The North Andover Planning Board has voted to APPRM said plan, subject to the
following conditions:
1. That the record owners of the subject land forthwith execute and record
a "covenant running with the land", or otherwise provide security for the con-
struction of ways and the installation of municipal services within said sub-
division, all as provided by G.L. c. 41, S. 81-U.
2. That all such construction and installations shall in all respects
conform to the governing roles and regulations of this Board.
3. That, as required by the North Andover Board of Health in its report to
this Board, no building or other structure shall be built or placed upon Lots

The undersigned hereby applies for the approval of said DZVIAITIVS plan
by the Board, and is furtherance thereof hereby agrees to abide by the Board's
Rules and Regulations. The undersigned hereby further covenants and agrees
with the Torn of North Andover, upon approval of said DSFMTM plan by the

1. To install utilities in accordance with the rules and regulations of the

Liberty Hills 11, Conditional Approval
(1) All septic systems designs, within the Town of North Andover,
be approved by the Hoard of Health.
(2) Any changes on the plans required by the North Andover
Conservation Commission may be subject to Modification under
Chapter 41 by the Planning Board.
(3) All Planning Hoard Order of Conditions are to be placed upon
the recorded Definitive Plan, (cover sheet) Prior to endorsement
and filing with the Registry of Deeds.
(4) A stop sign shall be installed at the point that Laura
Woodside Walkins Way connects to Sharpners Pond Road, and
int@r^section warning signs shall be located 750+ in either
direction from the proposed intersection. Per order of the NAPD
safety officer
(5) Throughout all lands located in North Andover, tree cutting
shall be kept to a minimum in order to minimize erosion and
preserve the natural features of the site. Accordingly, the
developer in conjunction with a registered arborist, shall submit
a tree cutting and reforestation plan ( the plan is for areas of
substantial cutting and filling ) to be reviewed by the Planning
Hoard prior to the This plan shall explicitly include specific
trees to be retained. Also, the developer shall inform the Town
Planner when significant tree cutting is to occur in order that
the Planner may determine the need to be present.
(6) The contractor shall contact Dig-Safe at least 72 hours prior
to commencing any excavation.
(7) Sas, telephone, cable and electric utilities shall 60
installed as specified by the respective utility companies.
(6) All catch basins shall be protected with hay to prevent
siltation into the drain lines during road construction.
(9) No open burning shall be done except as is permitted during
burning season under Fire Department regulations.
(10) No underground fuel storage facilities will be installed
except as may be required by Town regulations.
(11 ) Permanent house numbers will be posted on dwellings prior to
occupancy.
( 12) Prior to releasing of any security, all roadways, headwallli,
culverts and rip-rap retaining walls shall be built to
specification from the North Andover DPW. Also, all drainage and
detention ponds shall be installed, loamed and seeded, and
certified from the design engineer with As-Built Plans detailed
that all drainage is in conformance with th• Definitive Plan.

(13) All construction shall be 100% complete within two (2) years
from the signing of these plans.
(14) Liberty Street, as it extends to the south, shall be
upgraded to proper width, grads and construction so as to allow
direct access to the subdivision through the Town of Middleton.

Reasons for Disapproval R
Due to the lack of interest on the 44 �� pC.t" f plicant and
representatives no presentation was made before thNorth Andover
Planning Board for review and discussion to determine the viability of
the project for development.
1. A Request for Determination has not been filed with the North Andover
Conservation Commission per Section 310 CMR 10.57 (4) (b) under Chapter
131 - Wetlands Protection Act, and local wetland bylaws.
- the definitive plan shall delineate the edge of the bordering
vegetative wetlands. -
2. Per the Police Department's recommendations:
- The eleven lots in North Andover are those in the jurisdiction of
town services.
- The applicant has not satisfied the Police Dept. that all homes will
be clearly numbered to identify the area which falls under the
jurisdiction of North Andover .
3. Per the Fire Chief's recommendations:
- The applicant has satisfied the Fire Dept for public safety reasons
that there exists adequate water supply for fire protection.
Construction should not occur on lots 1-11 until such time as there is
an adequate water supply for fire protection.
At such time as the water supply issue has been resolved, the following
conditions may apply:
- Fire hydrants to be installed at 500 foot intervals.
- Lot numbers are to be posted during construction.
- No open burning is to be permitted except during open burning season
under fire department regulations.
- All builders must comply with the Fire Department' s underground fuel
storage regulations. Any lot restricted by an order of conditions by
the Conservation Commission for underground fuel storage shall not be
issued a permit for such by the fire department.
- Permanent house numbers shall be posted on dwellings prior to
occupancy.
- Prior to taking occupancy, the subdivision streets shall provide
adequate access to each residence by having had the binder coat
applied.
- As a matter of public safety and in the best interest of the future
residents of the subdivision all dwellings shall have a residential
sprinkler system installed in accordance with NFPA 13D and North
Andover Fire Department Regulations.
4. Drainage calculations have not been submitted to mitigate runoff.
Cross drainage has not been designed to handle 100 year storm event.

5. No lots would be released from the covenant running with the property
until the following is completed at the time definitive submittal is
approved:
- Drainage is constructed in accordance with the Subdivision Plans.
- Prior to binder coat application, all utilities, including but not
limited to, fire alarms, water lines, sewer, -drainage, electric, gas,
cable shall beinstalledin accordance with plans.
6. A detailed tree plan in accordance with Section V, K and IV.1 shall be
submitted with the definitive plan for review by the Planning Board and
the Tree Warden.
7 . A stump pit burial plan shall be submitted to the Planning Board and
Highway Department for review and approval prior to any on-site
construction.
8. The applicant shall be advised that in the event a Definitive Plan
evolves from this Preliminary Plan and/or parcel of land, the North
Andover Planning Board will require upon submittal that all aspects of
the Rules and Regulations governing the Subdivision of land must be
strictly adhered to and will be a requirements notwithstanding this
decision.
9 . The applicant shall comply with the Tree Department's recommendation to
preserve existing trees and to bond for new planting.
