Requirements as to the contents of "definitive plans":
G.L. c. 41, s. 81 0, briefly describes a "definitive subdivision plan" as "a
plan of such proposed subdivision, showing the lots into which such land is to
be divided and the ways already existing or which are to be provided.... * for
furnishing access to such lots....." However, such a plan should also supply
the data required of "preliminary plans" under G.L. c. 41, s. 81 L, as follows:
"Preliminary plan" shall mean a plan of a proposed subdivision or resubdivi-
sion of land drawn on tracing paper, or a print thereof, showing (a) the
subdivision name, boundaries, north point, date, scale, legend and title
"Preliminary Plan"; (b) the names of the record owner and the applicant and the
name of the designer, engineer or surveyor; (c) the names of all abutters, as
determined from the most recent local tax list; (d) the existing and proposed
lines of streets, ways, easements and any public areas within the subdivision
in a general manner; (e) the proposed system of drainage, including adjacent
existing natural waterways, in a general manner; (f) the approximate boundary
lines of proposed lots, with approximate areas and dimensions; (g) the names$
approximate location and widths of adjacent streets; (h) and the topography of
the land in a general manner.
It should also conform to the rules and regulations of the North Andover
Planning Board relative to definitive plans, and to the requirements imposed
by law for the recording of plans at the Registry of Deeds.

REASONS
1. The pians are not adequate under our existing regulations.
2. No topo_>,raphical map was submitted with the definitive plan
and onP is required.
3. The top)�rraphical map should show existing natural features,
particu'arly a ponded area in the general vicinity of lots
#1, 7, q � 9.
k. Additional drainage must be shown; specifically, two catch
basin,, at the junction of Bannan Drive and Salem Street to
interr!ept water that would enter from Salem Street.
5. Additional substantial drainage should be provided for
drama;=e of the ponded area, as previously mentioned.
6. The Board of Health has advised that they require percolation
tests by a sanitary engineer on each lot before the lot will
be arrroved for building purposes.

Dear Mr. Lyons:
A public�_,hearing was held by the Board of Appeals on August 8, 1977 upon application
of Chester Sullivan who requested a variation of Sec. 6.3 and Table 2 of the Zoning
By-Law so as to permit a side setback variance as shown on a plan of land dated
November 13, 11976 located on Surrey Drive. The following members were present and
voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Vice-Chairman; Louis DiFruscio,
Clerk; James D. Noble, Jr.; and Assoc. Member, Sandra Munroe.
The hearing was advertised in the Lawrence Eagle-Tribune on July 23 & 30, 1977 and
all abutters were duly notified by regular mail.
Appeared Chester Sullivan on his own behalf and made a presentation according to his
plans. He stated that since the last time he petitioned for this same variance he has
tried to effect land swap in an effort to eliminate the zoning violation but was unsuc-
cessful in doing so. His only recourse at that time was to petition the Planning Board
for permission to reapproach the Board of Appeals within the two-year restriction period.
The Board of Appeals made the determination that such permission was granted by the
Planning Board and that the petitioner did, in fact, have standing to reappear with
his petition.
The petitioner introduced his plans as per his original petition showing the violation
and indicating that it would be necessary to move the entire premises 3 feet over as
his only remedy.
No persons appeared in opposition.
The Board felt that to allow this building to remain in its unmarketable state would
subject the same and the neighborhood to the likelihood of vandalism thereby creating

a substantial hardship on the petitioner and the neighborhood in general.
At a meeting held on September 19, 1977 a motion was made by Mr. Noble and seconded
)reluctantly by Mr. Frizelle to GRANT the variance and received the unanimous vote of
the Board.

