inspector/Planner recommended approval of the project with conditions, including pre- and post-
construction site inspections by the Conservation Department.
• A motion to approve the project as a Small Project under Category"B",with conditions as recommended,
was made by Mr. White and seconded by Ms. Valentino.

• The Field Inspector/Planner presented the proposal for pruning existing vegetation,planting native vegetation,
and gardening. The project involves the installation of native plantings around a Town-owned pump station
located in front of the property. Proposed plantings include inkberry,witch hazel, and arrowwood viburnum.
• The Field Inspector/Planner noted that DPW had been contacted by the homeowners and granted permission
for the proposed work. All work will be completed by hand. The pump station is located outside the 50-foot
NBZ,with a portion of the work area located within the outer 100 feet of the 200-foot Riverfront Area
associated with Mosquito Brook.
• Shara Hall and Kerry Levenberg, the homeowners,were present.
• The Field Inspector/Planner recommended that the Commission determine the project qualifies as a Category
"G" Small Project and approve the project with conditions requiring a pre-work site inspection to review the
scope of work and a post-work site inspection to verify compliance.
• Commission members expressed support for the project and noted the proposed improvements would enhance
the area.
• A motion to approve the project as a Small Project under Category"G",with conditions as recommended,
was made by Mr. Bohenek and seconded by Ms. Valentino.

• The Administrator presented the proposal for the in-kind replacement of an existing 30-foot round above-
ground swimming pool. The applicant purchased the property in 2022. The existing pool is visible in aerial
photography dating back to at least 2001; however,no Conservation Department or Building Department
permits were found on file for the pool.
• The Administrator explained that the pool wall recently collapsed,requiring replacement of the entire
structure. The applicant subsequently submitted a Small Project application and a Building Permit application
for the in-kind replacement. The proposed pool will remain in the same location and dimensions as the

existing pool. The pool is located greater than 100 feet from the pond bank and approximately 75 feet from
the stream along the easterly property boundary.
• Ilir Kavaja,the homeowner,was present and stated that the pool was in place when he purchased the property
and had assumed it had been properly permitted by a previous owner.
• Commission members discussed the proposed work and whether the project qualified as a Small Project
under Category"L."Ms. Valentino requested confirmation that the pool would continue to utilize a cartridge
filter and that no backwashing would occur. Mr. McDonough stated that while he supported the project,he
questioned whether the proposal qualified as a Small Project under Category"L."Mr. Kavaja confirmed that
the existing cartridge filter would be retained and that no backwashing would occur. The Administrator noted
that the work would involve minimal disturbance, limited primarily to leveling the existing sand base beneath
the replacement pool.
• The Administrator recommended that the Commission determine the project qualifies as a Category"L"
Small Project and approve the project with conditions requiring a pre-work site inspection and continued use
of a cartridge filter with no backwashing.
• A motion to approve the project as a Small Project under Category"L,"with conditions as recommended,
including the continued use of a cartridge filter and no backwashing,was made by Mr. White and seconded
by Ms. Valentino.

Request for Determination of Applicability

• Hailey Page, Environmental Scientist, and Joseph Fitzpatrick, Project Manager, of Weston & Sampson
presented the proposal on behalf of the Town of North Andover DPW. Mr. Fitzpatrick explained that the
project is associated with the existing fueling station at the DPW facility,which serves municipal vehicles,
including DPW, Police, and Fire Department vehicles. The existing underground storage tanks were installed
in the early 1990s,have exceeded their 30-year warranty and have surpassed their useful life. The proposed
subsurface investigations will evaluate existing site and soil conditions to support the design of future fuel
island improvements. Mr. Fitzpatrick noted that a separate Notice of Intent will be submitted for the future
construction phase of the project.
• Ms. Page reviewed existing site conditions and resource areas, including Inland Bank, Bordering Vegetated
Wetland, Bordering Land Subject to Flooding,Riverfront Area, and associated Buffer Zones. She noted that a
previously identified stormwater channel had since been determined to be a maintained stormwater feature
and therefore non jurisdictional.
• The project includes five soil borings, consisting of three borings at the existing fuel island and two borings at
the waste oil tanks. One boring will be utilized as a temporary groundwater monitoring well. Borings will be
advanced to a depth of approximately 20 feet using either a hollow stem auger or casing method and will be
backfilled and restored upon completion. Temporary erosion controls, including compost filter tubes,will be
installed around each boring location.
• Ms. Page explained that one boring is proposed within the inner 100-foot Riverfront Area,while the
remaining four borings are located within the outer Riverfront Area. All five borings are located within the
100-foot Buffer Zone. The proposed work will result in approximately four square feet of temporary impacts
associated with the installation of erosion controls.
• Ms. Valentino inquired whether the temporary monitoring well was intended for environmental sampling or
groundwater elevation monitoring. Mr. Fitzpatrick clarified that it would be used to determine groundwater
levels.
• The Administrator noted that she had consulted with John Borgesi, Town Engineer regarding the proposed
drilling methods and the potential need for dewatering. Based on the anticipated drilling depth, dewatering

