This was a special meeting called at the order ef the shaiz~m and at
the request of Mr, Wil~am J, Byrne~ ~3 Lowell Street~ Lameence,
Mr. ~yrne was present and ~ to the Board that he ewned la~d
~eat Pond R~ad~ and for the past two years he had ,w~uccessful~ tried
~ get a building per, i% to allow the erection of a dwelling on this land.
He informed the Board that the B~ilding Inspestor had refused repeatedly to
to give permits to build ia an unapproved development. Mr. B~rne stated that
although the ba~k of has laud was en Stamleyville Avenue~ which is not an
approved street~ his land faces ~n a- accepted street amd he sould ese no
reason wh~ he sould n~t have the pe,-~'.t he requested and was appe=l~-~ to
this Board in order %e reverse the decision of the buil~ inspesto~.
Mr. ~ told th~ Beard that he was ~ aware of the difficulties that
would present themselves ~- trying to build in this area and he knew that
he hsd ~e have a permit from the ~eate and buil~ his septic tank a~d
area accerding ts State specifications, ~ also understood that he had
b~ild his house no less tb~n 250 f~e$ from the water ~ of the lake and
he stated that he was wlll'ln~ t~ comp~ with all the tulsa and regulations
£er ~ special area,
The above matter was discussed at length with Mrs Byrne amd a m~tica was
made md seconded and it was VOTe; Shat Mr, ~rne should make a for~
&pplAcation to the Board complete with plans as required ~
a~d a date for a Public ~earing was ~et f~r Monda~ evening~ Ju~ ~ 1952
Mr. Byrne ag~ed ~e this and informed the Board that he weuld comp~ with
their re~,~e~ents and would have his plans ready so %ha% t~is hearing
eould be advertised on June 30~ 1951.
Motion was made and seconded and it was VOT~ to adJearn at ~15 P.M.
