HomeMy WebLinkAbout1949-01-10'January 10, 1949 The meeting was called to order by the Chairman at 8:00 P.M. in the Town Building Members present: Chairman, John F. Alter, Secretary, 'Gregory Mooradkantan, Irving C. Howes, Henry E. Lund and James T. Poor. Mr. Thomas Frettwell of Andover Street, w as before the Board informally to request information as to the procedure he must follow to make an application to have his property changed from a General Residential to a Business District. This property is located at the corner of Andover Street and Chickering Road. Mr. Fretwell conducts a b~sineas in his barn, where he sells floor coverings and wished to put in a large display window to show his wares. This window would be visible from Andover and Peters Streets. He would also like to put up a sign advertising his business. He asked the Board if it were possible to give him a variance in order to make this c~mnge. He was advised by the Board that they could not consider his re~est as he would be changing or amending the Zoning By-Law and he was advised that this was a matter for the Planning Board. He was advised that he should make an application to the Planning Board to get approval and then this matter would be con- sidered at a Town Meeting. Attorney Bradley and Attorney Sullivan of Lawrence were before the Board relative to the Collins property located on Main Street, in the business area. Attorney Bradley represented the bank and Attorney SuLlivan represented the seller. They explained to the Board that the owner of this proeprty wished to divide this property into two individual parcels in order that they could be sold with the houses as they stood. One lot would have:A~59 foot frontage and the other would have a 57 foot frontage. There is a driveway between these two houses. This property is located in the business district of the Town. They were advised that they would not be required to apply to this Board for a variance as the houses already existed and were in a business district so that the restriction of frontage is not considered. Motion was made and seconded and it was VOTED that it is the sense of the Board of AppeaLs that the matter presented by the heirs of Dennis Collins for partition of property located at 82 to 92 Main Street, North Andover, does not present a problem for action by the Board of Appeals. Both attorneys were so advised. An inquiry was received from Mr. Llpyd Crockett, owner of the Crockett Sanatorium as to restrictions or permits involved in his conducting a Sanatorium. A motion was made and seconded and it was VOTED that a letter be sent to Mr. Crockett as well as a copy of the Zoning By-Laws and forms for an application to the Board in order to get the necessary permit for this type of business. Mr, Crockett was also informed that he must make an application to the Board for such a permit. 1 Copy ~f letter to Mr. Crockett: Dear Sir: In answer to your inquiry regarding a license or permit to operate a Sanatorium in North Andover, we beg to inform you that it will be necessary f or you to make a regular application to the Board of Appeals for such a perm~it. You are expected to fill out the enclosed application forms. Your attention is called to the Zoning By-Laws, parti- cularly to Article VI, section 2, paragraph A & E, relative to Single Residence Districts, where your property is located. The next meeting of the Board will be held on February IA, 1949 and upon receipt of your application, duly filled out and executed, this application will be advertised and a Public Hearing will be given. It is suggested that your application be sent to us at your earliest possible convenience in order to be advertised and the hearing held at this meeting. Motion was made and seconded and it was VOTED that the chairman's name appear on all notices forPublic Hearings. Motion was made and seconded and it was VOTED that a letter be sent to the Board of Selectmen, calling their attention to violations of the Zoning By-Laws at property located at 208 Massachusetts Avenue, and also at ~7 Massachusetts Avenue. A copy of the above letter is on file with the Board. Motion was made and seconded and it was VOT~n to adjourn the meeting. Meeting adjourned at lO:l§ P.M.
