These comprise an irregularly shaped parcel approximately 1000 feet by 700 feet bounded northerly by 3oute 114 and containing about twenty acres more or less. lie understand that in 1943 at the time of the adoption of the North Andover Zoning By-law the premises in question were used for a commercial ski slope development . We propose to continue this use and to improve the site by (a ) clearing and grading a parking lot and additional open slopes and trails, (b) moving the old school building used as a warming but and snack bar to a new location on the south side of Route 114, (c ) increasing the capacity of the lift, (d) installing snow making e : equipment, ani (e) installing and constructing whatever other structures , fences , etc. , may be incidental to the above improve- ments. These improvements will all be made within the general area which was devoted to the ski slope development prior to 1943. Under these circumstances our counsel has advised that the proposed improvements might well be considered exempt from the operation of the Zoning By-law by reason of G.L. Ch. 40A, Section 5,that we may, therefore, start work on the improvements next week, but should also, out of an abund- ance of caution , stand ready( particularly if any of the town authorities desire it) to make appropriate application to the Board of Appeals for special permission under Section 4.04 of the Zoning B<T-law `or a variance .
