In addition to this report, a set of definitive subdivision plans, x 24" 36" in size,- whish show the lot layout, plan and profile, construction details, and also the topography and grading, are included. The Lot Grading and Topographic Plans show the existing and proposed' ' topography at two foot contour intervals„ along with the location of existing structures, fences, and walls. In addtion, the plan shows the existing vegetative cover, as well as all major tree groupings and other botanical features which are of importance which might exist on the site. Important wild life habitats, as well as areas which will not be disturbed by construction are shown on the plan. The plan shows the location of test pits and percolation tests which were taken on the site, as well as "the'scil types based on the-United States Department of Agriculture Soil Study!. The 'location of these test pits designate the areas in which ground water table elevations were recorded, and these are contained on the enclosed perc test and test pit report enclosed with this statement. The seasonal high ground water mark can then be determined through a review of these reports and the plans together. In addition, the wetland elevation is shown on the plan. Plans which show the drainage area watershed are delineated separately but enclosed within this report for use and consideration. 1 PHY$IOAL ENVIRONMENT The site consists of approximately ll+acres, located on the Easterly side of Boston Street in North Andover, MA. The entire site is wooded with trees which include hardwood and pine. These trees are mixed throughout the site, ' depending on the soils which exist on each individual section of the site. In addition, a wetland area exists on the site, in the front area of the parcel, as well as immediately adjacent to the two streams which traverse the site. The topography is generally varied, and slopes from the East in the rear of the ,site, down to Boston Street, the Western boundary of the parcel. A series of small hills and valleys exist on the premises. Some ledge outcrops are on the site, as well as many large boulders scattered throughout the premises. Other than a large boulder existing in the Easterly portion of the site, there are no special or unusual geological features which are not indigenous to New England, and North Andover. There are no specific scenic areas, Tia our knowledge there is no record of any special historical features, except that the appearance of an old foundation does exist on the site, on lot 1. Trails exist on the site, in the form of MERRIMACK ENGINEERING SERVICES. INC 0 66 PARR STREET • ANDOVER, MASSACHUSETTS 01810 2 I gravel cart roads or woods roads, which run from one parcel to the other adjacent parcel in a random fashion, through the site. These appear to be ' old logging roads which provided access from Boston. Street into some back land parcels. These probably were put into existanee when all of the land was under common ownership. ' Adjocent.to the premises is land owned by the Commonwealth of Massachusetts, Division of Land Management.; This land is part of the Harold Parker State Forest System, and is not to be developed by the Commonwealth, but held in ' reserve for open space. At no time was any endangered wildlife observed on the premises. Wildlife ' which is'indigenous to this area include waterborne creatures which normally exist in and around wetlands, as well as indigenous wild life to wooded areas. These include chipmunks and squirrels as well as various types of birds. The proposed development will not impact any of the features.-mentioned above in a,negative fashion. The proposal calls for the development of nine lots, all of which can accommodate the construction of ,a. single family home. All of the lots will be a minimum of one acre in size. All of the lots will be serviced with a roadway approximately 850 feet in length. The roadwV'has been layed out to minimize negative impact upon the site, but ' does in fact cross two different streams at one point. The first roadway crossing is through and across a main brook which is enlverted at the woods road previously described. This culvert will be removed, and replaced with a new pipe line which is the full width of the right of way. In addition, a secondary stream will be crossed by the roadway, by means of a culvert placed thereunder. The culverts have been designed to accommodate the flow for a 100 year storm. 1 Only those trees which must be removed to accommodate construction of the roadway will be lost or removed for construction of this project. In 1 addition, trees which are located in the areas of subsurface disposal systems and proposed houses, including areas of regrading will be removed from the site. It is not proposed to remove any other trees from the site, but to maintain as many of the trees on the premises as possible. None of the gravel cart paths or roads will be removed from the site but in fact will disappear in places, due to the construction of the houses and ' leach fields on the site. The construction of the major roadway into the site will cause the disruption of some of those cart paths. A title search by the attorney for the subdivider did not turn up any prescriptive rights L in the roadways, and therefore, the integrity of the cart paths need not be maintained by the subdivider. All of the stone walls which exist around the perimeter of the site will be maintained by