Conditions of Disapproval
July 6, 1987
1 . The length of the dead end roadway exceeds the maximum
length allowed by the Subdivision Rules & Regulations,
Sec. IIB, para. 8a, Although a waiver request has been
submitted, it is not totally excepted to the satisfaction of
the Planning Board.
a) No provision has been made or shown for the continuation
or access to, or proper projection of, potential streets
as provided for in Section IIB, para. 5.
b) In regards to the request for waiver dated: June 4, 1987,
Line item #5, states that the dead end would be6dieamh..Unudd
if developed by the only feasible abutter. The key map must
show how this might look
under Section II, para. 8b and Section IV, para. A Id & le.
Without the inclusion of potential streets, it is hard to
project how this dead end could be readily discontinued
as stated in waiver. There would still be a dead end and
turnaround.
c) Although the 120 ft. minimum radius (Section IV, papa. 4b)
for a cul-de-sac has been met, the Highway Superintendent
recommends a larger than minimum turnaround, which
should be considered.
2. The design of the detention pond, runoffs and the possible impact
to adjacent lands within the subdivision and also with the abutters
is not clear. Compliance to Section IV, para. E should be shown.
a) Clarification of abutters low land and possible wetland
should be shown/taken into account.
b) Two outlets to the detention pond is of concern.
c) Headwall should possibly outlet into the pond and not into
a grassy Swale.
d) A drainage easement would be required from the owner (s)
of the abutting properties if runoff is as shown in
Preliminary Plan.
3. Flood hazard area should be indicated on plans.
4 . Clarification on plan whether it is a 4 or 5 lot subdivision.
a) Conflict in plan check list with drawings.
b) If a five lot subdivision, lot #5 does not have sufficient
frontage.
5. Contiguous buildable area has not been shown on each lot on the
plan.
The following are other Planning Board' s recommendations
which should be included with the above, to any Definitive
Plan submittal (Form C) provided other provisions of the
rules and regulations governing subdivisions are followed.

1 . List of abutters and their addresses (Form E)
2. Zoning district of proposed subdivision and adjacent abutters.
3. A request for determination has to be filed with the North Andover
(Conservation Commission per Section 310 CMR 10.57 (4) (b) under
Chapter 131 - Wetlands Protection Act, and local wetlands bylaws
and the plans have not delineated the edge of bordering vegetated
wetlands. The plan does not show the extent of the wetlands on the
adjacent parcel which may be affected.
4 . The Police Department recommendations should be as follows. A
stop sign and a stop line shall be placed at the intersection of
White Bij'ch Road and Bradford Street. Need for a school bus stop
in this area shall be determined.
5. The Fire Chief' s recommendations should be taken into account
as follows:
a) Fire hydrants to be installed at 500 ' intervals.
b) Lot numbers to be posted during construction.
c) No open burning is to be permitted except during open
burning season under Fire Department Regulations.
d) All builders must be in compliance with the Fire Departments
Underground Fuel Storage Regulations and no permit will be
issued on lots found unsuitable by the North Andover
Conservation Commission.
e) Permanent house numbers shall be posted on dwellings prior
to occupancy.
f) Prior to taking occupancy, the subdivision streets shall
provide adequate access to each residence by having had the
binder coat applied.
g) As a matter of public safety, I strongly recommend the
installation of a residential sprinkler in each proposed
dwelling in accordance with NFPA 13D and North Andover
Fire Department requirements.
h) Any dwelling over 500' from the subdivision street measured
along the driveway shall be required to have an additional
fire hydrant and a residential sprinkler system installed.
i) A street sign approved by the Division of Public works is
to be posted at the intersection of Bradford Street and
White Birch Way.
6 . No lots shall be released from the covenant running with the property
until the following is completed. All drainage is constructed in
accordance with the Subdivision Pain, including binder coat
application, all utilities, including, but not limited to fire alarms,
water lines, sewer, drainage, lelctric, gas, cable shall be installed
in accordance with the plans.
7 . Drainage calculations will have to be submitted to mitigate runoff.
No calculations or drainage plan has yet been submitted to prove
to the Planning Board that the subdivision can mitigate increased
runoff without affecting abutting property.

8. The Highway Surveyor' s recommendations shall be addressed as
follows:
a) Catch basins to be 8" precast concrete with 8" barrel.
blocks used for pipe courses only.
b) Any brick to be clay brick and all mortar to be portland
concrete mortar.
c) All shoulder areas to be 8 ' with a i" per foot rise from
pavement.
d) Cul-de-sac as shown not acceptable. If this type of
cul-de-sac is desired, the planting area should be a
200 foot inner radius with a 26' paved road around it
and twelve foot shoulder area around that.
e) No service will be provided by this department until
binder is in place and the road is free of excavations
and any other obstacles that would hamper service vehicles.
9. A detailed tree plan in accordance with Section V. K and IV. 1
will have to be submitted with the plan for review by the
Planning Board and the Tree Warden. The applicant will have
to address the Tree Departments recommendations to preserve
existing trees and to bond for new planting if appropriate.
10 . A stump pit burial plan will have to be submitted to the Planning
Board and Highway Department for review and approval prior to any
on-site construction.
11 . The applicant shall be advised that in the event a Definitive Plan
evolves from this Preliminary Plan and/or parcel of land, the
North Andover Planning Board will require upon submittal that all
aspects of the Rules & Regulations governing the Subdivision of
Land must be strictly adhered to and will be a requirement
notwithstanding this decision.
12 . There shall be no common driveways within this subdivision.
