Lyons, Town Clerk ' Town Office Ruildina North Andnver, Mass. Dear Sir: A publi^ hearing was held by the Board of Appeals on December 11, 1972 upon appli— cation of PHII,TP A. CAHILL who requested a variation and special permit under Sec. 4.1:22, para. 14, a, b, & c of the Zoning Bye-Law so as to permit the conversion of a two-family home into a three-family home by altering the first floor apartment into two apArtment.s; located at the west side of Waverly Road and known as 157-159 Waverly Road. The following members were present and voting: J. Philip Arsenault, Esq., Chairman; Dr. Eugene A. Beliveau, Clerk; Frank Serio, Jr., Arthur Dru=nond and Associate Member Louis DiFruscio, who sat in place of member Kenneth Pickard. The hearing was advertised in the Lawrence Eagle-Tribune on November 25 and Decem- ber 2, 1972 and all abutters were duly notified by regular mail. Atty. James A. Glynn, Jr. represented the petitioner and explained that a variance had been .7rsnted hv_ this Roars to the previous owner for the subdivision of land so that, th- frontad-e of this particular lot has already been varied. He is re- a questing the conver-loo of a. two-family dwelling into a three-family dwelling. The second floor dwelling unit is occupied. The proposed two dwelling units on the first floor meet the area requirements. The house is over forty years old and has water and sewer facilities. He would like to vary the section calling for arehi- tect 'G nllans because this is such a small conversion, it would entail great expense to submit architect's mans and submit builder's blueprints of the conversion in- stead. He is silo*, to vary C,2,b relative to the width of the roadway because there is not. -nrntgh area to meet this requirement; also to vary 4, c & d relative to parking area, becaus- this is such a small conversion. He feels there are several mrporanhQ of this particular section of the BY-Law that apply specifically to large conversions and would not apply in this particular case. They will provide a parkinl- area .and will hot-top it. Several abutters were present and were in favor of the petition. Dr. ?elivem, mad- a mnt.ion to continue the hearing and that the petitioner submit proper maps showirc the rrorversion for the next meeting; Mr. Serio seconded the motion and the vnt- wps unanimo>>s. Philip A. Cahill -2- January 24r 1973 SF At i aoard of 4^rP.a?s meeting held on January 1$, 1973, proper building plans were siibmitte•l. 4+ter. Glynn explained further that there would be no exterior structural chapP 7Pq Th plot plan showed the hot-topped area for parking. He Pxpinined that• aG loan as the weather permitsl another area will be hot-topped for ,4 cars an, with n f—strPpt, parking in the front, there will be nine narking 9nacPs p,-n•rf-i- 1 4r all . Yr. Member Drummond, who tat on the original 'hearing, was rn+ nrpsAn+ -:n that the vote of the four members that were present was unanimous. The Doard' frnzna that +,r,r, sPveral requirements of Section 4.122 (14) had been met ari t^at, t.a certain regulations would cause a severe hardship to the petitionp^; i ,,er?fore, the special permit was granted and the requested vnrinnces to the f^"owin sections: B, 11; C, 2b; C, 4, cried; be granted. The Board found that the orantine! of these variances would not be a substantial dercontion from +..hp intent and purpose of the Zoning Fay-Lew and would not be detri- mental to the area; in fact, the proposal would enhance the neighborhood.
