July 15 , 1985 Mr. Daniel Long , Town Clerk Town Office Building Worth Andover, MA 01845 Re: LMT Realty Trust/Lot 4 Southside Holt Road Site Plan Review through Special Permit Dear Mr. Long: The North Andover Planning Board held a public hearing on Monday evening , July 1 , 1985 at 8 :00 p .m, in the Town office Meeting Room upon the application of LMT Realty Trust. The hearing was advertised in the North Andover Citizen on June 13 and 20 , 1985 . The following members were present: Paul A. Hedstrom, Vice Chairman; John A. James , Jr. , Clerk; Erich Nitzsche ; and John J. Burke. The petitioner seeks a special permit under Section 8 para- graph 3 , Site Plan Review, of the North Andover, Zouing Bylaw. The purpose of the Site Plan Special Permit is to review the proposal of LMT Realty Trust to construct an office and repair shop. The premises is known as Lot 4 located on the South side of Holt Road . Said lot is situated in an Industrial-2 Zoning District possessing 1 . 93 acres of land area and ,street frontage of 250 feet on Holt Road. At the hearing, the Project Engineer, Michael Rosati of DiPrete Marchionda Associates , the applicants representative presented the proposed plans and informed the Planning Board of the following: - LMT desires to construct the proposed building totaling 18, 000 square feet on a 1 .93 acre vacant lot. It will be serviced by town water, gas and electric. - The owner will occupy 1/3 of the building, the rest will be leased . -2- - There are no on-site wetlands . - Thirty one (31 ) parking spaces will be provided. - Hours of operation will be 7 a.m.. to 5 p.m. - Drainage will be provided by means of an easement to Holt Road . Mr. Rosati informed .1 o ed the board that he he d a meeting with the Highway Surveyor to discuss the pro- posed drainage tie in to Holt Road. The following members were present and voting at the July 15, 1985 meeting when the board rendered their decisions Paul A. Hedstrom, Vice Chairman, John A. James,, Jr. ,Clerk, Erich W. Nitzsche, and John J. Burke. Upon a motion made by John J. Burke and seconded by John J. James Jr. the Board voted to grant the petition for Site Plan Approval under the Special Permit process for Merrimack Trucking and Equipment Company dated May 1985 , revised July 10 , 1985 by DiPrete Marchionda & Associates , Woburn, MA for Lot 4, Holt Road, subject to the following : 1 . A total sprinkler system with a Fire Department connection is required under M.G.L. , Chapter 148, Section 26G. 2 . The building shall have a fire alarm system and be con- nected to the municipal Fire alarm. The builder should contact the Fire Chief regarding this system. 3. The owners shall provide information to the Fire Dept. as to what processes will be involved with this business; (i . e. , cutting and welding, flammable storage, types of vehicles to be serviced , etc. ) 4. There shall be no leakage, dumping or storage of waste products associated with the use on-site. In granting this Special Permit, the Planning Board finds, pursuant to Section 10.31 - Conditions for Approval of Special Permits of the Zoning Bylaw, that the following conditions are met: •There will be no nuisance or serious hazard to vehicles or pedestrians due to its location within an Industrial-2 district and due to the improvements on Holt Road. • Adequate and appropriate facilities, such as town water, gas, electric and approved septic system, will be provided for the properoperationof the proposed office and repair shop. • i • Based on site visits , the hearing process , and review and input by town boards and departments , the repair shop and office use which is permitted in Section 4.130 is considered to be in harmony with the general purpose and intent of the Bylaw.
