The following members were present and voting : Michael P. Roberts , Vice Chairman ; Vincent S . Turano , Clerk ; John J . Burke ; and Erich W. Nitzsche . A motion was made by Mr. Nitzsche and seconded by Mr . Burke to approve "French Farm Village ; subject to the following conditions and with a completion date of November 11 , 1982 for the binder coat and November 11 , 1983 for a4l improvements . The motion to approve the subdivision carried , I . That the record owners of the subject land forthwith execute and record a "Covenant running with the land" , or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision , all as provided by G. L . c. 41 , S . 81-U . 2. That all such construction and installations shall in all respects conform to the governing rules and regulations of this Board . No #3. 4. That no work shall be done in the subdivision until security in the form of a bond or covenant has been duly recorded a4d the plans are signed and recorded. 5 . That any changes made to the Definitive Plan by other town agencies or officials shall be submitted for approval to the Planning Board by the applicant . i 6 . All street trees shall conform to the Tree Warden ' s specifications. 7. A Notice of Intent , if applicable , shall be filed with the North Andover Conservation Commission pursuant to M .G. L . The applicant shall submit Proof of Ownership of said land, including authority to sign documents for the Trust prior to the Planning Board ' s endorsement of plan. 9. The applicant shall obtain a permit from the State Department of Public Works for installation of sewer an Osgood Street. 10. In accordance with the Board of Public Works letters dated August 17 , 1981 , August 28 , 1981 , and September 9 , 1981: a) The proposed force main on Osgood Street shall be a minimum of eight inch (8" ) ductile iron cement lined pipe ; b ) A sewer manhole shall be constructed on the centerline of Barker Street at the intersection of Barker Street and Old Farm Road and piped down Old Farm Road to French Farm Road in a location to be specified by the Board of Public Works ; c) The proposed sewage pumping station shall be designed so as to accept modifications to allow increased pump rates to 1 m. g. d. in accordance with the Master Plan ; d) The proposed sewage pumping station shall be located at Station 7 + 50 off French Farm Road on Lot 30 A 20 foot utility easement shall be provided along the Northwesterly properly line of Lot 30 to land owned N/ F of Stella Sobel and J . Arthur Bradley Trust, e) A ten inch vitrified clay sewer shall be installed from Barker Street along French Farm Road to the pumping station ; f) Prior to the issuance of a sewer construction permit, a Sewer Flow Analysis shall be performed on the existing Sutton Street sewer; a) If the Sewer Flow Analysis demonstrates that construction of said subdivision would overtax existing sewer, the existing six and eight inch gravity sewer on Sutton Street shall be replaced with an adequately sized pipe , as per Board of Public Works recommendations , and at the expense of the appli - cant ; h) Any portion of the subdivision that falls within the Watershed Zone as defined by the Watershed Zoning Map shall be staked out on the ground prior to any work and verified by the Board of Public Works . Said line to be maintained throughout the construction period and comply with Section 4. 133 of the i Zoning By Law; i ) Profiles shall be provided for all cross country sewers ; j ) All water and sewer facilities shall be installed in accordance with the Rules and Regulations of the Board of Public Works ; k) All sewer plans , profiles , and analyses will be submitted to the Planning Board for its record. If the proposed subdivision is not serviced by the proposed sewer system, then said subdivision shall be re-submitted to the Planning Board pursuant to M. G .L . Ch . 41 , Sec . 81-W . 12 . A properly executed utility easemen.t to the Town of North Andover over either land owned N/F of Starmard Realty Trust or land owned N/F of Sophie Haphey , both as shown on sheet 6 of 7 on the Definitive Plan , and shall be submitted to the Planning Board and recorded with the plan . 13. In accordance with the Highway Surveyor' s recommendations and letter dated August 17 , 1981 : a ) Any drainage problems encountered during construction shall be incorporated into the proposed drainage system to be determined by the Highway -Surveyor; b) A properly executed Pedestrian Access/Egress easement , 20 feet in width , across Lots 16 and 17 , extending to land owned by the Town of North Andover shall be deeded to the Town of North Andover and shall be recorded with the plan; c) Two catch basins shall be installed at the intersection of the proposed road and Barker Street; d) The proposed cul -de- sac at approximately Station 28 + 0 shall be raised four feet and adjuste dto a 1% grade at Station 24 + 0 ; e) To accomodate leaching from the hill , to minimize slopes , and to provide any necessary drainage to accomodate drains from site development , drainage from cul -de-sac shall be continuous from the