The meeting was called to order by the Chairman at 8:10 P.M. in the
Town Building. This was a Public Hearinge
Members present: Chairman, Gregory Mooradkanian, Secretary, Richard
G. Whipple, Henry E. Lund, Andrew Al~ino and associate members Ja.~s
Regan and Sam DiM~nro. Mr. Dimauro replacing Irving 0. Howes and at
the re'quest o£ Mr. Lund, he was excused and James Regan replaced hi~
An application was received from Alfred Stott and Mary Burris requesting
a variation of the zoning by-laws so as to permit the building of a pro-
posed garage attached to the existing building at 43 Beverly Street;
This garage would extend out to within 3 feet of the side lot line. '
Ittornet Arthur Thomson represented the applicant and stated to the
Board that-this application had been made under Article 4 of the zoning
by-laws. This proPerty is located in a general residential district;
Mr. Thomson also stated that he felt that in addition to the exemptions
stated in the by-laws the board had the power of granting variances A~
over and above the expemptions contained in the by-laws if they were
construed to inflict a hardship upon the applicant. He stated that this
was a long settled community and that special consideration should be given
the facts concerned with this application. He stated that the existing house
was built long before zonin~ and was rather a box-like type of house and that
the addition of the propsed garage on the side of the house would !~mprove
~the appearance of the house by giving it width and would in no way be a
derogation from the character of the neighborhood. There was no obJectio, n
to this application. Ail abutters were notified and the notice for the
Public Hearing was published in the Evening Tribune on the evening of
December 2, 1950. Suggestions were made by the Board that the garag~
could be easily be built on the ~ther side of the house where there was
sufficient room and there still would be a required sideline. However,
the applicant felt that the garage would be better suited to his purpose
if it was built as shown on his plan. After further suggestions and
consideration a motion was ~de and seconded and it was voted to take
the matter under advisement and it was also voted that the Board go in a
body to view this property on Saturday afternoon, December/S, 1950.

The Board went to view the property i~ question on December 9, 1950.
After discussi~ng the application,, motion was made and seconded and it
was unanimously VOTED to der~ the application.
