Dear Sir: I recently inspected your property on 2357 Turnpike Street and found that there has been material dumped recently in the rear of your buildings. Large areas of land have also been stripped, with the dirt stockpiled. In checking with the Board of Health, I find that your original dumping permit has long since expired and that no earth removal permit was ever issued to you. I must, therefore, order you to cease any and all dumping, stripping of loam and/or removal of any earth materials until you obtain the necessary permits to allow such work. If dumping or earth moving is observed, I shall immediately obtain a court injunction ordering you to cease and desist such activities. I agree that the status of this operation under the Zoning By-Law is a non—conforming use that may be continued; however, it is my opinion that in order to continue earth removal operations, you must conform to the operating procedures, restoration standards, etc, set forth in the Zoning By—Law. Undoubtedly, you will wish to consult with your legal counsel concerning my interpretation of the Zoning By—Law. I strongly urge you to apply to the Zoning Board of Appeals for a special permit so that the town of North Andover may properly regulate this earth removal operation. Very truly yours, CHARLES H. Gentlemen: There has been no application for any building permits for any of the lots involved in this petition. The Board of Appeals have fall power over division of land and perhaps the Building Inspector should not get involved, but I believe there are pertinent facts regarding this land that the Board should be made aware of. 1. bets 6 & B as shows, on the plans are close' to the Shawsheen River than oaf other land from Grease Street to Mass, Ave. In fact, the Assessor's map shows the bank of the Shawsheen River ening through these two lots. If these lots were to be approved, the Board would, in my opinion, be IftocatINt for ' dine m7 a. One only has to think back to the floods of 3.938to realise what poor building lots these are. 2. All of the land included in this petition has changed hands during 1965. The laud was acquired (again from Assessorls records) by Salvatore & Prances Fiches from two different owners. Cpw-oaw5- There is a distinct possibility that the land was bought and is being ` divided for speculative purposes. 3. Because the lance does lie adJacent to the ShawsheoR Rives, the Board members might wish to personally view the premises before reaching a deeision. In conclusion, mag I again state that I wish in no way to inter- fere or impose mfr personal judgaeat upon the Board realising they have fall powers in the situation. Gentlemen: I have inspected the premises of the Atlantis Refining Company filling station and garage located on Osgood Street near the intersection of Great Pond Road. I find that on the westerly side of the lot next to Nr. Chepuli.s there are 18 evergreme planted in a single rov on this narrow stri of Uxd. The ever-* greens are approzLoately 1* feet high and l to 2 feet in diaawbsr. The bashes and grass have been allowed to grow &UMCA theme and even though this area is landscaped as required b7 your Board, it apparently has not been maintained. On the easterly side of the lot there are appro3dmtelr 32 low evergreens of the same type and size. Here again the area has not been maintained and bushes, grass, eta, are groving and it is difficult to ascertain that the evergreens are there. Gentlemen: I would like to call the attention of the Board to a souse of aggravation to many abutters and, a situation that could be controlled, I believe, by the Board. In Section 7.2 of the Zoning By-Taws, eaves, steps and uncovered perches are allowed to be nearer the lot lines than the specified number of -test in the various districts. This is all right when the normal eat-banks occur, but in instances where the Board has granted inriancos for dwelliags to approach nearer to the let line, the eztensica of the entrance steps or uncovered porches cow quite near the lot lines and result is complaints from people abutting the lot in question. I believe it would be within the powers of the Board to require all petitioners for variances on lot line set-backs to show the location of steps and uncovered perches so that the Board in its decision could control the set-back of steps and porches from the lot lino as well as the min building. Or, even if the petitioner did not show the location of steps and porches, the Board could stipulate that such steps and perches be located on a particular side of the structure so that a normal number of foot would be kept from: the lot line.
