Dear Commissioners, On behalf and upon request of RCG LLC, I, Julie Vondrak, wetland scientist, inspected the above referenced Project Site on April 29, 2026 to review if wetland resource areas subject to jurisdiction under the U.S. Army Corps of Engineers " Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Northcentral 2012), the Massachusetts Wetlands Bordering Vegetated Wetlands Under the Massachusetts Wetlands Protection Act (March 1995), and Site. A small, isolated area was evaluated behind the East Mill garage wall (see attached photos) to determine if it is subject to jurisdiction under the WPA and Bylaw. The area is a small depressional area that appears to receive surface runoff from the surrounding sloped residential areas and from street runoff. The vertical wall appears to act as a dam and therefore the water may be periodically collecting and pooling. During my inspection, there was no standing water observed, however, water staining was observed. The area was primarily dominated with purple loosestrife, poison ivy and emerging goldenrod species. Soils were evaluated in several areas and displayed some mottling features indicating periodic water retention close to the surface. Refusal was encountered within 12-inches in all the soil plots, thus the area is not properly draining and creating this small, isolated depression. Five flags labeled A1 through A5 were hung along the edges of the depressional area. Tapes were pulled in the field and the area measures approximately 900+/- s.f. in size. The area would not qualify as Bordering Vegetated Wetland (310 CMR 10.55) under the WPA. Furthermore, the area does not appear to qualify as Isolated Land Subject to Flooding (310 10.57) as it does not appear to hold the requisite volume of water (1/4 acre-foot of water). Under the North Andover Bylaw, isolated wetlands greater than 1,000 s.f. may be subject to protection. As stated above, measurements of the flagged area were initially documented on April 29, 2026 and measured again with the Conservation Administrator, Amy Maxner on May 11, 2026. Both measurements indicated approximate areas of less than 1,000 s.f., therefore, the depressional area would not be subject to protection under local regulations.
