The vote was(4-0) in favor of the application. w r Jean Enright On behalf of the North Andover Planning Board Eitan Goldberg, Chairman Peter Boynton Kate Kelly John Simons 1 203 Turnpike Street Site Plan Review Special Permit Modification April 28,2026 The Planning Board herein APPROVES the Site Plan Review Special Permit Modification to allow for construction of three separate carports, which include installation of approximately 10,000 SF of PV panels atop of approximately 12,000 SF of carport roof area. The project is located within the Business 4 Zoning District. The application is filed in accordance with Article 8, Part 3 Section 1.95-8.17. Revisions to Approved Site Plans,Article 1.0 Section 195-10.7 Special Permits of the North Andover Zoning Bylaw and MGL c. 40A, Sec 9. This Special Permit was requested by Andrew Keller,AC Development LLC, 7295 Surfbird Circle, Carlsbad, CA 92008. The Applicant submitted a complete application on March 5,2026, which was noticed and reviewed in accordance Town of North Andover Zoning Bylaw and MGL Chapter 40A, Section 9. The motion to approve was subject to the FINDINGS OF FACTS and SPECIAL CONDITIONS set forth in this decision. The public hearing on the above referenced application was opened on April 7, 2026 and closed on April 28, 2026. The Planning Board voted unanimously(by a vote of 4-0) to grant the Site Plan Review Special Permit Modification.. A special permit issued by the Planning Board, as special permit granting authority, requires a vote of at least four members of a five-member board. The Applicant is hereby notified that should the Applicant disagree with this Notice of Decision ("Decision"),the Applicant has the right, under MGL Chapter 40A, Section 17, to appeal this.Decision within twenty days after the date this Decision has been filed with the Town Clerk. The Planning Board makes the following findings as required by the North Andover Zoning Bylaws Article 8, Part 3 Site Plan Review and Section 195-10.7. The Planning Board makes the finding that the intent of the Bylaw, as well.as its specific criteria, are met. This Decision specifically stated by the Planning Board makes the following FINDINGS OF FACT: 1) Thee specific Site is an appropriate location for such a use, structure or condition. The carports and solar energy system are deemed to be an accessory use for an existing development. 2) The use as developed will not adversely affect the neighborhood character. The installation of carports and solar energy system will.maintain the existing patterns of access, parking, and stormwater management. 3) There will be no nuisance or serious hazard to vehicles or pedestrians. The Fire Department has reviewed and approved the SWEPT PATH Analysis and concerns expressed regarding access and setup of the ladder truck have been addressed. 4) Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Adequate and appropriate facilities will be provided for the proper operations and use of the Site. New electric utility lines will be installed and connected to an existing pole with a new mounted transformer in coordination with National Grid. 5) The use is in harrnon with the general purpose and intent of this Zoning Bylaw. In addition to the reasons described herein and as shown on the Plans and stormwater management report,and other information submitted as part of this 2 203 Turnpile Street Site Plan Review Special Permit Modification April 28,2026 Application,the proposed use is in harmony with the general purpose and intent of this Zoning Bylaw. The Site is comprised of approximately 5.31. acres and is currently occupied by the North Andover Medical Park, which consists of 2-four story buildings that house various medical and other office uses. The Site includes parking and access on each side of the buildings with the majority of parking in the rear. The Site is bounded by Turnpike Street to the north,Andover Street to the east, and an existing wetland area to the south and west. The proposed Project involves installing multiple carports, each equipped with photovoltaic panels for solar energy, over approximately 63 existing parking spaces. This installation will not alter the existing number of parking spaces or disrupt the current traffic flow within the lot. An electric line is planned to connect these structures to an existing utility pole where a new transformer will be installed. 6) On July 24, 1990,the Planning Board approved a Site Plan Review Special Permit for the Site, which allowed for the construction of a 18,583 SF 4--story addition to an existing structure 7) The proposed carports are located outside of the 100-buffer of wetland resource areas south and west of the existing buildings and therefore the Project is outside of the Conservation Commission jurisdiction. The Conservation Administrator has confirmed the wetland delineation. 