was not expected to be necessary. Ms. Page agreed,noting that the proposed work was expected to proceed
without dewatering.
• The Administrator recommended issuance of a Negative Determination#3 with conditions, including a
requirement that the applicant contact the Conservation Department for review and approval of any proposed
dewatering methods should dewatering become necessary.
• Chairman Manzi expressed support for the project but questioned whether the proposal was appropriately
filed as a Request for Determination of Applicability. Discussion also occurred regarding the number and
structure of conditions that could be included in a Negative Determination.
• No abutters were present.
• A motion to close the hearing and issue a Negative Determination#3, with conditions as recommended,was
made by Ms. Valentino and seconded by Mr. White.
• Vote: 5-0,Unanimous.

• Bill Dufresne of Merrimack Engineering presented the revised proposal on behalf of applicant Frank
Colomba, who was present. Mr. Dufresne reviewed changes made since the previous hearing, including a
reduction in the proposed driveway area within the 25-foot NBZ to approximately 442 square feet,the
addition of a 3:1 restoration area, installation of a bioswale to infiltrate driveway runoff, infiltration trenches
associated with the proposed detached garage, and a rain garden to manage roof runoff from the proposed
addition. Mr. Dufresne explained that alternative driveway and garage configurations had been evaluated but
were determined to be infeasible due to structural constraints and costs associated with redesigning the
project. He further stated that the proposed work would occur in the higher elevations of the site and that
additional stormwater management measures had been incorporated into the design.
• Ms. Valentino raised questions regarding the site's location within a FEMA flood zone and whether sufficient
information had been provided to demonstrate that the proposed structures would be outside the 100-year
floodplain. Mr. Dufresne explained that the project plans were prepared using an assumed datum established
during the septic system replacement project and that no flood study had been completed for the site. He
indicated that additional topographic information and cross-sections could be prepared to better demonstrate
the relationship between site elevations and FEMA flood elevations.
• Chairman Manzi expressed concerns regarding stormwater management and potential flooding impacts
associated with the proposed additions and garages. Mr. Dufresne described the proposed rain garden,

bioswaleI infiltration trenches, and pervious paver systems designed to capture and infiltrate runoff. The
Administrator asked additional questions regarding roof runoff and drainage from the proposed structures.
Following discussion, Chairman Manzi and Ms. Valentino indicated that additional information regarding site
elevations, floodplain limits, and drainage would assist the Commission in its review. The possibility of a
third-party review was discussed; however,Mr. Dufresne stated that he would prefer to provide additional
information for the Commission's consideration.
• Joseph Pas, 606 Foster Street, addressed the Commission and described existing flooding conditions in the
neighborhood during significant storm events. Mr. Pas stated that standing water frequently accumulates in
the area and can overtop the roadway during heavy rainfall. Mr. Pas expressed concerns regarding the
potential impact of the proposed project on existing drainage conditions within the area.
• Mr. Dufresne agreed to provide additional information regarding site elevations, floodplain considerations,
and drainage.
• A motion to continue to the June 24, 2026 meeting was made by Mr. McDonough, seconded by Mr. White.

