This application and additional documentation as cited herein was filed by the Applicant with the Planning Board on October 3, 2019. The Premises,315 Turnpike Street,Merrimack College,Rogers Center-,North Andover,MA 1845,Map 25,Lot 13,is located entirely within the Residential-3 3 Zoning District.The public hearing on the above referenced application was opened on November 5, 2019, and closed by the North Andover Planning Board on January 21, 2020. The Applicant submitted a complete application that was noticed and reviewed in accordance with North Andover Zoning Bylaw Part Wireless Service Facilities and Section 10.7 and MGL c. A, Sec. 9. The Applicant is hereby notified that should the Applicant disagree with this decision,the Applicant has the right,under MGL Chapter 40A, Section 17,to appeal this decision within twenty days after the date this decision has been filed with the Town Clerk. In accordance with Forth Andover Zoning Bylaw Article 8 Part 8 and part 3 wireless Service Facilities and Section 10.7, the Planning Board makes the finding that the intent of the Bylaw, as well as its specific criteria,have been met. In support of this Decision,the Planning Board makes the following FEN-DINGS of FACT: IND 'GS of FACT: 1. A pre-application conference was held on September 17,2019. . The Applicant's Attorney provided testimony that there is an existing substantial gap in coverage in the vicinity of the proposed installation and that the facility is necessary in order to substantial close the gap in coverage. 3. The Town's wireless leer Review Consultant, Cityscape Consulting, Inc.,reviewed the application and found that there is sufficient documentation to justify a new personal wireless facility within the general vicinity and the new facility would alleviate the coverage gap and capacity overload described by the Applicant(Please see Consultant Review Memos from B. Benjamin Evans, Bated November 29, 2 019, and January 21, 2 . . There will be sufficient space on the goof for Fire Department access for ventilation operations in the event of a fire. 5. The Design is similar to the architectural roof design of the adjacent building not of the Rogers Center and all ground equipment lease area will be surrounded by a brick screening wall that matches the building exterior and all cables will be muted inside the building. . Landscaping is not proposed for this Project as the antennae will be roof mounted and all ground equipment will be concealed within a brick screening. 2 315 Turnpike Street Wireless Facility Special Permit and Site Plan Review r . The Applicant has provided evidence that they have the legal right to install the wireless facility as proposed(See Memorandum of Building and Rooftop Lease Agreement recorded at the Northern Essex Registry of]Deeds on June 26, 2019). . Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The proposed antenna cables and equipment area are described in detail on the plans and reports referenced herein. . The antennae will be concealed within fiberglass stacks to mimic the look of rooftop stacks on ad j acent buildings. 10. The Inspector of Buildings has determined that the"antenna"placement complies with zoning requirements and the height does not exceed more than 10 feet of the average heights of the buildings located within 300 feet ofthe facility(See email from Paul Hutchins dated January 7, 22 . 11. The Fire Department reviewed the Plan and the project must meet the requirements of MGL 148, 527 C1R,NF'PA. 1 and MGL 148 where applicable(See emails from Michael el Beirne dated October 21,2019, and January 16,2 2 as conditioned in 420 of the Special Permit. WARS The installation will be constructed according to the flan,with the following waivers granted by the Town of North Andover Planning Board, according to the provisions of the Town of North Andover Zoning Bylaw. These waivers are hereby granted: 12. Section 1 -- . 5 f). Landscape Plan, including preexisting trees and shrubs and those proposed to be added, identified by the size of specimen at installation and species. No landscaping will be disturbed or added. 13. Section 195- .45.5g . During the public hearing process,the Applicant shall schedule Frith the Planning Board balloon or crane test t the proposed site, t the expense of the Applicant,to illustrate the height of the proposed facility. No new structure is proposed and visual imagery provided is sufficient. 1 . Section 195- . 55 h . If lighting on the site is required by the FAA,the Applicant shall submit a manufacturer's computer--generated point-to-point printout, indicating the horizontal foot candle levels at grade, within the property to be developed and 25 feet beyond property lines. The printout shall indicate the locations and types of luminaries proposed. No lighting is required. 15. Section 195- .4 . The Applicant shall provide a statement listing the preexisting and maximum future projected measurements of noise from the proposed wireless service facilities. No sound audible to the human ear is emitted from the proposed facilities and there will be no generator at the site. 16. Section 195- . 