Dear Sirs
The following petition wqs heard at a muting of the Planning Board on Monday evening,
September 11, 1967 at the Town Office Building. The members present and voting were:
William Chepulis, Jr., Chairman; Robert J. Burke, Vice Chairman; Howard L. Gilman,
Secretary; James M. Barman and George B. Farley.
FRED and HELEN YQNGGEBA= petitioned to subdivide a parcel of land containing approxe
39 acres into three parcels. The petitioners donated a Right of Way to the Town of
North Andover, which was accepted at the Town Meeting of March, 1966, in order that
the Board of Public Works and Town Agencies would have access to the new well fields.
However, the right of way divides the property into large lots thus making interior
land available for development.
Atty. James Eaton, III represented the petitioners. Atty. John J. Willis spoke as
a member of the Board of Public Works, in favor of approving the plan and stated
that the road would become a public way. The Board of Public Works and the Highway
Department would construct the roadway and the Town would have the entire responsibility
of maintaining it. Mr. Angelo Cataldo spoke in favor of the subdivision saying that he
had at least two prospects interested in the Industrial development of the interior
land but would be unable to show them the land until the road was traversable.
Mr. Burke made a motion to take the petition under advisement. Mr. Barman seconded the
motion and the vote was unanimous.
The Board met on Monday evening, October 2, 1967 and further discussed the petition.
Mr. Burke made.a motion to approve the petition for subdivision subject to certain
conditions. Mr. Bannan seconded the motion and the vote was unanimous.
However, the duly filed decision was withdrawn when Atty. Eaton and Messrs. Willis
and Duffy of the Board of Public Works appeared at the Board meeting on Monday,
November 6, 1967 to further discuss various aspects and conditions affecting the
subdivision. In accordance with the Board's recommendations, Atty. Eaton agreed to
revise the plans to show a turnaround at the end of the roadway adjacent to land
owned by the City of Lawrence. Also, any necessary easements would also be provided.
Attp. Eaton also requested an extension of time for the approval period in order that
he may complete the items proposed and agreed to.

On Monday, December 41 1967 Atty. Willis presented the modified plans of the Yunggebauer
subdivision. Atty. Eaton's request for an extension of time was again confirmed.
Mr. Bannan made a motion to approve the petition for the subdivision as modified by
the amended plans subject to certain conditions. Mr. Burke seconded the motion and
the vote was unanimous.
The conditions are as follows;
1. Slope easements, where necessary as determined by the Board of Public Works,
shall be provided so that no section of the roadway shall emceed a 7% grade as
proposed.
Z. The road shall be suitably constructed to support industrial traffic and hot—topped
in accordance with subdivision amended regulations recently recorded.
3. No buildings or other structures shall be built or placed upon the land as shown
in the Plan of Subdivision without the prior consent and approval of the North Andover
Board of Health as required in its report to this Board.
4. Approval is further subject to the requirements of the Local and/or State Dept.
of Public Health regarding sanitary disposal systems.
g. The water connections shall be in accordance with the rules and regulations of
the Board of Public Works.