slope side of the road from approximately Station 27 + 0 to 20 + 0 ; f) Drain line from Station 7 + O to 17 + 0 shall have a connecting truck drain running down the Southerly side of road vs the Northerly side ; g) All shoulders and slopes shall conform with the Subdivision Rules and Regulations and shall be seeded with hay seed as specified by the Highway Surveyor ; h) Headwall size and shapes shall be in accordance with the Highway Surveyor ' s recommendations ; i ) Entry and alterations to existing street drainagq shall require a street opening permit from Highway Department ; j ) Tops of catch basin frames shall be three inches lower than pavement ; k ) Minimum cover over any drain pipe shall be thirty inches ; 1 ) Underground utilities shall require a plan of approval and shall be completed prior to application of hottop . Said utilities shall be inspected by the Highway Surveyor prior to any backfilling ; m) A North Andover Planning Board inspection form shall be used and complied with . In accordance with the Fire Department ' s letter dated August 14 , 1981 , the distance between hydrants shall be no greater than 250 feet . 16 . In accordance with the Tree Warden ' s letter dated August 11 , 1981 , a bond in the amount of $20 ,000 shall be posted to insure com- pliance with street trees requirements , subject to inflation adjustments . 17 . If proposed subdivision is to be completed in phases , . separate completion dates shall be imposed for each phase as they are initiated . 18. Binder coat shall be applied no later than November 11 , 1982 . 19 . All improvements in said subdivision shall be compelted no later than November 11 , 1983. 20 . Drainage calculations refer to a spillway at elevation 138. 0 . Provide detail on plans to show the design and location of such spillway and submit plans to Highway Surveyor and Planning Board. 21. Revise the drain pipe size from twelve (12) inches to eighteen (18) inches at Station 19 + 0 on Old Farm Road to be consistent with the drain calculations . 22 . Revise the drain pipe size from twelve (12 ) inches to twenty four (24) inches and from eighteen ( 18) ,inches to twenty four (24) inches at Station 12 + 10 + on Old Farm Road to be consistent with the drain calculations , 23. Gelinas, representing BARGO CORP., petitioned For a subdivision of a parcel of land containing approximately 8.6 acres situated off Marbleridge Road, subdivided into 10 lots and to be known as "Marbleridge Estates". Plans were presented to the Board by Mr. Gelinas at which time he stated that there is about a 30 ft. difference in elevation going from Marbleridge Road down. They intend to put in a 600 ft. roadway, shown as Woodberry Lane on the plan, which will run southerly toward the rear of the property. Individual septic systems will be installed, as opposed to communal sewerage. Abutters and neighbors objecting to the severe wetlands and proposed drainage were as follows: Benjamin Kalinowski, Sr., Alexander Uzynski, Dr. Robert Smith, Adele Dainowski, Derman Harris, Josephine, Uarynski, Connie Bernal, Ann Howes, Vera Warwick, Joseph Winning, and Ben Kalinowski, Jr. Charles Poster, Building Inspectoiv objected to the minimal frontage on some lots and the fact that the cul de sao was not brought to the property line. The following members were present and voting: William Chepulis, Chairman, Paul Hedstrom, Clerk, and Michael P. Roberts. A motion was made by Roberts and seconded by Hedstrom to approve STONECLEAVE II Modification with the following conditions. The vote was unanimous and the meeting adjourned at 9:30 P.M. Conditions — Stoneoleave II: 1. That the record owners of the subject land forthwith execute and record a "covenant" running with the land, or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision, all as provided by G.L. Ch. 41, s. 81-u- 2. That all such construction and installations shall in all respects conform to the governing rules and regulations of this Board. 3. That, as required by the North Andover Board of Health in its report to this Board, that individual septic system permits must be obtained prior to the issuance of a building permit from the Board of Health under the rules and regulations of Title "V" of the state sanity code; and that the developer shall, prior to the sale of individual lots to individual owners, submit to the Board of Health percolation tests showing the suitability of said lots for the installation of subsurface disposal systems for single family dwellings, however such restriction shall not prevent the mortgage of said lots or the sale to developers or home builders against whom this III condition shall also remain applicable and enforceable until complied with. 4. That no work shall be done in the subdivision until security in the form of a bond or covenant has been duly recorded and the plans are signed and recorded. Stonecleave 11 — Decision — Page 2 S. That any changes made to the definitive plan by other town agencies or officials shall be submitted to the Planning Board by the applicant. 6. All street trees shall conform to Tree Warden's specifications. 