the developer, and wherever possible, the stone walls which transect the site will be maintained on the ' premises. As few wetlands as possible will be disturbed, and in fact, the roadway and drainage system has been layed out so as to provide a minimal disruption of the wetlands by the construction. In order to minimize the impacts of this construction on the site, hey bales and other erosion control devices will be placed in critical areas of the site. ' This project will not impact in a negative fashion any special historical features, or displace any endangered wild life, as none has been identified on the premises. The resulting surface will be foamed and seeded or treated with bark mulch until a permanent vegetative cover is put in place. II' The ,land use within the developmentsingle will 'consist of sin a family homes, ' serviced with municipal water. Subsurface disposal systems (septic systems) " will'be constructed on each lotto service each of the homes. The water main will be extended by the developer down Boston Street, from Grey Street, as no municipal water main currently exists within Boston Street ' at this time. The roadway, approximately 850 feet long, will contain storm drainage and water mains as all designed and layed out in full accordance with the Town of North Andover Subdivision Regulations. The roadway will consist of a 26 feet wide bituminous concrete road, with a closed cul-de-sac at the end. A Cape Cod type berm will be constructed on etch side of the roadway to direct water in the gutter to the catch basis, storm drainage system. The area behind the bituminous concrete curb will consist of loam and seed, as no sidewalks are proposed to service the development at this time, since none exist on Boston Street. ' The proposed land use is compatable with the existing land use in the neighborhood, since all single family homes and public open space exist .__.., within area adjacent to this project. No pollution of ground water is' antictipated'since all of the septic .systems.. will be designed is accordance-,- with _'.. . . ..- . .. with the State Sanitary Code. No harmful pollutants'will be generated = from the residential site development. Since erosion control and sedimentation control will be put in place during construction of the roadway and other improvements, no other negative impact upon the neighborhood will be generated. SURFACES WATER, AND SOILS Within the development, a wetland area exists in the front of the site, adjacent to Boston Street. This wetland is fed by an intermittent brook which runs from the North of the site, into the wetland, towards the South portion of the site. A smaller stream runs from the land of the Commonwealth of ' Massachusetts, in the Southeast quadrant of the site, Northwesterly to this large brook. The outlet from the wetlands is controlled by a 12" x 24" oval corrugated metal pipe which passes under Boston Street. The land uses to ' the South of the site, specifically two single family dwellings as well as a portion of the open space from the land of the Commonwealth of Massachusetts, all drain onto a portion of the site. In addition, the land to the North of this site also drains into the brook which traverses this property. All of this drainage enters the wetland area in the Boston Street portion of the site. The wetland in this area, consists of a wooded vegetative wetland which has skunk cabbage, some blueberries, red maple, and few cedar therein. ' A portion of the site drains to the east property line, onto land owned by Brown and the Commonwealth of Massachusetts. This separate and distinct watershed does not have any defined channel leading from it. Only a small amount of overland flow leaves the premises to the neighbors lands in this area. Attention is called to the watershed plan for a, more definitive description of this area. • MASSAC„USETTS 01810 ' MERRIMAf K ENCaNEERING SERVICES in+t- 0 60 PARK STREET ANDOVER. During construction, as much of the wetland and stream areas which can be protected, will be protected. Hay bales and siltation fences will be placed ' where shown on the plan in a protective radius around these wetlands and streams, to prohibit surface and sediment pollution of these watercourses. These siltation fences and hay bales are devices approved by the United ' States Soil Conservation Service for protecting such sensitive areas. It will not be necessary to provide temporary siltation ponds or sediment basins, as the degree of erosion from the site will be minimized by the maintenance of the existing vegetative cover wherever possible on the site. The trees and matting which exist will reduce the runoff of soil from the site into these regions. ' The maximum amount of vegetation removal which will occur at any time, will be at the time the roadway is first cut into the site. At this time, it will be necessary to remove 1.3 acres of tree cover in order to accommodate the ' slopes and the roadway construction called for on this plan. No other tree clearing will be done during this time. This vegetation will be removed only after the erosion control devices have been put in place by the developer. All of the brush will be chipped on the site, and stored for reuse as mulch ' and erosion control. The logs will be removed from the site using standard -, logging methods. The stumps win oe removed from the premises n an9 put into an approved dumping ground, or buried along &-property