Conservation Conditions of Approval,NACC #378
Pursuant to section 4.4.2 (B) of the North Andover Wetlands Protection Regulations, Florentin Chaves from
Tinos Inc., on behalf of the homeowner, Robert Ford,filed for a Small Project Permit for work proposed at 89
Bear Hill Road,North Andover. Work involves:
➢ Demolition of the existing upper and lower decks, and replacement of only the upper 14'x16' deck,
stairs and footings. All work shall be done by hand, and replacement of deck shall remain within the
footprint of the existing upper deck. Dumpster shall be located in the front of the garage to the left of
the existing upper deck. The resource areas on the property include an intermittent stream, Bordering
Vegetated Wetland, and associated 100-foot Buffer Zone. The closest point of work is located—54' from
the intermittent stream.
➢ The current site conditions consist of a brick patio and walkway underneath the upper deck, stone
patio underneath and next to the lower deck, and a sand stone footprint from a recently removed above
ground pool.
During the August 12,2026 public meeting, the North Andover Conservation Commission voted to approve
this as a Srrrall Project Categonl "A" Open slotted decks, ivithont roofs, equal to or less than 300 square eet stir:ace area,
inchrsive of stairs and ramps, w1 iclr are to be attached to an existing home, zvhere soil disrtiption dyfing construction is
limited to less than 50 square feet, and z0iere no permanent soil alterations are planned under thenfootprint of the deck.
The project is approved only as it relates to the Conservation Cormnission and any and (if applicable) all other
approvals should be obtained by the applicant/homeowner. The applicant is responsible for determining
property boundaries. All work shall conform to the following;

The following conditions are hereby mandated:
CONDITIONS:
1. Prior to construction, erosion control (in the form of straw wattle) shall be installed and staked according to
the instructions of Conservation staff.
2. A pre-work site inspection shall be scheduled with the homeowner,contractor and Conservation staff to
review the scope of work and review erosion control.
3. A post-work site inspection shall be scheduled with the Conservation Department to verify compliance
and approve removal of erosion control.
4. Additional permitting shall be required if the existing brick patio and stone patio are altered or expanded,
or if the stone dust pool footprint is removed and replaced with anything other than lawn.
5. This permit shall expire one year from the date of issuance.
**The applicant,homeowner and their contractors are advised that NO other work on the property is
allowed under this permit. The NACC has jurisdiction over all of the wetlands and associated 100-Foot buffer
zones and 200 Riverfront Area to the Shawsheen River on site and any work that involves ground disturbance
or changing the current conditions in these areas will require permitting with the NACC. This includes,but are
not limited to,house additions,pools,patios, decks, sheds,fences, garden beds, landscaping and bridge
installation, tree or vegetation cutting/pruning. These activities shall be held to the current standards under
the Bylaw and WPA.**
