TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS December 15 , 1982 Petition No . 42- 182 George and Mary Doumani 150 Chadwick Street Mr . Daniel Long , Town Clerk Town Office Building North Andover , Mass . Dear Mr. Long : The Board of Appeals held a public hearing on Monday evening, December 13 , 1982 upon the application of George and Mary Doumani . The hearing was advertised in the North Andover Citizen on November 24 and December 2 , 1982 and all abutters were notifed by regular mail '. The following members were present and voting : Alfred E . Fri zel1e , Esq . Vice Chairman ; Richard J . Trepanier , Esq . , Clerk ; William J . Sullivan ; Augus- tine W . Nickerson ; and Maurice S . Foulds . The petitioner seeks a variance from the provisions of Section 7 , Paragraph 7 . 3 and Table 2 as it relates to yard setbacks to allow relief from the side and rear setbacks to allow the continued ex- istence of a single family dwelling having less than the required setbacks on the premises located at 150 Chadwick Street The petitioner testified through counsel that the dwelling was constructed several years ago and when a recent plot plan was required by the bank to secure a mortgage , it was discovered that the dwelling did not meet the setback requirements , Upon a motion made by Mr . Trepanier and seconded by Mr . Nickerson, the Board voted unanimously to grant the variance as requested . The Board finds that each of the provisions of Section 10 ,4 of the Zoning By Law have been satisfied . In particular; the Board finds that due to the location of the structure on the premises for many years with a deviation from the existing requirements Petition No . 42- 182 R EIVED George and Mary Doumani DAH171.