line in an approved area. Loam will be stipped and stockpiled in an area which is at least 100 feet away from all of the streams and brooks on the site. This loam will be reused as part of the road construction, and lot finish grading. The subgrade will then be prepared with excavation using a large bulldozer. Any fill which is necessary to be brought onto :;he site will be done so ' at this time, where as any excess material will be stockpiled in an area more than 100 feet away from any of the wetland area or water courses. Util- ities will then be constructed within the roadway, and upon completion of these utilities the gravel subgrades will be installed. The road will be finish graded, paved, and the side slope loam and seeded. It is anticipated that no longer than six months of actual construction time will be necessary to build the entire roadway as described above. The maximum length of time ' for loam to be stockpiled on the site would then be five months, and which if maintained for any longer period, would be covered with a matting for other erosion control devices such as seed or hay. Lots shall be cleared only after the roadway has been grubbed and cleared and erosion control devices of an appropriate nature have been. put in place. Stockpiling of soil will be done"in the same fashion as. specified for the roadway, and all site contrucion on each lot shall be completed within six months from its commencement. Approximately 1.5 acres of trees and vegetation must be cleared and removed to accommodate construction of the septic system ' the house and driveway on each lot. The areas in which the vegetation is removed, will be replaced with loam and seed and therefore a grass lawn. This will occur even in the area of septic systems, but will not occur in the area of driveways which will be paved. The maximum amount of time that any lot ' will be disrupted would be approximately six months, since this is all of the time which is necessary for the developer to clear the lot, constuct the home, ' MERRIMACK ENGINEERING SERVOCES. ' No negative impacts upon any adjacent properties are expected by utilizing the above schedule and procedure, and no negative impacts are expected to occur to any of the streams or wetlands by use of this procedure.' ' Methods to control erosion and sedimentation include the provision of catch basins with sumps • according to Town standard, which will trap sediment before it can enter any stream or wetland area. The surface drainage system will be piped from catch basin into manholes, to allow access into the pipe lines for cleaning purposes. Land around the outlet of pipes as well as inlets of cross culverts will be maintained in place with the use of flared concrete ' pipe ends; •wi.th' rip-rap so As to not allow any erosion •a.Pter $he_ improvements which are proposed . have baen place$. The land will be graded to a maximum slope of 3 to 1. and therefore will be a stable slope which will not allow any erosion or sedimentation to occur within the waterways. All of the disturbed and graded areas will be affixed with a permanent vegetative cover in the form of grass or other approved legumes. ' The existing vegetation within the wetlands will be protected with the erosion control devices that have described above. Trees will not be disrupted when adjacent to construction but will be protected so as to maximize the value of the site. The development will blendwiththe ` topography, as no major regrading is taking place except to accommodate septic systems, the roadway on a minimul basis, and the homes as might be necessary to accommodate the septic system tie-ins. No marshes will be disrupted with this project, and the only shore line ' and seasonal wet area which will be affected will be the crossing of the streams with the roadway, which is necessary to access land which would otherwise not be accessible from a public way. There are no existing flood control or wetland easements on the site, but drainage easements are proposed in areas which will contain permanent drainage devices, and which be accessed for maintenance of the storm ' drainage system. Increaises in the peak rate of runoff caused by the altered surface conditions ' will be mitigated through the use of storage within the existing wetland area on lot, #9. The outlet from lot 9 does control the inflow from the major brook previously described. This control structure will continue to control the flow from the site so that a 0% increase in the rate of runoff from the ' premises will result. Modification to the inlet in the form of a control structure to be built around it will be provided by the developer. Wherever possible, ground water recharge is being utilized, and in this case, in the •� large vretland and retention area on lot N9. All of the lots will be serviced with septic systems which will be constructed in accordance with the Town of North Andover and State Sanitary Code. Since these are constructed according to the codes, no negative impact on the Around water or soils will result. The soils are conducive to the construction of the septic systems, as the percolation tests indicate relatively permeable ' soil well within the cut off limits for the installation of subsurface disposal systems. In addition, the ground water table in all cases is low enough to accommodate the construction of the septic systems with minimal ' MERRIMACK ENGINEERING SERVICES INC 0 66 PARK