Seven Oaks Definitive subdivision
Conditional Approval cy:
4 . Remove the stump hole area from its current location
shown on lot 20. Expand the stump hole area V 4tsim
and 17 .
5. The applicant shall submit revised stormwater runoff
calculations which will show the mitigation of runoff
for this subdivision. The system will be designed to
handle a 100 year event.
6 . All plans currently before the Planning Board must receive
NACC approval. Any changes in the current plans called for
by NACC shall be submitted and reviewed by the Planning
Board under a Definitive Modification APplication.
7. An easement for the extension of Seven Oaks Road from the
edge of the temporary turnaround easement to the land owned
by Edward and Ida Miller shall be granted to the Town upon
the final acceptance of the roadway by the Town as a public
way. This action will allow for the possible extension of
Seven Oaks Road to connect with Forest Street.
8. All lot numbers shall be posted during construction.
9. All homes servedbya common driveway shall install
residential sprinkler systems in accordance with NEPA 13D.
10. All septic system design shall be approved by the Board
of Health prior to any building permits being issued for
any lot in this subdivision.
11 . The phasing plan for this subdivision as submitted by the
applicant in his October 19 , 1987 letter, is hereby approved.
12 . All Planning Board Order of Conditions are to be placed on
the recorded Definitive Plan, (cover sheet) prior to
endorsement and filing with the Registry of Deeds.
13. Prior to signing the Definitive Plans all executed deeds
of easements and parcels shall be submitted to the Planning
Board and held in escrow until the completion. At the time
of completion and prior to final security release, the
developer shall record said documents for the Town.
14 . A certified document from a Professional Engineer and/or
Land Surveyor shall be submitted to the Planning Board
after the completion of each phase verifying that all
utilities (including electric, telephone, sewer and cable)
have been installed in accordance with the plans prior to
binder coat of application. Installation shall be in
accordance with plans and profile prior to the release of
any lots.
15. A bond in the amount of $4,500 for the As-Built Plans
shall not be released until approved by the Planning
Board.
16. No Certificate of Occupancy shall be issued for any
structure built in this subdivision prior to the binder
coat of bituminous pavement being placed to the satisfaction
of the Department of Public Works.
17. The water main on Sugarcane Lane and Seven Oaks Road shall
be 8" pipe installed 10 feet left of the center line of
the road. Eight inch gate valves shall be installed at
station 1+90 on Sugarcane Lane and at stations 1+00, 4+60
and 4+80 on Seven Oaks Road. All water mains shall be class
52 ductile iron cement lined water pipe installed with
5 feet of cover below the finish grade. All gate velves shall
comply with AWWA specifications L500 52T and will be supplied
with a 100 lb. sliding type gate box marked "WATER MAINS" .
All water mains shall pass leakage and pressure tests
performed in accordance with Section 13 of the AWWA
Standard C600 and shall be clorinated in accordance with
AWWA C601 "Standards Procedure for Disinfection of Water
Mains. "
18 . Hydrants shall be installed at station 1+10 and 9+0 on
Seven Oaks Road and at station 1+75 Sugarcane Lane. All
hydrant branches shall be provided with six inch Mueller
or equal gate valves (open left) . All hydrants shall be
Eddy Breakflange Hydrants to North Andover specifications.
19 . Tree cutting shall be kept to a minimum throughout the
project in order to minimize erosion and preserve the
natural features of the site. Accordingly, the developer
in conjunction with a registered arborist shall submit
a tree cutting and reforestation plan(the plan is for areas
of substantial cutting and fillings) to be reviewed by the
Planning Board. This plan shall explicity include specific
trees to be retained. Also, the developer shall inform
the Town Planner when sighificant tree cutting is to occur
in order that the Planner may determine the need to be
present.
20. Adequate sidewalks shall be provided by the applicant at the
discretion of the Planning Board after it receives input
from the Department of Public Works and other pertinent
Town Departments concerning the need for sidewalks in
this section of Town.
21 . The Planning Board shall approve an erosion control plan
prior to any building permits are issued for any lot
contained in this subdivision.