7. That due to changes in the modification of said subdivision: which have resulted in the removal of a proposed pond on Lot 20, the following conditions of approval on the original subdivision plan which was approved on MAY 7, 1979, are hereby released: a) Condition 6.0. "With respect to the proper administration of material disposal, which will result frost the construction of the pond, the following shall apply: all material dredged from the pond will be utilized on the site; should any excess material result that is not necessary for sitework, it will be offered initially to the flown of North Andover at a fair market value. Should the Tows of North Andover not require the material all the material required to be trucked from the site will be done so in accordance to the Tows of N.A. Earth Removal Ordinances." b) Condition 9, the phrase '"Town of North Andover shall have control of pond elevation and outfall" and the phrase found in parentheses,"exclusive of pond."i 8. That in accordance with the HWY Surveyor's letter dated July 7, 1980: a) gravel used on the road to meet HWY Department specifications (or Blass. The following members were present and voting: Paul R. Lamprey, Chairman; William N. Salemme, Vice-Chairman; Michael P. Roberts, Clerk; William Chepulis; and .John J. Monteiro. Mr. Prank C. Gelinas, engineer for the developer, Joseph Barbagallo petitioned for a subdivision of land containing 32 lots on approximately 46 acres situated off Boxford Street, and to be known as Stonecleave Estates. Mr. Gelinas presented plans for all to view and pointed out the drainage systems, roadway, basic terrain which is full of ridges. He told the Board that once the roadway-is put in the problem concerning the two permanent wet areas will be taken care of due to the drainage systems. The one wet area, estimated to be about 30-40 feet in diameter, would be used for fire fighting, etc. by increasing its water holding capacity for year round use. They will work with the Conservation Commission an this matter. The land is adjacent to the old Teal Farm property. An easement line of 30 feet and an additional buffer of 20 feet runs behind lots 8-12. At a meeting held on May 16, 1977 the Subdivision Control Subcommittee made and seconded a motion to approve said subdivision subject to the following conditions: 1. That the record owners of the subject land forthwith execute and record a "cove- nant running with the land", or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision, all as pro- vided by G.L. c. 41, s. 81-U- 2. That such construction and installation shall be in all respects in conformance to the governing rules and regulations of this Board. 3. That no lot may be built upon until a subsurface sewage disposal system permit is granted by the Board of Health. 4. That changes requested by the Planning Board and outlined in P. C. Dry Hydrants In cooperation with the Board of Public Works, I have been able to outline a standard detail for dry hydrants. These dry hydrants will be serviced by a 611 Class 150 John Manville Blue Brute Pipe from said hydrant to a point fifteen feet (15 ft. ) into a water reservoir. Said pipe to be located three feet (3 ft. ) below the water surface. Attached to the end of the pipe will be R.E. Chapmann type strainer. Dear Sir: The following petition was heard at a meeting of the Planning Board an NowdaY evening, June 49 1973 at 7:30 P.M. in the Tore: Office wilding; meeting room. The following members were present and voting: William Chepulis► Chairman; John J, Monteiro► Vice Chairman; Paul R. Lamprey► Clerk and Donald H. Keirstead, JOSBPH J. BARBAG'ALLO petitioned for a subdivision of a parcel of land containing appy 37 acres situated on the easterly side of Forest Street► subdivided into 9 lots and to be known as "Cedar Lane" subdivision. Hr. Barbagallo appeared on his own behalf and presented plans and profiles to the Board. He stated that Lot #9 would never be built upon and that it contained a swamp area of some 30 acres which he will probably give to the tors in a few years. Since there is no town water available* the development will have to be welled. The Fire Chief was concerned as to fire protection since there is no water avaii.l.able. It was noted that an existing pond could be used for fire protection. There were no mor problems with the development. A few minor corrections and changes had to be made on the definitive plans and pending receipt of corrected pump the matter was taken under advissment. There was no opposition to the development. At a meeting held are July 21p 1973► proper plans were submitted. We Honteir0 made a motion to APPROVE the subdivision subject to the standard conditions and requirements of the Board of Health and Conservation Commission, Hr. Ostherr seconded the motion sad the vote was unanimous. The conditions are as follow: 1. That the record owners of the subject land forthwith execute and record a "covenant running with the land", or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision► all as provided by C.L. c. 41► S. 81-U. 2.