STREET 0 ANDOVER. MASSACHUSETTS WSW ' 6 regrading required. Because these septic systems will b in accordance with the State Sanitarya regraded Code, no ponding of surface water on the premises shall occur. B�UB�U ACECONDITIONS The test pit and percolation test results which have been taken in the presence of the Town of Borth Andover, Board of Health Inspector in the Spring of 1984, indicate that he t septic ept systems can be constructed in accordance with Town and State regulations on each lot. There are few, if any, limitations to the proposed project caused by subsurface soil and water conditions. In some locations, ledge and bedrock was found at elevations less that 4 feet from the surface. In these areas of the site, no septic systems can be constructed. In addition, septic. systems will not be constructed in wetlands, or within 100 feet from them. In all cases, the lot lines have been leyed out to allow the construction of subsurface disposal systems on each lot. In particular, lot 9 provides a configuration Of lot layout which is not considered rectangular or normal, but one which is specifically set up to allow for the construction of subsurface disposal systems to service a home an lot p93, in addition of the proposed flood storage pond. •'•r.._: .w ..:-.. .:..,.r _.... d..'-,:: >.....-Yr.?'+►!..'4• M n.;. .- ., - .. .. ., The percolation tests were Ndone in accordance with trh.e;.'Statey Sanitary Code, in the presence of the Town of Borth Andover Board of Health Inspector. The procedure involved excavation of the top soil and subsoil with a backhoe ' to an approved depth which is at least 36" below the surface and in other instances as deep as 5 feet below the surface. A 12" hole was excavated into this receiving material, the water poured in, and the test run in ' accordance with the State Standards. The findings indicate that subsurface disposal systems can be constructed on each lot. Since all of the septic systems will be constructed in accordance with the State Sanitary Code, there shall be no negative impact from these - systems on the ground water or the surface water. The States Sanitary Code that no pollution will occur as longus the design and construction is done witin their standards. Subsurface water quality will thus not be negatively affected by this development. TOWN SEgCES It is anticipated that 18 cars will be owned within this project, as 9 single family homes are proposed to be constructed within the development. The circulation flow is straight forward, with access to Boston Street being only through the one means of egress, available from the new roadway, onto li Boston Street. Because of the location of the homes within the development, the driveways from the two lots with fronts on Boston Street will access the proposed roadway, rather that directly onto Boston Street itself. The intersection is very close to 900, and is considered safely designed with plenty of sight distance' in the North and South directions. In fact, the location of the roadway as it enters onto Boston Street was set with the Town Highway Surveyor, to insure a maximum amount of visibility to the North. This waa even done with the consideration that a roadway placed further South on the property would allow for the construction of a Form A lot MERRIMACK ENGINEkRING SERVICES IN( 0 66 PARK STREET 0 ANDOVER, MASSACHUSETTS 01810 7 immediately, rather than when the roadway servicing the subdivision was under construction. Based on national studies, and information available from the Institute of Traffic Engineers, approximately 8 trips per day per household can be expected in a single family type development. Therefore, it is anticipated that 72 trips will be generated at the intersection of BostonStreet and the proposed roadway from this development. An additional 72 trips will most likely occur down Boston Street to Route llb, as that is the principal service road to Boston Street. Route llk is a major arterial collector, and is also known as Salem Turnpike. Currently, Route 114 has excess capacity to handle additional flows placed by feeder roads to it. The capacity of Boston Street will not be impaired by the construction of this development, as the traffic flow on Boston Street is relatively light. All of the vehicles which will be in and out of the development will be serviced with either garages or driveways which will be constructed on each lot. No on street parking is anticipated for this project, nor*shall be provided by the developer. The roadway will be fully accessible to police and fire vehieles. The cul-dei-sac at the end of the roadway has been designed to allow a fire truck to turn arouhd. The" ome`df"the "street will -be such that it wf:ll not conflict with any streets which are currently named within the Town of North Andover. The street name is subject to approval of the Police and Fire Chief. During construction of the subdivision and the roadway the PoliceDepartment and Fire Department will be Hilly briefed on the activity taking place so as to provide emergency access at all times to the development while under construction. The roadway design has been done in full accordance with the Town of North Andover, Department of Public Works requirement. Included within these specifications are design of a closed drainage system which includes catch basins that have sumps which must be maintained on a periodic basis by the Public Works Department. In