3• The North Andover Planning Board has tentatively approved said plane
subject to the following modifications thereof:
1. IN accordance with the Board of Fire Engineers letter dated January 8, 1981,
the distance between hydrants shall be no greater than 500 feet;
2. All requirements for street trees shall be enforced and a bond shall be
Posted at the Definitive Subdivision stage for this purpose in accordance
with the Tree Warden's letter dated January 15, 1981;
3. Water and sewer improvements shall be in accordance with the Board. of Public
Works letter dated January 16, 1981. additionally, a detailed design for the
sewage pumping station and force mail shall be submitted with the Definitive

Subdivision Plan and a Flow Study on the existing sewer on Sutton Street shall
be submitted prior to the submittal of the Definitive Subdivision Plan;
4. In accordance with the Highway Surveyor's letter dated January 19, 1981:
a. .Adequate slope easements shall be shown on the Definitive Subdivision
Plan aocomodating an eight foot shoulder area and a 2.1 slope. Said
easement shall also be submitted in a written, recordable form; and
b. Hank gravel shall be used an. roadway. If bank gravel is not available,
a top dressing of six inches of processed gravel shall be required.

7 . A Notice of Intent , if applicable , shall be filS&41th10&n th
Andover Conservation Commission pursuant to M .G . L . Ch . 131 , Sec. 40.
If applicable , a Certificate of Compliance shallbe obtained from
the Conservation Commission for any order of conditions prior to
the final release of any bond or covenant.
8. The applicant shall submit Proof of Ownership of said land , in-
cluding authority to sign documents for the Trust prior to the
Planning Board ' s endorsement of plan .
9 . The applicant shall obtain a permit from the State Department of
Public Works for installation of sewer on Osgood Street .
10. In accordance with the Board of Public Works letters dated August 17 ,
1981 , August 28 , 1981 , and September 9 , 1981 :
a) The proposed force main on Osgood Street shall be a minimum of
eight inch (8" ) ductile iron cement lined pipe;
b ) A sewer manhole shall be constructed OR the centerline .of , Barker St .
at the intersection of Barker. St , acrd 01u Farm Rd, and pipeddown
Old Farm Rd , to French Farm -Rd . in a location to be specified by
the Board of Public Works .
c) The proposed sewage pumping station shall be designed so as to
accept modifications to allow increased pump rates to 1 m .g. d .
in accordance wit4 the taster Plan ;
d) The proposed sewage pumping station shall be location at Station
7 + 50 off French Farm Road on Lot 30. A 20-foot utility easement
shall be provided along the Northwesterly property line of Lot 30
to land owned N/F of Stella Sobel and J . Arthur Bradley Trust ,
e ) A ten inch vitrified clay sewer shall be installled from Barker
Street along French Farm Road to the pumping station ;
f) Prior to the issuance of a sewer construction permit , a Sewer
Flow Analysis shall be performed on the existing Sutton Street
sewer;
g) If the Sewer Flow Analysis demonstrates that construction of
said subdivision would overtax existing sewer , the existing six
and eight inch gravity sewer on Sutton Street shall be replaced
with an adequately sized pipe , as per BPW recommendations , and
at the expense of the applicant ;
h ) Any portion of the subdivision that falls within the Watershed
Zone as defined by the Watershed Zoning Map shall be staked out
on the ground prior to any work and verified by the Board of
Public Works . Said line to be maintained throughout the con -
struction period and comply with Section 4. 133 of the Zoning
By Law ;
i ) Profiles shall be provided for all cross country sewers;
J ) All water and sewer facilities shall be installed in accordance
with the Rules and Regulations of the Board of Public Works ;
k ) All sewer plans , profiles , and analyses will be submitted to the
Planning Board far its record.

11. If the proposed subdivision is not serviced by the proposed sewer
system , then said subdivision shall be re-submitted to the Planning
Board pursuant to M . G , L . Ch . 41 , Sec. 81-W.
12 . A. properly executed utility easement to the Town of North Andover
over either land owned' N/ F of S,tarmard Realty Trust or land owned
N/F of Sophie` Haphey , both as shown on sheet 6 o 7 on the definitive
plan,and shall be submitted to the Planning Board and recorded with
the plan .
13. In accordance with the Highway Surveyor ' s recommendations and
letter dated August 17 , 19811
a ) Any drainage problems encountered during construction shall be
incorporated into the proposed drainage system to be determined
by the Highway Surveyor;
b ) A properly executed Pedestrian Access/Egress easement, 20 feet
in width , across Lots 16 and 17 , extending to land owned by
the Town of North Andover shall be deeded to the Town of North
Andover and shall be recorded with the plan ;
c) Two catch basins shall be installed at the intersection of
the proposed road and Barker Street ;
d) The proposed cul -de-sac at approximately Station 28 + 0 shall
be raised four feet and adjusted to a 1% grade at Station 24 + 0 ;
e ) To accomodate leaching from the hill , to minimize slopes , and
to provide any necessary drainage to accomodate drains from site
development , drainage from cul -de-sac shall be continuous from
the slope side of the road from approximately Station 27 + 0
to 20 + 0 ;
f) Drain line from Station 7 + 0 to 17 + 0 shall have a connecting:
truck drain running down the southerly side of road versus the
northerly side ;
g) All shoulders and slopes shall conform with the Subdivision Rules
and Regulations and shall be seeded with hay seed as specified
by the Hiqhway Surveyor;
h ) Headwall size and shapes shall be in accordance with the High-
way Surveyor ' s recommendations ,
i ) Entry and alterations to existing street drainage shall require
a street opening permit from Highway Department;
j ) Tops of catch basin frames shall be three inches lower than
pavement ;
k) Minimum cover over any drain pipe shall be thirty inches ;
1 ) Underground utilities shall require a plan of approval and
shall be completed prior to application of hottop . Said utilities
shall be inspected by the Highway Surveyor prior to any backfilling;
m) A North Andover -Planning Board inspection form shall be used and
complied with .
14 . All slope , drainage , and utility easements shall be completely
dimensioned on plan and shall be properly executed and recorded at
the North Essex Registry of Deeds at the time the subdivision plan