• The Administrator reported that MassDEP requested a continuance while funding is secured for design work
associated with the project. Chairman Manzi inquired about the status of site monitoring and monitoring
reports. The Administrator stated that a monitor had previously been appointed and that she would follow up
regarding reporting.

Enforcement Order/Violation

• The Administrator provided background on the property,noting that it is located within an 11-lot subdivision
surrounded by Bordering Vegetated Wetland(BVW),with portions of the Buffer Zone encumbered by a
Conservation Restriction held by the Town. The Administrator explained that Conservation staff conducted a
baseline inspection in 2024 and subsequently worked with several homeowners to address yard waste
dumping and other violations within the restricted areas.
• The Administrator reported that the owners of 11 Woodlea Road had previously removed yard waste from
within the 25-foot NDZ and had been informed that any future tree removal near the wetland should be
coordinated with the Conservation Department. Staff later became aware that lawn rehabilitation, tree
removal, stump grinding, and the placement of shredded bark mulch had occurred on the property, including
within areas beyond the previously established lawn. Staff also received a report regarding tree removal at the
site.
• The Administrator recommended that a formal Enforcement Order be issued requiring removal of the
shredded bark and mulch from areas beyond the established lawn,restoration of the disturbed area, and
installation of permanent markers to identify the edge of the lawn area.
• Commission members discussed the proposed enforcement action and restoration requirements. Following
discussion,the Commission agreed to continue the matter to allow staff time to prepare a formal Enforcement
Order for consideration at the next meeting.
• A motion to continue to the June 24, 2026 meeting was made by Mr. McDonough, seconded by Mr. White.

• The Administrator reported that an existing shed, installed by the previous property owner prior to the current
owner's purchase of the property in 2023 , is located partially within the 25-foot NDZ and partially within the
50-foot NBZ. The Administrator explained that the violation was identified during a site visit related to a
potential deck rehabilitation project and that a compliant location for the shed had been identified outside the
50-foot NBZ. The homeowner was notified of the violation and indicated a willingness to relocate the shed to
the proposed location.
• The Administrator recommended issuance of a formal Enforcement Order requiring relocation of the shed no
later than July 1, 2026, and submission of a building permit application.
• Following discussion,the Commission agreed that Conservation staff should be notified prior to relocation of
the shed and that any ground disturbance associated with the relocation should be restored.
• A motion to issue an Enforcement Order as recommended and discussed was made by Mr. White, seconded
by Mr. Bohenek.

Enforcement Order/Violation

The Administrator reported that an Enforcement Order had previously been issued due to delays in restoring a
pre-existing gravel driveway to a planted state as required under the Order of Conditions. Following issuance
of the Enforcement Order, the contractor removed the gravel, installed the required soil amendments, and
completed the required shrub and tree plantings.
• The Administrator noted that the project will remain subject to the two-year monitoring requirement
contained in the Order of Conditions and clarified that,because the plantings were installed after May 30,the
first full growing season will begin in the spring of 2027.
• 8:34 p.m., the Field Inspector/Planner left the meeting.
• The Administrator recommended that the Enforcement Order be rescinded.

• 8:36 p.m., the Field Inspector/Planner rejoined the meeting.
• The Commission reviewed the draft Order of Conditions and amended Condition No. 36 to require that,prior
to submitting a request for a Certificate of Compliance for the pool project,the applicant shall submit a
complete request for and receive a Certificate of Compliance for the 1978 Order of Conditions (DEP File No.
242-43). The Commission also agreed to require a$3,000 performance bond.
• A motion to approve the Order of Conditions as drafted and amended was made by Ms. Valentino, seconded
by Mr. White.
• Vote: 5-0,Unanimous.

242-43, 115 Candlestick Road—1978 Order of Conditions
• Following issuance of the Order of Conditions, Ryan Roseen of Goddard Consulting provided an update
regarding efforts to locate a drainage pipe associated with the 1978 Order of Conditions (DEP File No. 242-
43). Mr. Roseen reported that field investigations have not identified the pipe and that additional information
is being sought from the Town regarding camera inspections.
• No action was taken by the Commission.