addition, pipe lines which carry the drainage flow from the catch basin to the drain man holes and ultimately the streams msut be cleaned and maintained periodically by the Public Works Department. Further!, since the Town will have constructed within the roadway a public water main system, it will be necessary for the Public Works Department and the Water Department to maintain this water system. At the same time, it will become necessary for the developer to construct a water main system on Boston Street onto Grey Street. The Department of Public Works will maintain this portion of the water system. The developer will be paving Boston Street in the area of water main construction, and therefore, the Public Works Department will monitor this construction and ultimately maintain the pavement which is put in place. Apparently, the Town maintains a public grammar school and high school system, and the maximum amount of children which will be generated by this development should not exceed 1 child per household, or 9 children in total. Since the population of students within the community is declining on a per capita basis, it is the opinion of the developer that any additional children generated by this development can be absorbed by the school system. Further, it should be pointed out that in many cases residents of this development will be residents that were transplanted from one section of the community to this MERRIMACK ENGINEERING SERVICES INC 0 66 PARK STREET 0 ANDOVER. MASSACHUSETTS WSW 8 section of the community. Therefore, it might be that no new citizens who were not already citizens of the Town will reside in this development. Therefore, it is possible that no impact upon the school system will be felt with this project. Since Tom water will be supplied to this detelopment, there will be :&.minor' impact on the maintenance budget of the Water Department itself as it must service the pipe line contained within the project. In addition, it will be necessary for the Water Department to maintain and service the water main which is extended dorm Boston Street to service the project. Further, since ample supply exists within the Town itself, and the demand from these homes will be only 3,000 gallons of water per day, no negative impacts upon the Town water system should be generated. Further, the Tovn will receive an increase revenue to the Water Department budget as a result of sales of water to other homes located along Boston Street which will have a distribution system constructed in front of them, by the developer, at no cost to the community. Since septic systems are being provided on each of the lots, no impact on the Town sewer system is anticipated to occur from this project. cam, IMPACT _, . No negative impacts from this development are anticipated onto the Town of North Andover. Any impacts which in the judgment of Town Officials might be considered negative would certainly be offset by the amount of tax revenue which will be generated by this development to the Town. Currently, the parcel is taxed as vacant unimproved land and after development this will be taxed as individual house lots. Further, all of the homes will have a value in excess of $150,000, based upon the standard type of construction which has taken place in the Town to date. Since the brook does not run into the water supply of the Town of North Andover, no negative impact upon the watershed area is anticipated. Since this area is not significant for flood control to the overall Town area, no negative impacts are expected to result to flood control in this area of the eormunity. Additionally, construction of this development will not impair the integrity of any existing streets or ways, or the health, safety or welfare of any of the abutters. Notice of Intent received September 3, 1992 prepared by Ronald Pica, Pica Engineering Co. 2. Site Plan for Domenic Teoli in North Andover MA prepared by Pica Engineering Co. , Plaistow NH, dated 8/31/92 received September 3, 1992. Findings 1. The proposed project will result in the following wetland impacts: (a) The re-routing of a stream. (b) The filling/replacement of an undetermined amount of bordering vegetated wetland for the placement of a house and fill material. (c) The destruction/replacement of an undetermined amount of stream bank. No wildlife habitat assessment has been submitted. (d) The placement of a septic system in the buffer zone which is not within the North Andover Board of Health Regulations. The Applicant has not requested a waiver to these regulations. 2 . The Applicant has presented a plan showing a delineated wetland but the wetland has not been delineated in the field. 3. The Applicant states that the delineation is based on both soils and vegetative criteria yet not information is presented on soils and incomplete information has been presented on vegetation. The delineation is inaccurate, based on the North Andover Conservation Administrator's site visit. 4. No access for the proposed house has been shown and no final grading has been shown on the submitted plan. The NACC cannot, therefore, assess the full wetland impacts from this project. 5. The Applicant has stated that filling of wetlands is not necessary to access this lot but to build the house on it. 6. The Applicant has not presented any argument that this wetland filling should be considered a limited project. This wetland filling is therefore a discretionary wetland filling which the NACC has the authority to deny. 7. There is a flooding problem immediately downstream of this project. The Applicant has not presented any information to the NACC that this proposed project would not exacerbate the flooding problem. 