Wetland Marker Relocation &Hot Tub Installation
Conservation Conditions of Approval,NACC #373
Pursuant to section 4.4.2 (B) of the North Andover Wetlands Protection Regulations,Ali Sadeghi,property
owner,filed for a Small Project Permit for work proposed at 326 Campbell Road,North Andover. Work
involves:
Relocation of existing wetland markers from the 50-foot No Build Zone to the 25-foot No Disturb Zone,
as well as the installation of a hot tub. These wetland markers will be moved to the 25-foot No Disturb
Zone to create a larger lawn area at the rear of the house,which will be undertaken by mowing without
rototilling or removing root systems. The resource areas on the property include a pond,Bordering
Vegetated Wetland, and associated 100-foot Buffer Zone. For a previous project,the existing wetland
markers were placed 50-feet from the nearby pond to mark the 50-foot No Disturb Zone associated
with a potential ephemeral pool. As precaution,the pond was considered potentially ephemeral, as it
had yet to be verified. In 2021, Bill Manuell from Wetlands & Land Management, Inc. determined that
the pond is not an ephemeral pool, as fish were observed.
Y The proposed hot tub shall be installed 85-feet from Bordering Vegetated Wetland,underneath existing
deck and on top of the existing gravel. No grading is anticipated as the area is relatively level. This
location was chosen as the fuse box is located in the house directly behind the adjacent wall.
All work shall be done by hand. No erosion control is deemed necessary as there is mir imal slope and
ground disturbance.
Duringthe he July 8,2026 public meeting, the North Andover Conservation Commission voted to approve this as
a Small Project Category "L" Otlier similar projects of ttainiinal impact, as detertniiied bit the North Andover
Comervatiotz Coitimissim. The project is approved only as it relates to the Conservation Commission and any
and (if applicable) all other approvals should be obtained by the applicant/homeowner. The applicant is
responsible for determining_property boundaries. All work shall conform to the following:

The following conditions are hereby mandated:
CONDITIONS:
1. No rototilling,root extraction or soil disturbance is allowed under this permit.
2. A pre-work site inspection shall be scheduled with the homeowner,contractor and Conservation staff to
review the scope of work and proposed wetland marker locations.
3. A post-work site inspection shall be scheduled with the Conservation Department to verify compliance.
4. This permit shall expire one year from the date of issuance.
**The applicant,homeowner and their contractors are advised that NO other work on the property is
allowed under this permit. The NACC has jurisdiction over all of the wetlands and associated 100-Foot buffer
zones and 200 Riverfront Area to the Shawsheen River on site and any work that involves ground disturbance
or changing the current conditions in these areas will require permitting with the NACC. This includes,but are
not limited to,house additions,pools,patios, decks,sheds,fences, garden beds,landscaping and bridge
installation, tree or vegetation cutting/pruning. These activities shall be held to the current standards under
the Bylaw and WPA.**