8) Stormwater Management: The stonnwater management design for the proposed Project includes collection of stormwater runoff in catch basins with deep sumps and hooded outlets for treatment, implementation of an[operation &Maintenance Plan for the proposed stormwater management system that describes the various components of the system, identifies inspection and maintenance tasks, and provides a schedule to follow, and implementation of a Long-Term Pollution Prevention Plan(LTPPP)to prevent illicit discharges to the stormwater management system. The stormwater management design is in accordance with the Town Bylaw requirements and Best Management Engineering and Practices, and the most recent version of the MA DEP Stormwater Handbook, and has been reviewed by the Town's outside consulting engineer,Horsley Witten. (See correspondence from Horsley Witten dated March 25,2026,April 3, 2026,and May 4,2026, and response comments from.Nobis dated March 30,2026 and April 21, 2026. 9) The Project has been reviewed by the North Andover Fire Department(email communication from Tim McGuire dated April 2, 2026 and April 23, 2026),North Andover Police Department(see email communication dated March 9, 2026,the Conservation Department(email communication from Amy Maxner dated March 9, 2026), and Department of Public works(email communication from Tim Willett dated March 17 and April 22, 2026). 3 203 Turnpike Street Site Plan Review Special Peri-nit Modification April 28,2026 WAIVERS 1.0) Chapter 1.95 Article 8.14.E.16—Landscape Plan Chapter 195 Article 8.14.E.17—Refuse Areas Chapter 195 Article 8.14.E.18__._Lighting Facilities Chapter 195 Article 8.1.4.E 19 Traffic Impact Study Chapter 195 Article 8.14.E.20—Commonwealth Review Chapter 1.95 Article 8.14E.21 -Utilities (Profiles) Chapter 195 Article 8.14.22—Fiscal Impact Report Chapter 195 Article 8.14.23 —Community Impact Report 11) Finally,the Planning Board finds that this Project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 195-8.1.4, as well as Part 3 Site Plan Review, 195-10.7. The Planning Board hereby grants an approval to the Applicant provided the following conditions are met: SPECIAL CONDITIONS: 12) For the purposes of the decision,the Planning Board approves the following Permit Definitions*. i. The "Locus" or "Site" refers to the parcels of land with land fronting on Turnpike Street shown on Assessor's Map/Lot 024.0-0028, mown as 203 Turnpike Street,North Andover, Massachusetts. ii. The "Plans" refer to the Plans prepared by Nobis Group, 55 Technology Drive, Lowell, MA 01851, entitled "Solar Carport for 203 Turnpike Street, North Andover,MA 01845", dated March 5, 2026,revised to April 21,2026 to consisting of sheets: Cover Sheet, G--1., Existing Conditions, C-1, C-2, C- 3. iii. The"Project"refers to the proposed improvements include construction of three separate carports,which include installation of approximately 10,000 SF of PV panels atop of approximately 12,000 SF of carport roof area. The Project is located within the Business 4 Zoning District. iv. The "Applicant" refers to Andrew Kellar of AC Development LLC, the Applicant for the Site Plan Review Special Permit Modification, its successors and assigns. V. The "Project owner"refers to the person or entity holding the fee interest to the title to the Locus from time to time, which can include but is not limited to the Applicant,developer, and owner. 13) All stormwater management best practices shall be maintained as specified in the Operations and Maintenance Plan, dated March 5,2026 and revised to April 21, 2026. 14) Except as modified by this Decision,all terms and conditions described the July 24, 1990 Site Plan Review Special Permit shall remain in full force and effect. 15) The Planning Director shall approve any changes made to these plans. Any changes deemed substantial by the Town Planner would require a public hearing and modification to the Special Permit by the Planning Board. PRIOR TO ISSUANCE OF SITE WORK,BUILDING PERMIT,OR CONSTRUCTION 4 203 Turnpike Street Site Plan Review Special Permit Modification April 28,2026 16) The Applicant will provide copies of all Decisions,Notification, and orders of Conditions from the North Andover Conservation Commission. 17) Two (2)copies of the signed, recorded decision and with endorsed plans attached must be delivered to the Planning Department. 