PROTECT HISTORY
n August 17,2021 the Planning Board approved a Watershed Special Permit to allow for the onsti-uction of a
detached garage;expand gravel driveway;install dr well to capture roof runoff of new garage;pump,crush and fill with
sand old septic tank cesspool;connect to town sewer; connect to gas. Proposed work is within the Non-Disturbance arid
Non-Discharge duffer Zones of the Watershed Protection District.The Project is located in the Residential (R-3)
Zone.
General Condition 65 states, "This Special Permit approval shall be deemed to have lapsed August 17,20 (two years
from the date of issuance) exclusive of the time required to pursue or await determination of any appeals, unless
substantial use or construction has commenced within said tiro-gear period. Substantial use or construction will be
determined by a majority vote of the Planning Board".
Under Section 10.31.3 of the Town of North Andover Zoning Bylaw,"...If an applicant can good cause why substantial
use or construction has not commended within the two-year period,the special permit granting authority,at its discretion,
may extend the special permit for an additional one-year period."
FINDINGS
n April 2 ,2023,the Applicant requested to extend the Watershed Special Permits for an additional one-yeas`period
(August 17,2024)t
DECISION
Ater discussion at the April 25,2023 Planning Board Meeting,g,and upon a motion by John Simons, seconded by Peter
Boynton,the Planning Board voted to approve a one-year 1 extension for the Watershed Special Permits for Kevin and
Alison Sparks,Map 97,Lot 72, This extension shall expire on August. 17,2024. No other extension shall be granted.
CONDITIONS
'bis Decision shall be recorded with the Northern Essex Registry of Deeds and evidence of recording is to be provided
to the Manning Department.
