Gentlemen:
All-States of Virginia, a Virginia corporation duly
qualified to do business in the Commonwealth of Massachusetts ,
and having its principal office in New York, New York, hereby
gives you notice of its appeal from the decision of the
North Andover Building Inspector dated May 14, 1958, refusing
to issue building permits on the application therefor filed
with him under date of May 13 , 1958, with respect to the
property on the westerly side of Turnpike Street, (Route 114)
and on the northerly side of Hillside Road.
The grounds of the appeal are that All-States of Virginia
is entitled to a variance with respect to said parcel from the
terms of the applicable zoning by-law, as provided by G. L.
Chapter 40A, Section 15, Paragraph 3, in that special conditions
make literal enforcement of the zoning ordinance or by-law a
substantial hardship and make desirable relief possible without
detriment to the public good or derogation from the intent or
purpose of such ordinance or by-law. Furthermore, when All-
States of Virginia purchased this parcel on December 30, 1957,
it was zoned for general business , and the purchase was made
in reliance on said zoning classification for general business.
We also file with you herewith in duplicate the formal
application for variation from the requirements of the zoning
ordinance filled out on your printed form, together with a
plan of the affected premises and a copy of the refusal by the
Building Inspector.
Please acknowledge receipt of this letter on the enclosed
copy and return it to us in the stamped addressed envelope
enclosed for your convenience.
