Mr. Nilliam F. Wood~ 26 Massachusetts Avenue~ North ~ndover was present before the
Board requesting information as to what steps he should take to acquit're a non-
conforming use permit so as to enable ~i~ to erect~ operate and maintain a
greenhouse and accessory tool shed on Bay State Road. Mr. Wood stated that
he wished to make an application ~for this type of permit ra~ther tha~ have the
property in question re-zoned into bus~_nesse He also stated that he already
had a building permit from the Building Inspector~ but had been advised that
~ should appl~ for a non-conforming use permite He stated that a complaint
had been filed with the Board of Selectmen regarding the erection of this
greenhouse~ which is already in progress~ he. having done the building himself
in his spare time~ but that he wished to do the thing right and had been advised
by the Board of Selectmen to come before this Board and to make a form~l appli-
cation for a non-conforming use permit. The Board felt at this time that this
would in effect be an amendment to the Zoning By-Laws and advised Mr. Wood that
they would take this matter under advisement and inform him whether or not they
could consider an application of this type.
After discussing the above matter~ the Board felt that they did not have the
power to grant this type of permit as in effect it would be an amendment to
the Zoning ~y-~ws and that this matter should be referred to the Planning
Board for a re-zoning. Notion ~s made and seconded and it was VOTED that
Mr. Wood be informed of this decision by letter~
Mr. & Mrs. George Portors were present before the Board requesting information
as to the procedure to be followed in order to make an application for a variance
to the zoning by-lawa to enable them to add to a one stall garage and thereby
make it l~rge enough to accomodate two cars. They were informed that they would
have to make formal application for a variance and have it considered at a
Public Hearing. Date for the Hearing was set for October 22, l~9~l.
Motion was made and secconded and it was. VOTED to adjourn at lO:15 P.M.
