Dear Sir:
A public hearing was held by the Board of Appeals on April 12, 1971 upon application
of Land Vest Properties, Inc. who requested a variation of Section 6.33 of the
Zoning By—Law so as to permit the subdivision of a parcel of land to form a lot
Containing 8.9 acres but not having the required frontage on the premises located
at the northerly side of Boxford Street, approx. 1/2 mile from the Boxford town
line. The following members were present and voting: J. Philip Arsenault, Esq.,
Chairman; Dr. Eugene A. Beliveau, Cleric; Kenneth E. Pickard, Arthur R. Drummond
and Frank Serio, Jr.
The hearing was advertised in the Lawrence Eagle—Tribune on March 27 and April 31
1971 and all abutters were duly notified by regular mail.
Benjamin C. Osgood spokes representing Land Vest Properties, Inc. He said Land
Vest has purchased approx, 118 acres of land from the Tools and. this 8.9 acre
parcel is land that would go with the Teel house, barns, etc. In 1946 a right of
way was granted from Boxford Street to the Teel farm. They have a buyer for the
house and two barns and the right of way will only be used for this one house.
This will in no way be a subdivision; all future development will be from the
other direction. They have no frontage and would like to have this as one house
lot.
Atty. Maurice Rappaport represented the Adams family, immediate abutters, and
opposed the petition. Atty. Ignatius Piscitello, representing Mrs, Catherine
Donovan, an immediate. abutter, also opposed the petition. Mrs. Strycinski and
Harry Thomas, also abutters, spoke in opposition. They pointed out that the
plan presented is misleading, there is frontage on Foster Street, the entire 180
acres should be shown. The Board of Appeals does not have the power to grant
this variance. Building Inspector Charles Foster pointed out that by forming
this new lot they are eliminating existing frontage on Foster Street.
The petition was taken under advisement and voted upon at the meeting held on
May 10, 1971. The Board found that no evidence of hardship was presented by the
petitioner and that to create a lot with no frontage would be in substantial
derogation of the intent and purpose of the Zoning By—Law. Mr. Drummond made a
motion to DENY the variance; Mr. Pickard seconded the motion & the vote was unanimous.

Gentlemen:
In compliance with your request, I have summarized the results
of soil tests and test pit observations on a parcel ofCland in
North Andover, known as Turner Bridges.
The results of percolation tests indicate that the drainage
properties of the majority of areas tested would be; in accordance
with Title 5, suitable for the subsurface di-sp6sel--of sewerage.
A major brook,which is a tributary to a drinking water supply
passess through the parcel. Small seasonal brooks were also observed
on the property. These brooks must be a major consideration in the
design of disposal systems .
Outcropings of ledge were observed. The test pits indicate that
the ledge, although existing, is not extensive. The presents of
ledge is a consideration in the design of sewerage systems, but it
Is my opinion it should not impose a severe problem.
This is a preliminary study and a more detail study of each
individual lot, including percolation tests and test pits must be
done prior to the design of -any subsurface disposal field.
