Hello All... For your consideration, please find attached a list of potential conditions that may be advantageous to include
in the 40B permit approval.
These conditions are typical boilerplate requirements that the Conservation Commission includes in its wetland permits to
maintain site controls, monitor post-construction impacts to wetland resources and facilitate communication between the
Town and the project proponent.

I only wanted to be transparent, but since the applicant performed additional due diligence showing the isolated wetland
to be non jurisdictional under both the State Wetlands Protection Act and local Bylaw there is no requirement for this to
be presented to the Commission. I understand that even if the isolated wetland were jurisdictional under the Bylaw,the
Commission would still have no jurisdiction as 40B's only need to address the State Wetlands Act.
I will provide a list of potential conditions for your consideration no later than tomorrow late morning if that is okay.

Apologies for the interim gap in my communication to you. The applicant engaged a wetland
consultant to inspect the site for wetlands. Attached is her report. I met with her on site and am
comfortable that the isolated wetland is too small to be jurisdictional under the Bylaw. The State

I plan to place this on the June 10th Conservation Commission agenda under New Business
discussion items. I will review the draft set of approval conditions that your legal counsel prepared
and will provide suggestions for during-construction and post-construction conditions for your
