Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening, November 29, 1971 at 7:30 P.M. in the Fire Station meeting room. Members present and voting were: Charles W. Trombly, Jr., Esq., Chairman; Donald N. Keirstead, Vice Chairman; John J. Monteiro, Secretary; Robert J. Burke and William Chepulis, Jr. RICHARD B. PEDIGREE and others petitioned to amend the North Andover Zoning By—Law as follows: To amend Section 4.11 by adding, as its opening phrase, the words: "Except in Rural Residence Districts," and by adding, at the end of said Section, the following sentence: "In Rural Residence Districts, only single family dwellings may be constructed, except as this By—Law may otherwise provide." Atty. Joseph A. Miragliotta represented the petitioners and others. He said the citizens of the town are very concerned about two—family and duplex homes being constructed in Rural Residence areas. He said people who build single family homes should have peace of mind and security in the area in which they live. They are concerned when homes are built that don't compliment the homes in the area. He doesn't think that his area is going to be affected by any zoning change but there are many other areas that would be affected and something must be done so as not to jeopardize the town's utilities and water supply. Many rural residence areas in town cannot handle duplex development, they cannot take septic tanks for more than one family. There were approximately 100 people present at the hearing. There was no opposition to the petition. Mr. Burke made a motion to take the petition under advisement and vote on the peti— tion at the next regular Planning Board meeting on Monday, December 6th. Mr. Monteiro seconded the motion and the vote was unanimous. The Planning Board met again on Monday evening, December 6, 1971 with the same members present, to vote on the petition. Mr. Monteiro made a motion to recommend FAVORABLE action; Mr. Keirstead seconded the motion and the vote was unanimous. The following reasons are given: y -2- December 10, 1971 The Board feels that two—family homes and duplex homes should not be allowed in Rural Residence areas in order to keep the density lower, which would be in keeping with the recommendations of John Brown, the planning consultant who is currently in the process of revising the Zoning By--Law and drawing up a master plan for the town.
