The North Andover Planning Board has voted to APPROVE said plant subject to the

4. Other conditions:
a. All Planning Board Orders of Condition are to be placed on the recorded definitive plan.
b. Prior to signing the definitive plans all deeds of easements shall be submitted to the
Planning Board and held in escrow until completion. At the time of completion, the
developer or owner shall execute such documents for the Town.
c. A certified as-bunt plan shall besubmitted showing the location of all utilities(electric,
water,sewer,telephone) prior to binder coat application.
d. Final as-built plans shall be submitted to the Planning Board prior to final release of
security.
e The applicant/owner/developer shall be aware of the fact that approval of this

4. A Notice of Intent shall be filed with the North Andover
Conservation Commission as required under Ch. 131, Wetlands
Protection Act and the local Conservation Commission' s
regulations and any changes required may be cause for
reconsideration of the subdivision under Ch. 41 .
5. In accordance with the Fire Department ' s recommendations:
a. No open burning is to be permittted;
b. All underground fuel storage shall comply with the Fire
Departments' requirements for the Watershed District;
C. A new fire alarm box, for use at the intersection of
Great Pond Road and the entrance to this development, shall
be provided to the Fire Department;
d. All hydrants shall be placed within 500 feet of each
other .
6. Prior to razing any structures on the site, the Planning
Board shall be notified in writing as to the dates removal
shall take place . All permits , both local and state shall
be obtained to ensure proper compliance .
7. All requirements of the subdivision control law pertaining
to ' street trees ' shall be enforced. Security in the amount
of $15, 000. shall be retained for this purpose.
8. In accordance with the Board of Public Works
recommendations:
a. The water main on the proposed roads shall be 8 " class
52 ductile iron cement lined water pipe installed 15 feet
from the property line with 5 feet of cover below the finish
grade of the street;
b. 8" Mueller or equal gate valves (open left) shall be
provided on baseline B at sta. 5+54 and 15+0 and at Bonny
Lane;
C. Eddy breakflange hydrants to North Andover
specifications are to be installed at sta.5+50, 9+66,and
6+83 on Baseline A and at 6+50 on Baseline B;
d . All hydrant branches shall be provided with 6" Mueller
or equal gate valves (open left ) ;
e. All gate vlaves shall comply with AWWA specifications
1500 52T and will be supplied with 100 lb. sliding type gate
boxes marked - WATER;
f . The 8" water main shall be installed straight. through
the proposed cul-de-sac on Baseline A;
g. All water mains shall pass leakage and pressure tests
performed in accordance with Section 13 of AWWA C600 and
shall be chlorinated in accordance with AWWA C601 Standard
Procedure for Disinfecting Water Mains;
h. All sewer mains within the subdivision shall be 8"
vitrified clay pipe installed in the centerline of the
street;
i . A 6" vertical separation shall be maintained between 8"
V.C. sewer and the 12" R.C.P. cross drain at sta.0+82+79 on
Baseline B;
j . A sewer lift station shall be provided in the existing
utility easement at the end of Bonny Lane in order to
provide sewer service to lots 9, 10, and 11; Profile and
calculations to be provided to the Planning Board and Board
of Public Works for approval prior to construction;
k. A plan and profile of the proposed gravity sewer on
Great Pond Road from the existing sewer lift station to the
proposed roads shall be submitted in detail;
1. Precast manholes shall conform to ASTM designation C478
and shall meet the following additional requirements:
the wall thickness shall not be less than 5" ,
sections have tongue and groove joints with a bitumastic
gasket .
pipe connections shall be of the rubber boot with
stainless steel band type or approved equal .
. manhole frames and covers shall be cast iron lettered
'SEWER' and be a minimum of 6" high.
M. All sewers must pass low pressure air tests with maximum
allowable leakage rate of 0. 0015 cubic feet/minute/square
foot of internal pipe surface .
9. A waiver request shall be submitted in writing regarding
length of a dead end street (Sec.II.B.8&IV.A.4. ) prior to
signing the definitive plans .
10. The following shall be placed on the restrictive covenant:
The parties agree that the approval of the definitive
subdivision plan is a condition in the covenant . It is
contemplated that such approval as may be issued by the
North Andover Planning Board will contain covenants,
conditions and various requirements as a part thereof ,
including such as may be stipulated by applicant (Seller )
and said Board as a condition of said final approval . Such
may include, but not by way of limitation, installation and
construction of roads, utilities, road improvements, sewer
installation and connections , water lines, sewer pumps or
lift stations , retention pond and areas, siltation holding
areas , drainage systems and improvements and erosion control
development .
11. Connecting drainage to Great Pond Road from Cochichewick
Drive shall be incorporated into Great Pond Road and be
redirected from Lake Cochichewick to Rea' s Pond. The
culvert to Lake Cochichewick shall be blocked or removed per
the Highway Department ' s recommendations . Improvements such
as pipe size, shall be approved by the Highway Department .
Drainage calculations shall be provided to the Highway
Department and Planning Board for review for concurrence .
12. The roadway cross-section shall be revised to comply with
the Planning Board' s Rules and Regulations .
13. Where the water service is located adjacent to and or
crosses the sewer line, a minimum 18" separation shall be
maintained, specifically at sta.0+82 and 13+00.
14. The 20 foot wide Lake Cochichewick access easement shall be
noted as ' public' and limited to 'pedestrian access '.
15. The Planning Board has made the determination that the
proposed subdivision roads and services are adequate only
for single family use.
Note: TO BE PLACED ON THE RESTRICTIVE COVENANT
16. If the proposed structures designated for demolition are not
razed, lot line changes shall be made to bring the lots into
conformance with the North Andover Zoning Bylaw.
17 . In accordance with the Highway Department ' s recommendations:
a. Two additional catch basins shall be placed at sta.6+00
and two at sta. 13+18;
b. All catch basins shall have 4 foot sumps;
C. Inspection Form shall be used for all phases of
construction.
18. A ' concrete sedimentation detention basin' or grease and oil
trap' shall be constructed in accordance with the plans
provided by the Highway Department . Calculations and a
final detailed plan shall be submitted to the Planning Board
and Highway Department for review anfd approval prior to
construction.
19. A 5, 000 square foot retention area shall be provided along
the property lines of Lot 9 and 10, with a 25 foot wide
access easement deeded to the Town.
20. The sedimentation and erosion control program shall be in
place prior to construction to include, but not be limited
to marafi fabric, double row staked haybales and check dams .
This program shall be continuously maintained throughout the
duration of all construction (roadway, utility installation
and house construction) and may be modified as deemed
necessary by the Planning Board. Security in the amount
$30, 000. shall be retained. A separate erosion control plan
to be provided prior to construction.
Note: This provision applies to both onsite and offsite
construction