18) In consultation with the Director of Planning,the Applicant shall designate an Independent Environmental Monitor. The monitor shall read, sign, and return to the Planning Director the Letter of Agreement for Independent Monitors. The Environmental Monitor must be available upon four(4)hours' notice to inspect the Site with the Planning Board designated official. The monitor shall make weekly inspections of the Project,provide monthly reports to the Planning Department throughout the duration of the Project, and detail any areas of non-compliance and corrective actions. The monitor will also provide reports following heavy rain events. 20) A construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities. 21) The proposed catch basin protections shall be installed. 22) The Applicant shall sign the Illicit Discharge Statement included in the operations and Maintenance Plan and return a copy of the signed document to the Planning Department. 23) A bond in the amount of ten thousand dollars ($10,000.00) shall be posted for the purpose of insuring that the Site is constructed in accordance with the approved plan and that a final as-built plan is provided, showing the location of all on-site structures (Site utilities, structures, curb cuts,parking spaces and drainage facilities, including invert elevations of all stormwater structures). This bond shall be in a form acceptable by statute. 24) All erosion control measures as shown on the Plan must be in place and reviewed by the Town Planner and Conservation Department. 25) A pre--construction meeting must be held with the developer,their construction employees, Planning Department and Conservation Department(and other applicable departments)to discuss scheduling of inspections to be conducted on the Project and the construction schedule. DURING CONSTRUCTION 26) Dust mitigation must be performed weekly, or more frequently as directed by the Planning Director,throughout the construction process. The Site must be kept clean and swept regularly. 27) Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a Plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all tunes and fenced off to minimize any dust problems that may occur with adjacent properties. 5 203 Turnpike Street Site Plan Review Special Permit Modification April 28,2025 28) It shall be the responsibility of the developer to assure that no erosion from the construction Site shall occur which will cause deposition of soil or sediment upon adjacent properties or public ways, except as normally ancillary to off-site construction. Off-site erosion will be a basis for the Planning Board making a finding that the Project is not in compliance with the Plan; provided, however,that the Planning Board shall give the developer written notice of any such finding and seven days to cure said condition. PRIOR TO A CERTIFICATE OF OCCUPANCY 29) The Applicant must submit a letter from the Project engineer of the Project stating that the building, landscaping, lighting and Site layout substantially comply with the Plans referenced at the end of this decision as endorsed by the Planning Board and that the stormwater management structures are functioning as designed. 3 0) The Applicant shall submit a final, signed operations and Maintenance Plan to the Planning Director. 31) In accordance with 4.a of Horsley Witten's April 3, 2026 peer review letter,the Applicant shall notify the Planning Director when.the proposed hooded outlets (Eliminators)have been added to the existing catch basins to improve the TSS removal obtained. The Applicant has noted that the catch basins require maintenance to confirm the depth of the sumps. After the maintenance in conducted an inspection shall be scheduled to confirm the catch basins have 4-foot--deep sumps. 32) All stormwater structures shall be cleaned, in accordance with the approved Operation and Maintenance Plan. PRIOR TO THE RELEASE OF THE PERFORMANCE BOND 33) The Applicant shall submit an as-built plan stamped by a Registered Professional Engineer in Massachusetts that shows all construction, including story-nwater structures and other pertinent Site features. This as-built plan shall be submitted to the Town Planner for approval and must be provided in paper form as well as in SDF (Standard.Digital File)format. 34) The Planning Board must by a majority vote make a finding that the Site is in conformance with the approved plan. GENERAL CONDITIONS 35) Any plants, trees, shrubs, or fencing that have been incorporated into the Plans approved in this Notice of Decision that die or fall into disrepair must be replaced by the Project owner in perpetuity. 3 6) The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 37) Gas,Telephone,Cable and Electric utilities shall be installed underground as specified by the respective utility companies. 