Lyons, Town Clerk Town Office Building North Andover, Massa Dear Sir: A public hearing was held by the Board of Appeals on January 10, 1972 upon application of JOSEPH P. CALLAHAN who requested a variation of See. 6.31 & 7.23 of the Zoning By- Law so as to permit the division of land with existing buildings for the purpose. of � conveyance; on the premises located at 147, 157-159 Waverly Roads 2-4v 6-6 & 30 Union Street. The following members were present and voting: J. Philip Arsenault, Chair- man- Kenneth E. Pickard, Vice Chairman; Dr. Eugene A. Beliveau, Clerk; Arthur R. Drummond and Frank Serio, Jr. The hearing was advertised in the Lawremae Eagle-Tribune on December 24 & 31f 1971 and all abutters were duly notified by regular nail. Atty. Maurice J. Close represented the petitioner and explained that a subdivision A plan had originally been drawn up is 1938 dividing the area into lots which was never recorded 'so that the area now shown one large lot with several houses, which have been there for a great number of years. In order to sell some of the property, it is necessary to divide the area into lots. Nothing will be dome to disturb the existing structures. Some of the lots do not conform to the requirements of the present Zoning By-Law; however, they do conform to existing properties in the surround- ing urrounding area. One of the houses will be sold to the present tenants. There are five houses presently existing and there would be three vacant lots formed. They intend to sell lot #7 but will hold lots #3 & #4 for the present. The character of the neighborhood would not be changed in any way; there would be no commercial use what- ever. There would be a financial hardship to the petitioner if the land was not subdivided. There was no oppositioh and the petition was taken under advisement. During this period the petition was reviewed by the Board; Mr. Seriomadea motion to GRANT the variance, Mr. Pickard seconded the motion and the vote was unanimous. ,r Joseph P. Callahan —2,- January 14# 1971 The Board found that the lots existed on a plan prior to 1956, and since 193$0 even though through an inadvertence the plan ran not recorded. The Board found that there are lots of similar size in the area that are built upon. To that part of the area on which there are existing structurea, there would be no struct— ural changes and the buildings existed prior to the enactment of the Zoning By—Lar, The Board found that it was necessary to subdivide the area to allow the petitioner to convey the houses separately and that there would be financial hardship if they could not be sold. very truly yours, BqNW OF APPEALS .
