Lyons, Town Clerk Town Office Building North Andover, Ma. Dear Sir: A public hearing was held by the Board of Appeals on August St 1977 upon application of MALCOLM W. BRAWN who requested a variation of Section 6.3 and Table 2 of the Zoning By-Law so as to permit the construction of a paddle tennis court located at 161 Raleigh Tavern Lane. The following members were present and voting: Frank Serio, Jr.t Chairman; Alfred E. Frizelle, Vice-Chairman; Louis DiFruscio, Clerk; James D. Noble, Jr. and Ralph R. Joyce, Esq. The hearing was advertised in the Lawrence Eagle-Tribune on July 23 & 30t 1977 and all abutters were duly notified by regular mail. There were no abutters present at the hearing and there was no opposition. The immediate abutter, Frank Gelinas, had notified the Board that he was in favor of the petition. The same Board members met again on August 221 1977 to vote on the petition. Upon motion by Mr. DiFruscio, seconded by Mr. Nobler the Board voted unani- mously to GRANT a variance of Section 6.3 and Table 2 of the By-Law. A hardship is created because of the unique shape of the land which prohibits the placing of the structure at any other place but this location. This would not derogate from the intent of the Bye-Law since there is sufficient space between the buildings.
