Dear Sir: The Board of Appeals held a public hearing on Monday evening, March 9, 1981 upon the application of Bay Bank Merrimack Valley. The hearing was duly advertised in the North Andover Citizen on February 12 and 19, 1981 and all abutters were notified by regular mail. The following members were present and voting at the public hearing: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice Chairman; Richard J. Trepanier, Esq. , Clerk; William J. Sullivan; and Walter F. Soule. The petitioner seeks a variance of Section 7, Paragraph 7.1, 7.3, and Table 2 of the Zoning By-Law to enable the construction of an addition to its office on Main Street, which would be used for the purpose of an Automatic Teller. The size of the lot and the location of the structure prohibits construction at any other location according to the petitioner. Security of patrons using the Automatic Teller also requires that it be located in the front of the structure. On a motion made by Mr. Frizelle and seconded by Mr. Trepanier, it was voted unanimously to grant the variance as requested. In making; its decision, the Board, relying upon the evidence presented, finds that the size of the lot and more particularly the location of the structure thereon, being set back in conformity with the other structures along the business section of Yain Street, creates a hardship to the petitioner. [ A • Y Bay Bank Merrimack Valley Petition No. 3 - '81 Page 2 The Board further finds that because of the makeup of the neighborhood, that the allowance of the variance will not derogate from the intent and purpose of the By-Law, and that the petitioner has satisfied all of the requirements of Section 10.4 of the Zoning By-Law.
