Request for Alp 1 provat of Insubstantial Modification
Dear Chairman Goldberg and Other Board Members:
On behalf of the Applicant, Second and Main, LLC, we are requesting the adjustments
described below to be determined by the Board to be considered insubstantial modifications to
the approved site plan and special permits noted above. As a result of a third party review of
the survey plan for the lot, there was a determination of the need to slightly adjust the
common lot tine boundary between the Applicant's property and the property owned by
Spencer by a little over 18 linches at the intersection of the Applicant's property at property
owned by Spencer (159 Malin Street) at Main Street, and which tapers to zero as you follow that
common boundary to abutting land owned by MacGregor (161 Main Street) to the rear property
line. The resulting change in the Applicant's lot area was a slight reduction of approximately
124 square feet (from 28,559 s.f. to 28,435 s.f.). However, with the adjustment, the
Applicant's layout remains substantively unchanged as the project had adequate lot area to
accommodate the adjustment such that a 5-foot setback remains along the common boundary,
and there is no change to parking spaces numbers, parking space sizes, driveway aisle widths,

or building size, all of which remain in compliance with Downtown Overlay District
requirements.
Attached please find a survey overtay which depicts the new survey tine and outline of
site improvements shown in blue, and with the minor adjustments from the original lot and
related improvements shown in red.
For the reasons discussed above and that will be discussed at the Board's meeting, the
Applicant respectfully requests the Planning Board to approve the adjustments as depicted on
the plan as a minor, insubstantial modification to the approved Project as reflected in the
Decision.
