A public hearing was held by the Board of Appeals on September 17, 1979 upon application
of Ernest G. & Edna Abbott who requested a variation of Sec. 7.1, 7.2, 7.3 & Table 2
of the Zoning By-Law so as to permit area, sideline and frontage variances located on
the south side of Dudley Street and shown on a plan -of land dated August 27, 1979,
The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E.
Frizelle, Esq., Vice-Chairman; R. Louis DiFruscio, Clerk; James D. Noble, Jr.; and
Assoc. Member, William J. Sullivan.
The hearing was advertised in the North Andover Citizen on Aug.-30 and Sept. 6, 1979
and all abutters were duly notified by regular mail.
The petitioner seeks this variance in order to permit the sale of a lot on the south
side of Dudley St. Evidence presented at the hearing showed that the petitioner is ;
requesting a variance for area, sideline, and frontage to enable the division of land E
into a small non-conforming lot. P
Upon motion by Mr. Frizelle, seconded by 14r. Noble, the Board voted unanimously to
DENY the petition. In denying the petition, the Board has found that the petition failed
to meet the provisions of Section 1094 of the By-Law, more specifically that the petition,
if granted, would not be a detriment to the public good. The Board further found that if
relief were granted it would derogate from the intent and purpose of the Zoning By-Law.