21 . No construction shall take place within 250 feet of Lake
Cochichewick .
22. The submitted Construction Schedule detailing Phase
I, II,III, IV, and V shall be fully adhered to and no
construction activity shall occur on any new phase until
substantial completion of the then current phase. The
Planning Board, together with the other Town Boards, shall
issue a written consent prior to commencement of a new phase
upon a finding after field inspection of substantial
completion of the then current phase. It is the Board' s
intent to minimize the amount of open construction activity
at any oen time in order to control resulting construction
runoffs into the Lake . Construction by applicant wihin each
phase as more specifically set forth in the applicant ' s
proposal shall take place in the sequence set forth in said
proposal .
23. In accordance with Section 4. 133, ( 2)a. there will be NO
dumping of stumps in the subdivision. '—
24. Any drainage from cellars or lot development shall be tied
into the designed drainage system to be shown on the
definitive plan, and approved by the Planning Board and
Highway Department.
25. All aspects of construction in this development will be
subject to inspection and review by the respective
departments of the Town of North Andover .

1. The preliminary plan of land as submitted does not show the
required information as specified in the Planning Board
Subdivision Rules and Regulations under Section III,A.2 -
CONTENTS.
2. The buffer and planting area between the proposed roadway and
land of Murphy creates a substandard lot in violation with the
North Andover Zoning Bylaw.
3. The preliminary plan of land as submitted does not show the
water loop connection to the existing main in Bonny Lane.
4. The preliminary plan does not show the connection to any
existing sewer line.
5. The applicant shall be advised that in the event a Definitive
Plan evolves from this preliminary plan and/or parcel of land, the
North Andover Planning Board will require upon submittal that ALL
aspects of the Rules and Regulations Governing the Subdivision of
Land must be strictly adhered to and will be required
notwithstanding this decision.