5. . Federal environmental filing requirements. a. An environmental assessment BA that meets FCC requirements shall be submitted. No LA is required by the FCC. 315 Turnpike Street Wireless Facility Special Permit and Site Plan Review b. The Applicant shall list location, type and amount of any materials proposed for use that are considered hazardous by the federal, state or local government. No hazardous materials are proposed. 17. Section 19 - •4 b [2)]. Preexistent plus proposed wireless service facilities: maximum estimate ofRFR from the proposed wireless service facility plus the preexisting RFR environment. Verizon is the only proposed wireless carrier. SPECIAL CONDITIONS 18. Access to the rooftop shall be restricted only authorized persons and areas around the antennas that may exceed the occupational Maximum Permissible Exposure limits should be clearly marked. 19. All roof entryways should have signs warning of high RF fields. 20. The project must meet the requirements of M L, 148, 527 CNM,I FPA 1 and M L 148 where applicable 2I. Discontinuance Abandonment a. At such time that a licensed carrier plans to abandon or discontinue operation of wireless service equipment,such carrier will notify the Town by certified US mail of the proposed date of abandonment or discontinuation of operations. Such notice shall be given no less than 30 days prior to abandonment or discontinuation of operations.In the event that a licensed carrier fails to give such notice,the wireless service equipment shall be considered abandoned upon discontinuation of operations. b. Upon abandonment or discontinuation of use, the carrier shall physically remove the wireless service equipment placed on the site by the carrier within 90 days from the date of abandonment or discontinuation of use. "Physically remove" shall include,but not be limited to: c. Removal of antennas,mount,equipment shelters and security barriers installed by the carrier(unless the sabre will continue to be used by the Owner)from the subject property. d. 'roper disposal ofthe waste materials generated by the carrier from the site in accordance with local and state solid waste disposal regulations. c. Restoring the location of the wireless service facility in its condition before the installation, except that any landscaping and grading shall remain the after- condition. f. Once abandonment or discontinuance has occurred, the carrier shall remove the equipment from the subject property within ninety days. 22. After the equipment on the facility is in operation, the Applicant shall submit to the Planning Board, within 90 days of beginning operations and at annual intervals from, the date of issuance of the Special Permit, current RFR measurements. Such measurements shall be signed and certified by an RF engineer, stating that RFR measurements are accurate and are in compliance or why the measurements fail to comply with all applicable FCC Guidelines as specified in Section 19 - . RFR Filing Requirements of this Bylaw. . The Applicant or their successor in interest shall maintain the wireless service equipment in good condition. Such maintenance shall include, but shall not be limited to, structural integrity of the antennas. Prior to Issuance of a Building Permit: 24. Two 2 recorded copies of the signed, recorded decision and the recorded plans must be delivered to the Planning Department. 25. A bond in the amount of five thousand dollars 5,00 shall be posted for the purpose of insuring that a final as-built plan showing the location of all on-site structures. The bond is also in place to insure that the site is constructed in accordance with the approved Flan.. This bond shall be in the form of a check made out to the Town of North Andover. This cheek will then be deposited into an interest bearing escrow account. . A construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction. Prior to the final release of the security: 2 . A final as-built Plan,showing final construction and location of the wireless hardware shall be submitted to and reviewed by the Planning Staff. The Applicant must submit a letter from the architect or engineer of the project stating that the construction and operations substantially comply with the Plans referenced at the end of this decision as endorsed by the Planning Board. 2 . The provisions of this conditional approval shall apply to and be binding upon the Applicant, its employees, and all successors and assigns in interest or control. 9. Any revisions shall be submitted to the Town Planner for review. If these revisions are deemed substantial,the Applicant must submit revised Plans to the Planning Board for approval. . This Special Permit approval shall be deemed to have lapsed after three years from the slate permit granted unless substantial use or construction has commenced. Substantial use or construction will be determined by the Town Planner. 1.
