Dear Sir: On Monday evening, September 15, 1969, the Board of Appeals met in the Town Office Building to consider the request of Ralph C. Bevin of 69 Prospect Street for a variation of Sections 6.61 and 7.23 of the Zoning By—Law so as to permit the keeping of a garage in its present location, 10 feet 2 inches from the side lot line on the easterly side of Prospect Street, 200 feet from the corner of Chadwick Street. This hearing was advertised in the Fagle Tribune on August 30 and September 6, 1969 with all abutters being duly notified by certified mail. Members that heard the case were Arthur R. Drummond, Chairman; Daniel T. O'Leary, Secretary; Donald J. Scott, J. Philip Arsenault, Esq. and Donald J. Leonard. Mr. Bevin appeared on his own behalf. Richard E. McDonald, an abutter opposed, was represented by Atty. Herve Moisson, also an abutter and opposed. Mr. and Mrs. Bevin stated that approximately one year ago they had filed a similar petition with the Board and then withdrew it and are now appearing before the Board. They stated that there exist in the immediate neighborhood many structures on adjacent lots that are much closer to the lot line than this garage and also that there is much hard feeling among marc* of the neighbors. A list containing 15 napes of neighbors in favor of granting the petition was submitted. Arthur lent also spoke in favor. Atty. Moisson presented the objections of his clients along with photographs. Those speaking in opposition were Timothy Murphys George Guillemette, Raymond Cyr and Frank Grande. Although there were no personalities engaged in, it was very much evident that a neighborhood verbal battle was in progress. At the request of the Chairman, Building Inspector Charles H. Foster, Jr. was asked to substantiate the conditions as reported in that area. He did not represent either the petitioners or the abutters and without referring to any particular property owners by name related conditions in that vicinity and suggested that the entire area should be re—surveyed. Mr. Foster had ordered Mr. Bevins to apply to the Board of Appeals for a variance. Ralph C. Bevin -2- September 24, 1969 Taking the petition under advisement, the Board, after lengthy deliberation, voted unanimously on the notion of Daniel T. OtLeary, seconded by Donald J. Leonard to GRANT the variance. The reasons for granting are that unless the variance is granted the applicants will suffer substantial hardship, financial or otherwise; it will not adversely affect the public good to any substantial exten* and will not materially affect the general character of the neighborhood; and the requested variance will not be in substantial derogation from the intent or purpose of the Zoning BY-Law.