38) The hours for construction shall be limited to between 7:00 a.m.and 5:00 p.m.Monday through Friday, and between 8:00 a.m. and 5:00 p.m. on Saturday. 6 203 Turnpike Street Site Plan Review Special Permit Modification April 28,2026 39) No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 40) The provisions of this conditional approval shall apply to and be binding upon the Applicant, its employees, and all successors and assigns in interest or control. 41) Any action by a Town Board, Commission,or Department,which requires changes in the Plans or design of the building,as presented to the Planning Board,may be subject to modification by the Planning Board. 42) Any revisions to the Plans shall be submitted to the Planning Director for review. 1f these revisions are deemed substantial,the Developer must submit revised plans to the Planning Board for approval. 43) Pursuant to the North Andover Zoning Bylaw Section 195-10.7, this Special Permit approval shall be deemed to have lapsed April 28, 2028 (two years from the date of issuance) exclusive of the time required to pursue or await determination of any appeals, unless substantial use or construction has commenced within said two-year period. Emphasize the importance of maintaining current and up-to-date inspection reports and maintenance records of BMPs. Documentation shall include any changes to the O&M Plan's procedures to accommodate changes and revisions to BiVMPs. The components of the stormwater management system must be inspected, monitored and maintained in accordance with the following in order to ensure that the on-site stormwater management/BMPs for 203 Turnpike Street are functioning as designed. Routine inspection and proper maintenance of these individual components is essential to providing the long-term operation of the drainage system. 4 Deep Sump Catch B aS'�ns: Storrnwater runoff from pavement areas is directed to catch basins via site grading and curbing. Catch basins are equipped with a deep (4ft) sump and a hood. The sumps are designed to capture sediment and coarse particles and the hoods prevent hydrocarbons and other floatable debris from entering the drainage system. To ensure proper functioning of catch basins, each will be inspected and maintained as follows: Inspection: Beginning of March, June, September and December. Structural damage and other malfunctions are to be noted and reported. Basins shall also be inspected after every.major rain event(3.2 inches or greater in 24 hours)to ensure the grates are not clogged and are functioning properly. Maintenance: Catch basins to be pumped and cleaned when sump is half full of sediment. Meaning shall be performed by a licensed contractor. Sediment and hydrocarbons will be properly handled and legally disposed of off-site in accordance with local, state, and federal guidelines and regulations. Any structural damage to catch basins and/or castings will be repaired upon discovery. Sweeping and Site Clean-Up: Routine sweeping of paved areas is an effective method to provide important nonpoint source pollution control and will be performed by mechanical sweepers. Most stormwater pollutants travel with the suspended solids contained in the storrnwater runoff and regular sweeping will help reduce a portion of this load. Sweeping, especially during the period immediately following winter snowrnelt(April) when road sand and other debris has accumulated on the pavement, will capture a peak sediment load before spring rains wash residual sand from winter applications into nearby resource areas. Inspection: Paved areas will be inspected for litter on a weekly basis and picked up and disposed of immediately. Maintenance: Parking area and driveways and other impervious surfaces (except roofs)will be swept clean of sand, litter,trash, etc. annually (April). A log of land/lot sweeping and cleanup will be kept. Additional cleanup services will be conducted as necessary. Please refer to Appendix A.for the Inspection Forms,which are to be used by the Pollution Prevention Team member responsible for conducting the scheduled inspections. F SECTION 2 -ILLICIT DISCHARGE STATEMENT These types of discharges will be allowed under the conditions that no pollutants will be allowed to come in contact with the water prior to or after its discharge. The existing control measures which have been listed previously in this report will be strictly followed to ensure that no contamination of these non-storm water discharges takes place. Illicit discharges, if they exist currently, will be contained and eliminated in the.manner specified by local, state and federal regulations, and will be prohibited in the proposed development.
