Lyons, Town Clerk Dear Sirs The following petition was heard at a Meting of the Board of Appeals on Dle®day evening, January 310 1965 at the Town Office Building. Nssabers present and voting were# Daniel T. O'Leary, Chair=&; William Xerten, Secretary; Henry 8. Lmd, John J. Shields and Arthur Drummond. M SON W.A. DOWNING & LOUIS H. WALOON requested a variation of See. 6. Para. 6.31 & 6.Al of the Zoning By-Lav so as to permit the subdivision and the sale of a portion of their land on the premises, located at the north side of Third Street; 100 feet distant from the corner of Main Street and known as #15, 17 & 23 Third Street. This public hearing was advertised in the Eagle Tribune on December 28, 1964 and Jan— uary 4, 1965. All abutters were duly notified by certified mail of this hearing. Representing the petitioner was Atty. john J. Willis who stated that the inteaat and purpose of the subdivision of land at #17 & 23 Third Street and to lots A & B, for cook let was for the ultimate intent of deeding the lot 30s as shown on a plan of land in North Andover, said plan dated January, 1965 by Brasseur Associates, registered land surveyors, to the Raman Catholic Archbishop of Boston. Area for an additional parking area for the presently existing elementary Parochial school abutting the rear sections of said land. That with respect to lot #23 Third Street property owned by Mason W. L Downing, the remaining square footage would consist of 12,540 sq. ft, well within the total sq. footage required under present zoning requirements, but having less them the required street frontage. That with respect to #17 Third Street, the land owned. by Louis H. McAleen, there would be retained the amount of 21,352 sq. ft. more or less, The zoning classification for this lot is for General Business and thereby would reduce the total square footage below that as approved at the time of adoption of the present zoning requirements, That the improvements to said land, now residential, and that the residual land to be retained by Mr. XcAleen would be in excess of sent lots in the aeightiorhoed. That at the !resent time., both parcels as shown as lot Die of not extreme depth removed from street frontage and an analysis of the typical lots in the iNnodiate neighborhood most be classified as omens land. Jam&ry 1$, 3.965 In Executive sessions the award considered all pertinent factors pertaining to the subject petition and upon motion of Beard member Morton, secoWed by Mr. Ltad, it was unanimously voted to GRA144' the petition with the restriction that the petition be so granted so as to provide and restrict the cenveyawo of said property to the Roma Catholic Archbishop of Boston, in conformity for the purposes to vhich the petition was formally filed. Granting of the petition was for the following reasonss a. With respect to the property of Mr. Downing, the Board finds that so fundamental change from the lot's mm—eoeforning size is affected. b. That with respect to the property of Ito. NeAloon, that the deletion of 4.,285 sq. feta swill not materially change the characteristic or end use of the present lot C. c. That the granting of thisi petition will not be in derogation to or adversely affect the lets of the immediate ne ghborlood. d.