Dear Sir:
A public hearing was held by the Board of Appeals on January 'L4, 1977 upon application
of Chester Sullivan who requested a variation of Section and Table 2 of the Zoning
By-Law so as to permit a side setback variance as shown on a plan of land dated
November 13, 1976 located; on Surrey Drive. The following members were present and
voting: Frank Serio, Jr.,, Chairman; Alfred E. Frizelle, Vice-Chairman; Louis DiF'ruscio,
Clerk; Ralph Joyce; and Assoc. Member, Stephen R. Doherty.
The hearing was advertised in the Lawrence Eagle-Tribune on December 24 & 31, 1976
and all abutters were duly notified by regular mail.
The petitioner seeks a variance from the provisions of Sec. 6.3 and Table 2 of the
By-Law, side setback for property owned by him on the north side of Surrey Drive 550
feet from Chadwick St.
The building located on the premises is not yet completed. The petitioner stated to
the Board that he purchased the land and building from the builder and subsequently
determined that the building was located 12 feet from the side and Table 2 of the By-
Law requires a 15 ft. setback.
Section 9.5 of the By-Law is clear in that it requires that the following elements be
met that owing to conditions especially affecting a parcel of land or a building
but not affecting generally the zoning district in which it is located, a literal
enforcement of the By-Law would involve substantial hardship, financial or otherwise,
to the appellant or where desirable relief may be granted without substantial detriment
to the public good and without nullifying or substantially derogating from the intent
and purpose of this By+-Law." The petitioner did not in his written application or at
the hearing meet all of the aforementioned elements. Further, the Board notes that the

petitioner is a builder and has constructed other dwellings in the town and, therefore,
was adequately familiar with the Zoning By—Law. Although this individual did not con—
struct the building on the premises he purchased it apparently without checking for a
defect such as the one presented to us. The petitioner does have remedies other than
the variance from the provisions of this By—Law available to him. In light of the
fail=e of the petitioner to satisfy the requirements of Section 9.5, the Board voted
unanimously to DEKY the request for a variance.

Dear Sir:
The following petition was heard at a meeting of the Planning Board on Monday
evening, November 20, 1972 at 7:30 P.M. in the Fire Station meeting room. The
following members were present and voting: Charles W. Trombly, Jr., Chairman;
Donald N. Kesirstead, Vice Chairman; Frits Ostherr, Clerk; William Chepulis and
John J. Monteiro.
CHESTER C. SULLIVAN petitioned for a subdivision of a parcel of land, containing
nine lots, entitled "Salem gardens"; located on the northerly side of Salem Street
bounded by land of Smith, New England Power and Peterson.
Mr. Sullivan appeared on his own behalf; Robert P. Morris was the engineer.
Several abutters objected because of the drainage and the wet area in the develop-
ment. On January 91 1973, the subdivision was disapproved for various reasons, as
filed with the Town Clerk at that time. Several meetings and discussions were
held thereafter to alleviate the drainage problems. The petitioner then submitted
corrected plans and at a meeting held on April 29 1973► the Board took the following
action. Mr. Monteiro made a motion to disapprove the subdivision; Mr. Lamprey
seconded the motion and the vote was two for disapproval and three against disapproval;
the motion failed. Mr. Keirstead then made a motion to APPROVE the subdivision; Mr.
Ostherr seconded the motion and the vote was three for approval and two against
approval. This being a majority vote, the subdivision is approved, subject to the
following conditions.
1. That the record owners of the subject land forthwith execute and record a
"covenant running with the land*, or otherwise provide security for the construction
of ways and the installation of municipal services within said subdivision, all as
provided by G.L. c. 419 S. 81-•U,
2. That all such construction and installations shall in all respects conform to
the governing rules and regulations of this Board.

3. That# 49 required by the forth Andover Board of Health in its report to this
Boardp no building or other structure shall be built or placed upon Lots as shown
on said Plan without the prior consent of said Board of Health.
k. That water and sewer will be according to the rules and regulations of the
Board of Public Works.
5. That surface drains and street bounds must be installed; the roads must be
hot-topped and constructed all in accordance with the requirements under the
Subdivision Rules and Regulations of the Planning Board. Proper street signs
must be installed. Appropriate inspections for the satisfactory completion of
the provisions in this paragraph are to be performed under the direction of the
Office of the Highway Surveyor,
6. Must comply with the Board of Fire Engineers' requirements as to the fire alarm
system.
7. The two proposed catch basins on Salem Street shall be located within the
entrance to Bannan Drive and be connected to the other catch basins within the
subdivision,
