Hi Jean:
Paul found there was adequate parking at Eaglewood Shops to allow CAVA to located at the Site, as noted below in
the email trail that started last Friday.
I sent Paul the same materials which I sent to you.
The only additional item Paul asked for was the set of preliminary plans which are attached as they were appended as
an Exhibit to the Lease.
Let me know if you need anything further.
Can you please confirm the same for the record so that I can then inform the client.?

Good Morning John, I have been to 127 Turnpiker numerous times ,morning ,afternoon and early evening and have
never found a time that the parking lot was not even close to capacity.) believe allowing Cava to open business at 127
Turnpike should not be a problem.

These are what was preliminary as included in the lease. They obviously are developing a more robust set that
would be for permit.

Hi Paul:
As a follow-up to our discussion earlier this week, attached are the following documents:
1. Memo Requesting Approval of New Food Uses;
2. Food Uses Chart By S.F. (current and proposed);
3. Parking Allocation Table (updated January 2024); and,
4. Vanasse Parking Demand Study Memo (which updated the 2019 Parking Demand Study).
Background
1. In its 2000 Amended Site Plan Decision, the Board added Condition No. 20 which states as follows:
condition 6.f shall be amended to read, "if an owner, its successors or assigns, in the course of continued
business operation, wishes to open a restaurant(s) that collectively exceeds 21,000 SF, the Applicant must,
prior to allowing such new or expanded restaurants(s) to open for business, submit revised Plans to the North
Andover Planning Director and North Andover Building Commissioner, demonstrating that adequate additional
parking exists on the Site with reference to Article 8, Part 1 (Off-Street Parking and Loading) of the North
Andover Zoning Bylaw as modified by the Modification of Site Plan Review Decision, dated November 24, 2020,
as amended.
2. Since the proposed new restaurant named CAVA would result in the Plaza exceeding 21,000 s.f. of food use,
Condition No. 20 authorizes the additional use if both the Building Commissioner and Planning Director
determine that "adequate additional parking exists on the Site."
3. For this reason, we have prepared the materials above including: (a) the Memo in support of the request;
(b) an updated food uses chart showing existing and proposed s.f. of food use; (c) an updated parking
allocation table; and, (d) an Updated Parking Utilization Analysis prepared by Vanasse Associates.
4. The Vanasse Memo states that "Parking occupancy on a weekday was not found to exceed 32 percent in the
north parking field, 53 percent in the center parking field, and 70 percent in the south parking field. Parking
occupancy on a Saturday was not found to exceed 24 percent in the north parking field, 35 percent in the
center parking field and 60 percent in the south parking field."

5. The Vanasse Memo also concludes that "It is apparent based on the parking demand observations and the
distribution of parking within the parking fields that serve the Eaglewood Shops that the parking supply is
sufficient to accommodate the current mix of retail and restaurant uses, with sufficient parking available to
accommodate occupancy of the currently vacant commercial space by retail or restaurant uses."
6.Also as noted in the attached materials, there are currently 46 unused spaces due to vacancies, so at a
minimum, the 42 spaces proposed for the CAVA restaurant uses is adequate to serve the parking needs, but also
note that the significant underutilization of parking at the Plaza as described in the Vanasse Memo also
supports a determination that "adequate additional parking exists on the "Site" to serve the proposed CAVA
restaurant use.

review, if that would be helpful to you. Please note that Linear has executed a lease with CAVA for the
proposed use, but subject to any locally required approvals.