Preliminary Plan
Conditions of Disapproval
June 151, 1987
1. A request for determination has not been filed with the North Andover
Conservation Commission per Section 310 CMP, 10.57(4) (b) under Chapter
131 - wetlands Protection Act, and the local wetland bylaws and the
definitive plans do not delineate the edge of the bordering vegetated
wetlands.
2. The Highway surveyor's recommendations were not taken into to account
as follows:
- water main installation as shown is not acceptable, the applicant
shall check with the Town Engineer to design the water main
installation to meet town specifications.
- Catch basins to be 8" precast concrete units and all brick used to be
clay type and be laid in good quality Portland cement motor.
- Road binder width to be 28 ft.
- Drain manhole at station 5+75 to be situated off the pavement.
- All phases of construction and utility installation to be inspected
prior to backfilling and all town policies and specifications are to
be adhered to. Permit form to be used and to be signed off at each
stage.
3. The Fire Chief's recommendations were not taken into account as
follows:
- Fire hydrants to be installed at 500 foot intervals. Hydrant should
be placed at station 1+00.
Lot numbers are to be posted during construction.
- No open burning is to be permitted except during open burning season
under fire department regulations.
- All builders must comply with the Fire Department's underground fuel
storage regulations.
- Permanent house numbers shall be posted on dwellings prior to
occupancy-
- Prior to occupancy, the subdivision streets shall provide adequate
access to each residence by having had the binder coat applied.
4. The Police Department's recommendations of street signs and numbers on
all homes in the subdivision were not indicated on the plans.
5. The NACC recommendations were not take into account as follows:
- The roadway configuration is unacceptable in that the resultant lot
configuration for Lots 7, 8 and 9 would require extensive filling of
wetlands at the front of the lots to gain access to the upland area
in the rear of the lots. The roadway and/or lots must be
reconfigured to minimize or eliminate this wetland filling.
6. A detailed waiver request for the length of the roadway which exceeds
the maximum set cat in the Subdivision Rules and Regulations hast

been approved by the Planning Board.
7. Drainage calculations shall be submitted to mitigate runoff. No
calculations or drainage plan has been submitted to show mitigation
from increased rate of runoff from the locus for the 100 year storm
event.
8. No lots shall be released from the covenant running with the property
until the following is conpleted. All drainage is constructed in
accordance with the Subdivision Plans, including binder coat
application, all utilities, including but not limited to, fire alarms,
water lines, sewer, drainage, electric, gas, cable shall be installed
in accordance with plans.
9. As the connection with the Jerad Place II Subdivision has not been
resolved to connect with this subdivision, the applicant shall consider
an alternate plan.
10. Lot 3 does not have frontage and is therefore an unbuildable lot. The
lot shall be removed until the road is actually connected through
providing frontage. - -
11. A definitive plan submittal shallprovidea detailed phasing plan for
the total development. No construction shall occur until the phasing
has been approved by the Planning Board. No phasing has been submitted
with the Preliminary Plan.
12. A detailed tree plan in accordance with Section V, R and IV.1 has not
been submitted with the plan for review by the Planning Board and the
Tree Warden.
13. A stump pit burial plan has not been submitted to the Planning Board
and Highway Department for review and approval prior to any on-site
construction.
14. The applicant shall be advised that in the event a Definitive Plan
evolves from this Preliminary Plan and/or parcel of land, the North
Andover Planning Board will require upon submittal that all aspects of
the Rules and Regulations governing the Subdivision of land mast be
strictly adhered to and will be a requirement notwithstanding this
decision.
15. The applicant has not complied with the Tree Department's
recommendation to preserve existing trees and to bond for new planting.
16. The plan, as submitted, does not show adequate access to the proposed
lots. The powers of a planning board (...under) the subdivision
control law shall be exercised with due regard for the provisions of
adequate access to all of the lots in a subdivision by ways that will
be safe and convenient for travel...and for coordinating the ways in a
subdivision with each other and with the public ways in the ...or town
in which it is located and with the ways in neighboring subdivisions.
(Chapter 41, Section 81M, M.G.L.) Access must be provided either via
an approved public road or over private ways built to the standards of
the subdivision rules and regulations over land to which the developer
can prove he has ownership or right-of-way.
17. There shall be no ccm m driveways within this subdivision.
18. The subdivision makes no provisions for connecting to Forest St. as was
presented tothePlanning Board.