8. This lot is presently owned by the developer of the subdivision. There were wetlands filled as a result of the subdivision construction. This is the one remaining undeveloped lot. Since all the property was recently under the control of the developer, this proposed wetland filling could have been avoided during the planning/construction of the subdivision. 9. The NACC forced other landowners in the subdivision to construct on their lots without wetland filling. Decision The North Andover Conservation Commission hereby denies this Notice of Intent. This project is denied due to the inadequacy of the information presented and for failure to meet various performance standards. The information presented regarding the wetland delineation is inaccurate and incomplete. The proposed project fails to meet the performance standards for Bordering Vegetated Wetlands. While it is unclear from the information presented, it appears that the proposed project may not meet the performance standards for land under water or bank. As an abuttor and co-developer of Teoma Estates with D.A. Teoli please advise us as to what the Wagon Wheel developers schedule is for the removal and restoration of the cul-de-sac. Also, please obtain from the developer and provide to me a definitive plan as to how my driveway will be incorporated into the extension of the street when the cul-de-sac is removed, and how the area is going to be restored. Finally, please advise Mr. Teoli (685-5973) or myself whether or not it is appropriate at this point, with the commencement of construction activity on the road into Wagon Wheel to place the finish coat of hot top on Old Cart Way. Our schedule was to have this completed by late Spring 1989. If this was to be done,the developer of Wagon Wheel would be required to rip up the finished street in order to continue the water main into the development. The NACC orders that all work shall be performed in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the following conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. GENERAL CONDITIONS 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3 . The work shall conform to the following (except as noted in the remainder of this document where revisions may be required) : (a) Notice of Intent filed by Merrimack Engineering services. (b) Plans prepared by Merrimack Engineering Services, Inc. dated June 19, 1992. 9. The following wetland resource area is affected by the proposed work: buffer zone. These resource areas are significant to the interests of the Act and Town Bylaw as noted above. These resource areas are also significant to the recreational and #242-593 Wagon Wheel Estates 3 wildlife interests of the Bylaw. The applicant has not attempted to overcome the presumption of significance of these resource areas to the identified interests. 10. The NACC agrees with the applicant's delineation of the wetland resource areas on the site as shown on the plans dated 6/19/92. 11. Issuance of these Conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding or storm damage. 12 . The conditions of this decision shall apply to, and be binding upon, the applicant, owner, its employees and all successors and assigns in interest or control. 13. For projects with catch basins except for crossing. All catch basins shall contain oil/gasoline traps, and it shall be a continuing condition of this order, even after a Certificate of Compliance is issued, that the oil/gasoline traps in the catch basins be maintained. All catch basins shall be free of all accumulated silt and debris before a Compliance is issued and the owner or his/her agent shall so specify in the request for a Compliance. 14. The previous Order of Conditions for this project expired and necessitated this filing. PRIOR TO CONSTRUCTION 15. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department or Court have been completed. 16. This Order shall be recorded by the applicant at the Registry of Deeds immediately after the expiration of all appeal periods. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. Any changes in he submitted plans caused by the applicant, another Board's deci ion or resulting from this Order of Conditions must be s witted to the NACC for approval prior to implementation. If he NACC finds said changes to be significant, the NAM will call for another public hearing (at the expense of the a )plicant) . Within 21 days of the close of said public hearing he NACC will issue an amended or new Order of Conditions. The applicant s all submit a construction schedule/sequence to the NACC detailin the proposed sequence of work on site to complete this projec . 