Dear Sir:
In regard to the entrances and exits at the Doctors building
located at Massachusetts Avenue and Marblehead Street, I would
recommend that the road leading in off Massachusetts Avenue and
the road coming out from the rear of the Doctors building onto
Massachusetts Avenue where only a right hand turn is allowed is
ample. There should not be such a volume of traffic going in and
coming out to create any problem. The plan indicated there would
be another entrance and exit on Marlblehead Street in the area of
Dana and Dewey Streets. This portion of Marblehead Street is very
narrow and the present time these streets are receiving an extra
volume of traffic due to the one-way signs that have been install
ed recently and to burden them with additional traffic would be
unfavorable. Because of the type of business that will be carried
on in this Doctors building I do not feel tie will be a great
volume of persons going and coming at the same time. I feel the
abovementioned entrances and exits are ideal because when persons
exit from the Doctors building unto Marblehead Street one can
only take a right hand turn (which is a one way street) towards
Massachusetts Avenue to the stop sign and are able to enter Massa-
chusetts Avenue at that point without difficulty. To confuse the
situation by adding additional entrances and exits would only cause
a problem, not only with the neighborhood by also traffic problems
as these roads are very narrow and cannot handle any additional
traffic than they have at the present time. I strongly recommend
at the present time to have only the entrance on Massachusetts Ave-
nue and the exit on Marblehead Street. If in the future there is
any problem with having only this entrance and exit, plans could
be made to create additional entrances and exits from this Doctors
building.

1. LENNON, Autran Ave.: Was refused a building permit because the lot
is undersized.
2. REA, Earth Removal Permit:. From my inspections of Mr. Rea's pit, in
my opinion, he has met all of the requirements of the earth removal
by—law and I recommend that his permit be renewed.
CLASSIC REAL TRUST, Mass. Ave.: When the plot plan was submitted
with the building permit application for the renovation of Glennie's
Milk plant, the present owners were made aware of the fact that a
portion of their proposed parking for their professional building
was located in a residential district and could not be allowed without
a special permit.

At its regular monthly meeting on Novmeber 10, 1980, the Board of Appeals
voted unanimously to amend condition #f on the above petition to read as
follows:
An evergreen screen of a minimum height of two (2) feet when planted which
will grow to at least six (6) feet, and planted so as to provide a solid
barrier along the perimeter of the property located in the R-4 zone, starting
at the corner of Marblehead and Williams Streets and proceeding to the
Northwest corner for eight (8) parking spaces as indicated on the plan.
An amended plan showing the above change will follow.

A public hearing was held by the Board of- Appeals on June 11, 1979 upon application
of Classic Realty Trust who requested a Special Permit under Sec. 4.11 (3) of the
Toning By-Law so as to permit parking beyond zoning district line (100 ft.) on the
premises located at 198 Massachusetts Ave. and shown on a plan of land dated April �
24� 1979, revised .ay 21, 19?9. The following members were present and voting: ;i
Alfred E. Frizelle, Esq. , Vice-Chairman; R. Louis DiFruscio, Clerk; James D. Noble,
Jr.; Richard J. Trepanier, Esq. ; and Assoc. Member, William J. Sullivan.
The hearing, was advertised in the North Andover Citizen on R?ay 24 & 31, 1979 and all
abutters were duly notified by regular mail.
The petitioner seeks a special permit as permitted pursuant to Sec. 4.11 (3) of the
By--Law to use •a portion of its premises located at a site designated as 198 14ass.
Ave. 'which are in an R-4 District for purposes of vehicle parking.
The petitioner testified and presented satisfactory evidence at the hearing to show
that the lot was of record on June 5, 1972 in one 6:-mership.
The Board, on motion made by 11r. Noble and seconded by Mr. Trepanier, voted to GRANT
the Special Permit. In approving this Special Permit, the Board has found:
that the site in question is an appropriate location for such use since it is
adjacent to a General Business District and has been for a great number of years;
that the use for parking motor vehicles will not adversely affect the neighborhood;
that a nuisance and hazard will not be created;

that adequate and appropriate facilities will be provided;
that the use is in harmony with the intent and purpose of the By-Law.

Ilurther, the Board in approving this Special.Permit makes it subject to the follow—
ing conditions:
1 ) there shall be only one entrance to the premises located on Massachusetts Ave.
2) -there shall be only one exit from the premises located on Williams St., also
known as Marblehead St.; all vehicles exiting must make a right turn;
3) there shall be no other exit or entrance t.o the premises;
4) the existing warehouse and block building must be removed within the (10) months
from the date of this permit;
5) that this Special Permit is only for parking within the R-4 District and shall
expire upon conveyance by the applicant or upon a change of use of the premises from
office use;
6) that an 8" curb along the property line on Marblehead St. be constructed which
shall extend to the exit;
7) an evergreen screen of a minimum height of two (2) feet vhen planted which will
grow to at least six (6) feet, and planted so as to provide a solid barrier along
the perimeter of the property located in the R--4 zone, starting at the northwest
corner of the property and ending on the corner of Marblehead St. and Williams St.

8) an amended plan showing the above requirements is to be submitted to the Board

CLASSIC Rr,LTY TRUST DECISION -2—
?+'arther, the Board in approving this Special Permit makes it subject to the follow—
ing conditions:
1 ) there shall be only one entrance to the premises located on Massachusetts Ave.
2) there shell be only one exit from the premises located on Williams St., also
Imo%-a as Larblehead St.; all vehicles exiting must make a right turn;
3) there shall be no other exit or entrance to the premises;
4) the existing warehouse and block building must be removed within the (10) months
from the date of this permit;
5) that this Special Permit is only for parking within the R-4 District and shall
expire upon conveyance by the applicant or upon a change of use of the premises from
office use;
6) that an 8" curb along the property line on Marblehead St. be constructed which
shall extend to the exit;
7) an evergreen screen of a minimum height of two (2) feet when planted which will
Lrow to at least six (6) feet, and planted so as to provide a solid barrier along
the perimeter of the property located in the R-4 zone, starting at the northwest
corner of the property and ending on the corner of Marblehead St. and Williams St.
marred on the Alen (as amended) as "D11; all areas on the plan not sho;in as paved
must be loamed and seeded;
8) an amended plan showing the above requirements is to be submitted to the Board
for final approval.

He alleges and some of our members have also noticed that the Conditions
of this Special Permit are not being adhered 'to, specifically: 1) there