is recorded . Said easements shall be deeded to the Town of North
Andover .
15 . In accordance with the Fire Department 's Tetter dated August 14 ,
1981 , the distance between hydrants shall be no greater than 250 feet .
16. In accordance with the Tree Warden 's letter dated August 11 , 1981 ,
a bond in the amount of $20 ,000 shall be posted to insure compliance
with street trees requirements , subject to inflation adjustments .
17 . If proposed subdivision is to be completed in phases , separate com-
pletion dates shall be imposed for each phase as they are initiated.
18. Binder coat shall be applied no later than November 11 , 1982 .
19 . All improvements in said subdivision shall be completed no later
than November 11 , 1983.
20. Drainage calculations refer to a spillway at elevation 138. 0 . Provide
detail on plans to show the design and location of such spillway
and submit plans to Highway Surveyor and Planning Board .
21. Revise the drain pipe size from twelve inches to eighteen inches
at Station 19 + O on Old Farm Road to be consistent with the drain
calculations .
22 . Revise the drain pipe size from twelve inches to twenty-four inches
and from eighteen inches to twenty-four inches at Station 12 + 70 +
on Old Farm Road to be consistent with the drain calculations .
23. Revise the drain pipe size from thirty inches to 18 inches at
Station 18 + 0 on Old Farm Road to be consistent with the drain
calculations .

11. If the proposed subdivision is not serviced by the proposed sewer
system, .then said subdivasron shall
be re-submitted to the Planning
Board pursuant to M.G, L. Ch . 41 , Sec. 81-W.-
12 . A properly executed utility easement to the Town, -of North Andover
over either land owner, N/•F of S-tarmard Realty Trust. or land owned
N/F of Sophie Haphey, both -as shown on sheet 6 of 7 on the definitive
plan,and shall be submitted to the Planning Board and rrcorded with
the .plan.
13. In accordance with the Highway Surveyor 's recommendations and
letter dated August 17 , 19811
a) Any drainage problems encountered during construction shall be
. incorporated into the proposed drainage system to be determined
by the Highway Surveyor;
b) A properly executed Pedestrian Access/Egress easement, 20 feet
in width , across Lots 16 and 17 ; extending to land owned by
the Town of North Andover shall be deeded to the Town of North
Andover and shall be recorded with the plan ;
c) Two catch basins shall be installed at the intersection of
the proposed road and Barker Street ;
d) The proposed cul -de-sac at approximately Station 28 + D shall
be raised four feet and adjusted to a 1% grade at Station 24 + 0 ;
e ) To ,accomodate leaching from the hill , to minimize slopes , and
to provide any necessary drainage to accomodate drains from site
development , drainage from cul -de-sac shall be continuous from
the slope side of the road from approximately Station 27 + 0
to 20 + 0 ;
f) Drain line from Station 7 + 0 to 17 + 0 shall have a connecting
truck drain running down the southerly side of road versus the
northerly side ;
g) All shoulders and slopes shall conform with the Subdivision Rules
and Regulations and shall be seeded with hay seed as specified
by the Hiqhway Surveyor;
h) Headwall size and shapes shall be in accordance with the High-
way Surveyor ' s recommendationse
i ) Entry and alterations to existing street drainage shall require
a street opening permit from Highway Department;
j ) Tops of catch basin frames shall be three inches dower than
pavement ;
k) Minimum cover over any drain pipe shall be thi_rtyes ;
1 ) Underground utilities shall require a plan of approval
and shall be completed prior to application of hot top . Said utilities
shall be inspected by the Highway Surveyor prior to any backfillin
m) A North Andover Planning Board inspection form shall be used and
complied with .
14 . All slope , drainage , and utility easements shall be completely
dimensioned on plan and shall be properly executed and recorded at
the North Essex Registry of Deeds- at the time the subdivision plan

1 is recorded. Said easements shall be deeded to the Town of North
Andover.

# 15 . In accordance with the Fire Department 's letter dated August 14 ,
1981 , the distance between hydrants shall be no greater than 250 feet ,
'4 16 . In accordance with the Tree Warden 's letter dated August 11 , 1981 ,
a bond in the amount of $20 ,000 shall be posted to insure compliance
'j with street trees requirements , subject to inflation adjustments .
17 . If proposed subdivision is to be completed in phases, separate com-
pletion dates shall be imposed for each phase as they are initiated.
18. Binder coat shall be applied no later than November 11 , 1982 .
19. All improvements in said subdivision shall be completed no later
than November 11 , 1983.
20. Drainage calculations refer to a spillway at elevation 138. 0. Providi
detail on plans to show the design and location of such spillway
and submit plans to Highway Surveyor and Planning Board .
j 21. Revise the drain pipe size from twelve inches to eighteen inches
at Station 19 + 0 on Old Farm Road to be consistent with the drain
calculations .
22 . Revise the drain pipe size from twelve inches to twenty=four inches
and from eighteen inches to twenty-four inches at Station 12 + 70 +
on Old Farm Road to be consistent with the drain calculations .
23. Revise the drain pipe size from thirty inches to 18 inches at
Station 18 + 0 on Old farm Road to be consistent with the drain
calculations .
