The applicant, the Institutes seeks a special pereeit
under SECTION 8 of the Uzi" Bylaws of the Town,, as most recently

Dear Six:
DECISION
The Board of Appeals held a Public Hearing oR Monday evening,
December 9, 1957 on the ippplieatiou of Massachusetts Institute of
Technology requesting a variation of the Zoning Ordinance so as to
permit the erection of a certain radar tower for antenna test measure-
ments,, to a height in excess of that permitted by Section 5 of said
Zoning By-Law entitled "Building Heights Permitted", on Millis Hill.,
off 300 Chestnut Street, North Andover.
This Public Hearing was advertised in the Lawrence Evening Tribune
on November 27, 1957 and the abutters were duly notified.
The members present and voting on this application were: Donald F.
Smith, Chairman; Daniel O'Leary, Henry E. Lund, Nicholas F. Nicetta and
John J. Willis, Associate Member.
Mr. Nicetta made the motion to GRANT the variance, seconded by Mr.
Willis and voted unanimously by the Board for the following reasons:
It appears to the Board that this tower is a necessary adjunct to
the transmitting tower located on Boston Hill, for which tower the Board
of Appeals has previously granted a variance under date of January 28,
1957.
It appears that there are no buildings in the near vicinity ee that
there would be no danger to surrounding structures. It further appeess
that no transmitting is contemplated from this tower, but the tower is to
be used solely to test and measure signals to be sent from the radar tower
on Boston Hill.
It also appears that the erection of this tower is important in the
interests of our national. defense. The Board therefore GMUS the
variance applied for provided that the tower and appurtenances be con-
structed substantially in conformity with the plan submitted and on file

Building Inspector issue the necessary, building permit in accordance
with this decision.

Dear Sir: VISION
The Board of Appeals held a Public Hearing on Monday evening, August 12, 1957
on the application of the Boston Ski. Development Corporation and John C. Farnum `
requesting a variation of the Zoning By-Laws so as to permit to change and/or
extend a non-conforming use and for a variation from the requirements of the
Zoning Ordinance, and all other inconsistent provisions thereof; on the premises,
located at the West side of Route 13d+, opposite the intersection of Johnson Street,
and known as Boston Hill.
This Public Daring was advertised in the Evening Tribane on July 29, 19571, and
the abutters duly notified.
The members present and voting on this application weres Donald F. Smith, Chair-
man; Daniel O'Leary, Nicholas F. Nicetta, Kenneth Terroux and Alfred Boeglia,
Associate Member.
Mr. Boeglin made the motion that the extension of the nosy-conforming use be DUM.
Mr. O'Leary seconded the motion and was voted unanimously. The petition for ex-
tension
atension of non-conforming use is denied on the grounds that it would extend beyond
the present allowable uses by reason of the uses of land prior to the existing by-
laws.
Upon motion made by Mr. Terroux, seconded by Mr. Boeg in, it was unanimously voted
that a variance be GRANTED subject to the following conditions:
1. That the uses of the land shall be limited substantially to those out-
lined on a certain plan entitled *Site Plan, Boston Ski Development Gorp., North
Andover, Mass, Bastille Halsey Associates - Architects, dated 7-22-57.*
2. That the water storage area shown on site plait shall be fenced in by a
permanent chain link fence, 5 feet in height.
3. That the Warming Hut shown on the plan, shall be used only by patrons
of the ski lift.
I*. That the Warming But as shown on the plan, shall be constructed only
upon condition that the wooden school house shown on site plan shall no longer
be used in connection with the ski lift.
5. The parking area shall be limited as now shown on the plan and shall

6. The ski lifts shawl be used only in connection with skiing.
7. The Warming Hut shall be of fire resistant interior comstruotion and
shall be satisfactory to the Board of Fire Engineers of the town.
The petition for a Variance is granted because the Board finds that the area in
question is of a very steep grade and not suitable for use as a residential area
nor as use for farming or other agricultural activities. The present area Visa
been used since prior to the effective date of the Zoning By-,Law as a ski lift.
The Board further finds that because of the unique character of this land and
because of its Unsuitability for other permitted uses in this zoning area by
reason of its unusual topography, a variance as here applied for may be granted
without substantial detriment to the public good and without nullifying or sub-
stantially derogating from the intent or purpose of the zoning by-law.
The Board finds that under the heretofore existing non-conforming use, a serious
traffic problem was caused by reason of the parking of oars of patrons of the
ski lift on the surrounding roadways. The Board also finds that under the here-
tofore existing non-conforming use, a wooden school building on the northeasterly
,wide of Route 1.14 had been used in connection with the ski lift. Such use of
' the school house caused a traffic basard, with pedestrians crossing the highway,
Under the variance hereby granted, this condition will be alleviated by reason
of the provision for parking areas and a so-called warming but can the westerly
side of Route 3-14, which will eliminate the serious traffic problem.
