Conditional Approval
A. All Planning Board Order of Conditions are t*,.b4e played;' {
on the recorded Definitive Plan, (cover shee'0 prior to
endorsement and filing with the Registry of Deeds.
B. Prior to signing the Definitive Plans, all executed deeds
of easements and parcels shall be submitted to the Planning
Board and held in escrow until completion. At the time of
completion and prior to final security release, the developer
shall record said documents for the Town.
C. A certified document from a Professional Engineer and/or
Land Surveyor shall be submitted to the Planning Board after
the completion of each phase verifying that all utilities
(including electric , telephone, sewer and cable) have been
installed in accordance with the plans prior to binder coat
of application. Installation shall be in accordance with
plans and profile prior to the release of any lots.
1 . The Order of Condition issued by the NACC for Lot H
Breckenridge Homes shall be followed.
2 . A bond in the amount of $8 , 000 for the As-Built Plans
shall not be released until approved by the
Planning Board.
3 . No Certificate of Occupancy shall be issued for any
structure built in this subdivision prior to the
binder coat of bituminous pavement being placed
to the satisfaction of the Department of Public
Works.
4 . All septic system designs must be approved by the
Board of Health.
5. All homes in this suvdivision shall install residential
sprinklers as recommended by Fire CHief' s letter
dated August 12, 1987.
6 . Existing trees listed to remain on the subdivision
plan shall not be removed on the site.
7 . All areas indicated on the plan to remain with tree
cover shall be maintained. No tree cutting shall be
allowed in these areas . A bond in the amount of
$10 , 000 shall be posted with the Planning Board to
insure replanting if builders or developer does
remove any trees . Also any cutting in the public
way shall conform to MGL Chapter 81 .

Preliminary Subdivision
Conditions to Approval
1. A Notice of Intent shall be filed with the North Andover Conservation
Commission as required under Chapter 131 - Wetlands Protection Act, and
local wetland regulations.
- The Notice of intent shall be submitted at the definitive plan review
process.
- The definitive plans shall delineate the edge of bordering vegetated
wetlands.
2. All aspects of the cul-de-sac construction shall conform to the
Planning Board's rules and regulations for the normal layout and
construction of cul-de-sacs.
3. Per the Fire Chief's recommendations-
- A fire hydrant must be installed at the end of the cul de sac near
the entrance to the middle dwelling ( on lot 2) .
- Permanent stone markers should be located at the entrance to this
subdivision, designating the house numbers or the street name. These
markers must meet with the approval of the Superintendent of Highways
and Utilities.
- Lot numbers are to be posted during construction.
- No open burning is to be permitted except during open burning season
under fire department regulations.
- All builders must comply with the Fire Department's underground fuel
storage regulations. Any lot restricted by an order of conditions by
the Conservation Commission for underground fuel storage shall not be
issued a permit for such by the fire department.
- Permanent house numbers shall be posted on dwellings prior to
occupancy.
- Prior to taking occupancy, the subdivision streets shall provide
adequate access to each residence by having had the binder coat
applied.
- As a matter of public safety and in the best interest of the future
residents of the subdivision, all dwellings shall have a residential
sprinkler system installed in accordance with NFPA 13D and North
Andover Fire Department Regulations.
4. Per the Police Department's recommendations:
Signs shall be placed east and west of the intersection on Gray
Street indicating that there is an intersection ahead.
5. A definitive plan submittal shall provide a detailed program of
constructing the development which is acceptable to the Planning Board.
No construction shall occur prior to the endorsement of said program by
the Board.
6. The applicant shall comply with the Tree department's recommendations
to preserve the existing treees and to bond for new planting.

7. Drainage calculations shall be submitted to mitigate runoff in the 10
year and 100 year storm event.
8. No lots shall be released from the covenant running with the property
until the following is completed:
- All drainage is constructed in accordance with the Subdivision Plans
including binder coat application, all utilities, including but not
limited to, fire alarms, water lines, sewer, drainage, electric, gas,
cable shall be installed in accordance with plans.
9. A stuff pit burial plan shall be submitted to the Planning Board and
Highway Department for review and approved prior to any on-site
construction.
10. The name of the proposed roadway shall be placed on the plans.
11. Contiguous Buildable Area shall be shown on each lot to be at least
75%.
12. The developer shall comply with the Tree department's recommendation to
preserve existing trees and to bond for new planting.
13. A detailed tree plan in accordance with section V, K and IV.1 shall be
submitted with the definitive plan for review by the Planning Board and
the Tree Department.
14. There shall be no common driveways within this subdivision.
