The site is located within the General Business(GB)Zoning District and within the Downtown Overlay District, On March 27,2024 the Petitioner submitted a request for Insubstantial Change to address design updates to the Approved Special Permits Decision. On April 4,20 24 at a regularly scheduled Planning Board meeting the request was approved by a 5-0 unanimous vote in favor of the determination of minor modification,which was recorded with said Deeds in Book 18009,Page 50(the First Amendment). a z On September 4,2024 the Petitioner submitted a request for Insubstantial Change to address a third party review of the survey plan for the lots reflected in the Approved Special Permits Decision. FLINGS OF FACTS Based on the third party review of the survey plan for the lots,there was a determination of the need to slightly adjust the common lot boundary between the Petitioner's property and the property owned T by Spencer(159 Main Street)at Main Street,and which tapers to zero following that Wrnmon rrl boundary westerly to abutting land owned by MacGregor(16 1 Main Street)to the rear property line. rrl • The resulting change in the Petitioner's lot area is a slight reduction of 124 square feet(from 28,559 sifr to r-s8` f35 ti.Q. �I However with the adjustment,stxnent the Petitioner's o ner's layout out remains substantive,e 4 �.�.of L n e tl1 pry eGt a � J x y y g, ... .] a had adequ ate lot area to accom modate th e adj ustment such that a 5-foot.swtb ck rem aMs.along t1m. A True Ce?Y i- • cf #tir,r Bk 18289 Pg329 #8486 Minor Modification 149 Main Street/14 Second Street September 10, 2024 Page 2 of 2 common boundary,and there is no change to parking spaces numbers,parking space sizes,driveway aisle widths, or building size,all of which remain in compliance with the Downtown Overlay District requirements. * Attached to this Notice of Decision is a survey overlay which depicts the new survey line and outline of site improvements shown in blue,and with the minor adjustments from the original lot and related improvements shown in red. * After discussion at the September 10, 2024 Planning Board meeting,and upon a motion by S. Kevlahan to deem the modifications as minor for 149 Main Streetl14 Second Street.J. Simons seconded the motion.The vote was 5-43 unanimous in favor.The finding of minor modification is conditioned on the following: CONDITIONS • The petitioner shall comply with all existing conditions rendered in the Approved Special Permits Decision for the site,as amended by the First Amendment and this Notice of Decision. This Notice of Decision shall be recorded with the Northern Essex Registry of Deeds and evidence of recording shall be provided to the Planning Department. • The following information shall be deemed part of the decision: Plan titled: 149 Main Street 14 Second Street North Andover Massachusetts Prepared by: Peter Nolan&Associates LLC 80 Jewett Street, Suite 2 Newton,MA 02458 Sheets: 1 page Scale: 115=207 Date: July 24,2024 • The site boundaries are more particularly described in a certain"Approval Not Required Plan,'' dated August 14, 2024,prepared by Peter Nolan&Associates LLC, and approved by the Planning Board on September 10,2024,to be recorded with said Registrar.
