Buthman 1625 Turnpike St. Petition No. 26-180 Daniel Long, Town Clerk Town Office Building North Andover, Mass. 01845 Dear Sir: A'public hearing was held by the Board. of Appeals on October 14, 1980 upon application of Fred and Ednah Buthman requesting relief of the Building Inspector's decision of September 10, 1980 and enforcement of the Board of Appeals decision of July 9, 1975 concerning the operation of United Freightways, Inc. on Turnpike Street. The decision is dated August 28, 1975• The hearing was advertised in the Lawrence Eagle Tribune on September 29 and October 6, 1980 and all abuttors were notified by regular mail. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice—Chairman; Richard J. Trepanier, Esq., Clerk; William J. Sullivan; and Augustine Nickerson. The petitioner in this matter is an abuttor of property owned by Charlotte Rea — United Freightways, Inc., located on Turnpike Street. This Board, in the matter of United Freightways, Inc., Petition No. 8—'75, found that the use as proposed by the petitioner in that matter was not in conformance with the By—Law. The decision of the Board, dated August 28, 1975, was appealed to the Superior Court, and as of this date the Court has not rendered a deoision. The petitioner requested enforcement of the By—Law by the Building Inspector, who rendered a written opinion, dated September 10, 1980, addressed to Attorney Charles - Trombly. The petitioner seeks a review of the decision of the Building Inspector. s Fred A. and Ednah E. Buthman Petition No. 26-180 Page 2 October 24, 1980 Upon a motion made by Mr. Frizelle and seconded by Mr. Trepanier, it was voted unanimously that the decision of the Building Inspector dated September 10, 1980 addressed to Attorney Charles Trombly wherein he states: "The so-called bark operation is I consider a legal non-conforming use being a storage and processing area that has been used through the years for similar purposes; therefore, in my opinion, there is no zoning violation..." is overruled.