21. Wetland flaggin shall be checked prior to start of construction and sha 1 be re-established where missing so that erosion control meas res can be properly placed and wetland impacts can be monit red. 22. A row of staked ay bales backed by a siltation fence shall be placed between all construction areas and wetlands. The erosion control bar ier will be properly installed and placed as shown on plans and all be inspected and approved by the NACC prior to the start f construction and shall remain intact until all disturbed areas ave been permanently stabilized to prevent erosion. All erosi n prevention and sedimentation protection measures found necessary during construction shall be implemented at the direction of the NACC. #242-593 Wagon Wheel Estates 5 23. The applicant shall have on hand at the start of any soil disturbance, removal or stockpiling, a minimum of fifty (50) hay bales and sufficient stakes for staking these bales (or an equivalent amount of silt fence) . Said bales shall be used only for the control of emergency erosion problems, and shall not be used for the normal control of erosion. 24. A proper bond or a deposit of money running to the Town of North Andover shall be provided in the amount of $10,000 for roadway and $3,000 for each lot in the buffer zone which shall be in all respects satisfactory to Town Counsel, Town Treasurer, and the NACC, and shall be posted with the North Andover Town Treasurer before commencement of work. Said bond or deposit of money shall be conditioned on the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the NACC, and Town Counsel, and shall be released after completion of the project, provided that provision, satisfactory to the NACC, has been made for performance of any conditions which are of continuing nature. The applicant may propose a bond release schedule keyed to completion of specific portions of the project for the NACC's review and approval. This condition is issued under the authority of the local Bylaw. DURING CONSTRUCTION 25. Upon beginning work, the applicant shall submit written progress reports every one (1) month detailing what work has been done in or near resource areas, and what work is anticipated to be done over the next period. This will update the construction sequence. 26. Any fill used in connection with this project shall be clean fill, containing no trash, refuse rubbish or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 27. No exposed area shall remain unfinished for more than thirty (30) days, unless approved by the NACC. 28. No regrading in the buffer zone shall have a slope steeper than 2: 1 (horizontal:vertical) . Slopes of steeper grade shall be rip-rapped to provide permanent stabilization. 29. There shall be no stockpiling of soil or other materials within twenty-five (25) feet of any resource area. 30. Washings from concrete trucks surplus concrete shall not � or be directed to, any drainage system or wetland resource area. #242-593 Wagon Wheel Estates 6 31. All waste generated by, or associated with, the construction activity shall be contained within the construction area, and away from any wetland resource area. There shall be no burying of spent construction materials or disposal of waste on the site by any other means. The applicant shall maintain dumpsters (or other suitable means) at the site for the storage and removal of such spent construction materials off-site. 32. Accepted engineering and construction standards and procedures shall be followed in the completion of the project. 33. Members of the NACC or its agent shall have the right to enter upon and inspect the premises to evaluate and/or effect compliance with this Order of Conditions. The NACC reserves the right to require, following field inspection, additional information or resource protection measures. 34. During and after work on this project, there shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area. If there is a spill or discharge of any pollutant during any phase of construction the NACC shall be notified by the applicant as soon as practical. No construction vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 100 feet of a resource area. AFTER CONSTRUCTION 35. No underground storage of fuel oils shall be allowed on any lot within one-hundred (100) feet of any wetland resource area. This Condition shall survive this Order of Conditions, and shall run with the title of the property. This condition is issued under the authority of the Town's Wetland Protection ByLaw. 36. Fertilizers utilized for landscaping and lawn care shall be organic and low-nitrogen content, and shall be used in moderation. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. This condition is issued under the authority of the Town's Wetland Protection ByLaw. 37. Upon completion of construction and grading, all disturbed areas located outside resource areas shall be stabilized permanently against erosion. This shall be done either by sodding or by loaming and seeding according to SCS standards. If the latter course is chosen, stabilization will be considered complete once vegetative cover has been achieved. 38. Upon completion of the project, the applicant shall submit a letter to the NACC from a Registered Professional Civil Engineer certifying compliance with this Order of Conditions and the approved plans referenced herein (or approved revisions) . A #242-593 Wagon Wheel Estates 7 stamped "As-Built" topographic plan of all areas within the jurisdiction of the Wetlands Protection Act and Bylaw shall be submitted when a Certificate of Compliance is requested. This plan will include: a. "As-Built" elevations of all drainage structures constructed within 100 feet of any wetland. b. "As-Built" elevations and grades of all filled or altered wetland resource areas. c. Distances from structures to wetlands. d. A line showing the limit of work. "Work" includes any disturbance of soils or vegetation. 39. The entrance to the State Forest Will be clearly marked. 40.
